Guillain-Barré Syndrome (GBS), with a global incidence of 1–2 cases per 100,000 population annually, remains the most common cause of acute flaccid paralysis. Standard treatment includes plasma exchange within 4 weeks or intravenous immunoglobulin (IVIg) within 2 weeks of symptom onset. However, IVIg may still benefit selected late-presenting cases. In addition, relative renal function (RRF) is performed by DMSA scintigraphy and estimated from the radiopharmaceutical uptake in both kidneys with radiation attenuation correction. Background: This study examines the social construction of sexual orientation among adolescents, particularly non-heterosexual, in Daerah Khusus Ibukota (DKI) Jakarta, Indonesia. Currently, non-heterosexual adolescents tend to recognize their sexual attraction earlier than previous generations.

Methods: A mixed methods approach was used. We conducted in-depth interviews with foundations focused on HIV/AIDS management and groups with non-heterosexual orientations. For the quantitative portion, 267 adolescents (89 non-heterosexual and 178 heterosexual) completed a validated questionnaire. We conducted univariate and bivariate analyses examining gender distribution as well as the association between social construction factors and the formation of sexual orientation.

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาความรับผิดทางแพ่งของบริษัทแม่ต่อผู้เสียหายที่ได้รับผลกระทบจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก โดยเป็นการศึกษาวิจัยเอกสารจากบทบัญญัติกฎหมาย คำพิพากษาศาล หนังสือตำรา และบทความเชิงวิชาการที่เกี่ยวข้อง ทั้งในประเทศและต่างประเทศ ผลการศึกษาพบว่า ปัจจุบันพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 ยังไม่มีบทบัญญัติให้บริษัทแม่เข้ามารับผิดชอบในความเสียหายจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก หากบริษัทแม่มีส่วนร่วมในแหล่งกำเนิดมลพิษหรือกำกับดูแลบริษัทลูก แต่ขาดการยึดถือแหล่งกำเนิดมลพิษทางกายภาพหรือเจตนาเพื่อตนอย่างใดอย่างหนึ่งไป อันไม่ครบองค์ประกอบของการเป็นผู้ครอบครองที่ต้องรับผิดตามมาตรา 96 หากบริษัทแม่มีการกระทำที่ไม่คำนึงถึงความเป็นนิติบุคคลของบริษัทลูกที่ไม่ใช่การกระทำละเมิด หากแต่เป็นการใช้โครงสร้างความเป็นนิติบุคคลของบริษัทลูกในทางมิชอบ อันได้แก่ การใช้นิติบุคคลเป็นเครื่องมือเพื่อหลบเลี่ยงหรือรับหน้าที่หรือความรับผิด และการมีทรัพย์สินปะปนกัน ดังนั้น จึงสมควรกำหนดบทบัญญัติที่เกี่ยวกับความรับผิดของบริษัทแม่ภายใต้พระราชบัญญัติดังกล่าว เพื่อให้ผู้เสียหายในคดีมลพิษจะได้รับความเป็นธรรมในการเยียวยา

วิธีการทางกฎหมายอันเหมาะสมและบทบัญญัติของกฎหมายที่เพียงพอต่อการลงโทษนิติบุคลคลซึ่งละเลยหน้าที่อันต้องกระทำการหลังการขุดเหมืองแร่นั้นถือเป็นประเด็นในทางกฎหมายที่หลายประเทศทั่วโลกไม่ได้ให้ความสนใจเท่าไรนัก นอกจากการละเว้นหน้าที่ดังกล่าวโดยประมาทจะส่งผลร้ายทั้งทางตรงและทางอ้อมต่อสิ่งแวดล้อมและชุมชน บริเวณรอบพื้นที่แล้ว การกระทำดังกล่าวยังส่งผลเสียต่อตัวนิติบุคคลด้วย ในอินโดนีเซียมีผู้เห็นว่าการบังคับใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวก็สามารถป้องปรามการกระทำดังกล่าวได้อย่างเพียงพอ แต่อย่างไรก็ตาม เมื่อได้ศึกษาเปรียบเทียบกฎหมายของอินโดนีเซียกับประเทศไทยและแอฟริกาใต้แล้ว พบว่ามีการใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครอง ดังนั้น กรณีดังกล่าวจึงนำมาสู่ปัญหาของงานวิจัยฉบับนี้ว่า การบังคับใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครองต่อความผิดฐานละเลยหน้าที่ที่พึงต้องกระทำหลังการขุดเหมืองแร่โดยประมาทจะมีผลสัมฤทธิ์มากกว่าการใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวหรือไม่ และการใช้โทษทางอาญาในความผิดฐานดังกล่าวนั้นขัดต่อหลักความได้สัดส่วนและหลักการกำหนดความผิดในทางอาญาหรือไม่ บทความวิจัยนี้จึงมุ่งศึกษาปัญหาดังกล่าวโดยเน้นการวิเคราะห์หลักเกณฑ์ทางทฤษฎีที่เกี่ยวข้อง และเปรียบเทียบกฎหมายของประเทศไทยและแอฟริกาใต้

บทความวิจัยนี้ศึกษาพัฒนาการของการตีความมาตรา XXI(b) ขององค์การการค้าโลก (WTO) เกี่ยวกับข้อยกเว้นด้านความมั่นคง ตั้งแต่ยุค GATT จนถึงปัจจุบัน โดยวิเคราะห์แนวปฏิบัติและคำวินิจฉัยในการยกอ้างข้อยกเว้นนี้ ผลการศึกษาพบว่า ในยุค GATT และ WTO ตอนต้น การตีความมาตรา XXI ยังขาดความชัดเจน โดยมีการอ้างอิงข้อยกเว้นนี้น้อยมาก และในกรณีที่มีการอ้างอิง ส่วนใหญ่มักยุติด้วยการเจรจา ตกลงกันโดยไม่ผ่านกระบวนการวินิจฉัยที่จะก่อให้เกิดบรรทัดฐานหรือแนวปฏิบัติ อย่างไรก็ตาม นับตั้งแต่ยุคสงครามการค้า การอ้างอิงข้อยกเว้นนี้ตามมาตรา XXI(b) ได้แพร่หลายมากขึ้น และคณะกรรมการวินิจฉัยข้อพิพาทแห่ง WTO ได้แสดงแนวโน้มที่ชัดเจนยิ่งขึ้นในหลายประเด็น เช่น การให้รัฐใช้ดุลพินิจในส่วนของบทนำและเป็นอำนาจพิจารณาของคณะกรรมการวินิจฉัยข้อพิพาทในบทเฉพาะ การแบ่งองค์ประกอบของบทบัญญัติและการตีความ “ผลประโยชน์สำคัญในด้านความมั่นคง” แต่ยังคงมีประเด็นที่ไม่ชัดเจน โดยเฉพาะในเรื่องการตีความ “สถานการณ์ฉุกเฉินในความสัมพันธ์ระหว่างประเทศ” และขอบเขตการใช้ดุลพินิจของรัฐที่จะถูกตรวจสอบโดยคณะกรรมการวินิจฉัยข้อพิพาท

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางการกำกับดูแลบริษัทโฮลดิ้งภายใต้พระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 โดยเปรียบเทียบกับกฎหมายและแนวปฏิบัติของต่างประเทศ เพื่อเสนอแนะแนวทางการปรับปรุงกฎหมายที่เหมาะสมสำหรับประเทศไทย การวิจัยใช้วิธีการศึกษาเชิงเอกสาร โดยวิเคราะห์เปรียบเทียบบทบัญญัติของกฎหมาย แนวปฏิบัติ และคำพิพากษาที่เกี่ยวข้องกับการกำกับดูแลบริษัทโฮลดิ้งตามกฎหมายการแข่งขันทางการค้าของสหรัฐอเมริกา สหภาพยุโรป และสาธารณรัฐเกาหลี ผลการศึกษาพบว่า กฎหมายการแข่งขันทางการค้าของไทยมีข้อจำกัดสำคัญในการกำกับดูแลบริษัทโฮลดิ้ง เนื่องจากนิยาม “ผู้ประกอบธุรกิจ” มีขอบเขตจำกัดเฉพาะผู้ที่ประกอบธุรกิจโดยตรง ทำให้ไม่ครอบคลุมถึงบริษัทโฮลดิ้งที่แม้จะมีอำนาจควบคุมบริษัทในเครือแต่มิได้ประกอบธุรกิจด้วยตนเอง ในขณะที่กฎหมายต่างประเทศมีการตีความอย่างกว้างให้ครอบคลุมถึงบริษัทที่มีอิทธิพลต่อการดำเนินธุรกิจของบริษัทอื่น หรือมีบทบัญญัติเฉพาะในการกำกับดูแลบริษัทโฮลดิ้ง การวิจัยนี้จึงเสนอให้แก้ไขนิยาม “ผู้ประกอบธุรกิจ” ให้ครอบคลุมถึงบริษัทที่มีอำนาจควบคุมหรือมีอิทธิพลอย่างมีนัยสำคัญต่อผู้ประกอบธุรกิจอื่น ปรับปรุงประกาศเกี่ยวกับหลักเกณฑ์การพิจารณาความสัมพันธ์ทางนโยบายหรืออำนาจสั่งการ และออกแนวปฏิบัติที่ชัดเจนในการพิจารณาอำนาจควบคุมและความรับผิดของบริษัทโฮลดิ้ง เพื่อให้การกำกับดูแลมีประสิทธิภาพและสอดคล้องกับมาตรฐานสากล

การวิจัยนี้เป็นงานวิจัยเอกสารซึ่งมีวัตถุประสงค์เพื่อศึกษาประเด็นหลักดังต่อไปนี้ 1) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายสามารถเป็นวัตถุแห่งการควบคุมความชอบด้วยรัฐธรรมนูญของไทยได้หรือไม่ 2) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายซึ่งกำหนดให้ใช้สัญชาติของสามีเป็นจุดเกาะเกี่ยวในความสัมพันธ์ระหว่างคู่สมรสและให้ใช้สัญชาติของบิดาในความสัมพันธ์ระหว่างบิดามารดาและบุตรขัดหรือแย้งกับหลักความเสมอภาคระหว่างเพศตามรัฐธรรมนูญของไทยหรือไม่ จากการศึกษาพบว่า พระราชบัญญัติว่าด้วยการขัดกันแห่งกฎหมาย พุทธศักราช 2481 ไม่ควรอยู่นอกขอบเขตของการควบคุมความชอบด้วยรัฐธรรมนูญ เนื่องจากการเลือกกำหนดจุดเกาะเกี่ยวของแต่ละลักษณะข้อกฎหมายล้วนได้รับอิทธิพลจากข้อความคิดที่ปรากฏอยู่ในกฎหมายแพ่งและระบบคุณค่าของสังคมในขณะที่ตรากฎหมาย นอกจากนี้ ยังไม่เคยปรากฏในคำวินิจฉัยของศาลรัฐธรรมนูญไทยที่เกี่ยวกับหลักความเสมอภาคระหว่างเพศว่า ศาลอาศัยเหตุผลที่ว่าระบบคุณค่าที่อยู่เบื้องหลังบทบัญญัติของกฎหมายขัดต่อหลักความเสมอภาคระหว่างเพศเพื่อวินิจฉัยว่าบทบัญญัติกฎหมายใดขัดต่อหลักการดังกล่าว แต่จะต้องเป็นกรณีซึ่งกฎหมายบัญญัติให้ปฏิบัติแตกต่างกันและส่งผลให้บุคคลเสียไปซึ่งสิทธิบางประการอย่างเป็นรูปธรรมด้วยเหตุแห่งเพศ ดังนั้น ผู้วิจัยเห็นว่าการวินิจฉัยความชอบด้วยรัฐธรรมนูญของบทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย ควรนำระบบคุณค่าที่อยู่เบื้องหลังการบัญญัติกฎหมายมาพิจารณาประกอบด้วย นอกจากนี้ ควรแก้ไขจุดเกาะเกี่ยวในกฎหมายขัดกันของไทยให้เป็นกลางทางเพศโดยให้สามารถรองรับการก่อตั้งครอบครัวในบริบทของความหลากหลายทางเพศ
