The Separation Of Law And Morals, Noel B. Reynolds

The classic opposition of legal positivism and natural law theory resurfaces continually and reminds us that we have yet to resolve this key conflict in our ways of understanding the moral authority of law. The strengths and weaknesses of the two theories are reviewed—both have fatal flaws. Conventionalism is proposed as a means of finding internal standards in a man-made system of law. The naturally emerging standards for a conventionalist system of law turn out to be the already familiar principles of the rule of law.

Composition And Abundance Of Periphyton And Aquatic Insects In A Sierra Nevada, California, Stream, Harry V. Leland, Steven V. Fend, James L. Carter, Albert D. Mahood

The species composition of periphyton and benthic insect communities and abundances of common taxa (>0.1% of individuals) were examined during snow-free months in Convict Creek, a permanent snowmelt- and spring-fed stream in the Sierra Nevada of California. The communities were highly diverse. The most abundant taxa in the periphyton were diatoms (Achnanthes minutissima, Cocconeis placentula lineata, Cymbella microcephala, C. sinuata, Fragilaria construens, F. crotonensis , Navicula spp., Synedra acus, and S. rumpens), except in late spring and summer when several seasonal blue-green algae (Chamaesiphon incrustans, Lyngbya spp. and Oscillatoria spp.) are at their maximum densities. …

Understory Seed Rain In Harvested Pinyon-Juniper Woodlands, Richard L. Everett

Seed rain was collected on six paired tree harvest and undisturbed plots in singleleaf pinyon (Pinus monophylla)–Utah juniper (Juniperus osteosperma) stands. Approximately 14,600 seeds were collected during four years. Seed rain in undisturbed plots was similar to levels in mixed forest communities. Seed rain on harvest plots was similar to disturbed sites and grasslands. Seed rain levels reflect the current successional stage rather than the climax community type for the site. Seed rain increased in numbers and seed production per unit of plant cover following tree removal and especially on transition soil microsites. Only three to …

A Critical Edition Of Paolo Virchi's Il Primo Libro Di Tabolatura Di Citthara (1574), William E. May
Theses and Dissertations
Paolo Virchi's II primo libro di tabolatura di citthara di ricercati, madrigali, canzoni, napolitane et saltarelli (Venice: Girolamo Scotto, 157414) is typical of many tablatures written for lute and cittern during the sixteenth century. It consists of fantasias, intabulations of madrigals, solo songs for tenor and cittern, and dance music. This thesis presents a complete transcription and analysis of the collection, the only surviving copy of which is preserved in the Osterreichische Nationalbibliothek, Vienna. The edition was made from a microfilm copy obtained from this library.
Virchi's music demonstrates his command of four divergent styles prevalent in the sixteenth century. …

Wildlife Distribution And Abundance On The Utah Oil Shale Tracts, 1975–1984, C. Val Grant
Great Basin Naturalist
Distribution and abundance of 215 amphibians, reptiles, birds, and mammals were monitored for 10 years on Utah's Oil Shale Tracts using line transects, mist netting, and live trapping. Wildlife monitoring was conducted in four major vegetation types and during all seasons to establish a quantitative baseline for use in impact identification during oil shale mining. Habitat preferences were established for many species in cold desert vegetation of two types of desert shrub, and juniper and riparian woodlands. Seasonal, annual, and habitat distribution of each class demonstrated a variety of adaptive responses to environmental variables. The most important environmental variables, that …

The title of this paper may arouse the expectation that we will concern ourselves mainly with a number of adventurous anecdotes from the biography of a prominent Swiss politician of the late 19th and early 20th century. I do not want to disappoint such expectations altogether. Arnoldia Kuesii, A New Juvenile Fernlike Plant From The Lower Permian Of New Mexico, William D. Tidwell, Sidney Ash

A nearly complete juvenile fernlike plant is described here from Lower Permian rocks of New Mexico. The fossil consists of a horizontal rhizome with roots, a short thick upright aerial branch, and a tuft of dimorphic leaves. It is assigned to Arnodia kuesii gen. et sp. n. and appears to be the first juvenile fernlike plant known from the Upper Paleozoic. Abundant palynomorphs and other plant fossils associated with the fossil indicate that it is Early Permian in age.

The process of the industrialization of a previously agrarian region is not easy to analyze and evaluate since it is made up of and touches upon qualitative as well as quantitative factors of a considerable variety and complexity. Jurg K. Siegenthaler in his monograph Konflikte der Industrialisierung attempts to provide such an analysis on the basis of a historical-comparative study of two distinct cases of 19th century industrialization, Glarus, a small mountain canton of Switzerland, and Scranton, a city in the Lackawanna valley of northeastern Pennsylvania. Morality And The Rule Of Law, Noel B. Reynolds

This paper lays out the logic of a conservative view of liberty and morality based on an understanding of human nature as both social and rational on the one hand, and radically individual and self-seeking on the other. Without public virtue, a people cannot govern itself as a free people. But neither virtue nor moral truth can be legislated. The rule of law under constitutionalism is the most successful human arrangement for providing freedom and allowing moral action on the part of individuals.

A framework for recovery planning for the black-footed ferret (Mustela nigripes) is presented. Current species numbers are probably not sufficient to maintain longterm viability. Three options are presented for increasing ferret numbers: (1) increase available habitat for ferrets where they currently exist, (2) find more wild ferrets elsewhere, and (3) directly manipulate the ferret population through translocation and/ or captive rearing. The first two options are either unlikely or currently unfeasable, making it necessary to initiate the third option to ensure ferret recovery. Black-footed ferrets (Mustela nigripes) use prairie dogs (Cynomys spp.) for food and their burrows for shelter. Thus, prairie dog colonies are essential ferret habitat. Prairie dog control, which resulted in permanent loss of ferret habitat, is considered the primary reason for the ferret's endangered status today. Northern Pacific Railroad (presently Burlington Northern) lands were surveyed 1908–1914, just prior to the onset of widespread prairie dog control. In Montana the surveyed area included a belt about 483 km long and 192 km wide, from the Montana-North Dakota border westward to Livingston. In all, 6,661 sections (11.8%) of 22 …

Determing Minimum Population Size For Recovery Of The Black-Footed Ferret, Craig R. Groves, Tim W. Clark
Great Basin Naturalist Memoirs
A minimum viable population (MVP) size is estimated for the critically endangered black-footed ferret by examining five basic methods: experiments, biogeographic patterns, theoretical models, simulation models, and genetic considerations. Each method is evaluated for its applicability to the feret and endangered species in general with two criteria in mind: (1) potential research impacts to target species and (2) the value of scientific accuracy and precision in relation to short-term conservation needs. For the black-footed ferret, the genetic method proved to be the most useful, resulting in an MVP estimate of about 200 ferrets for maintenance of short-term fitness. For most …
