"The Right Of Privacy", Fernando Bustos

Brigham Young University Prelaw Review

The concept of a right of privacy is one that is currently the focal point of the argument for legalized abortion, and for women's rights in general. By examining the history of this issue, along with its influence upon the U.S. Constitution, and the decisions of the U.S. Supreme Court, we will be better enabled to understand the legal debate at hand.

Pornography And The Law, Steve Lenker Sep 1992

Pornography And The Law, Steve Lenker

Brigham Young University Prelaw Review

Pornography is big business. According to Charles Clark in "The Obscenity Debate," the pornography industry is a $10 billion a year business (974). Just as with any controversial issue, pornography has both its opponents and its proponents.

Heterogeneity Of Intergranular Damage In Copper Crept In Plane-Strain Tension, Brent L. Adams, David P. Field Sep 1992

Heterogeneity Of Intergranular Damage In Copper Crept In Plane-Strain Tension, Brent L. Adams, David P. Field

Faculty Publications

The authors wish to acknowledge support of this work by the Office of Basic Energy Sciences of the U. S. Department of Energy. An interface damage function (IDF), which statistically describes the area fraction of interface damage as a function of up to eight parameters defining crystallite interfaces, was determined for commercial purity copper specimens crept in plane strain tension. The IDF was determined from stereological parameters measured on plane sections cut through damaged specimens. The eight-dimensional space of the function was investigated by analyzing two-dimensional projections of the complete domain. Certain special interfaces were observed to damage preferentially. A …

Patent Law: Protecting Innovation In A Global Economy, Nathan O. Jensen Sep 1992

Patent Law: Protecting Innovation In A Global Economy, Nathan O. Jensen

Brigham Young University Prelaw Review

For over 200 years, the United States has been renowned for the ingenuity of its citizens, such as Franklin, Edison, and Ford. The Government has recognized this ingenuity as a national asset and has developed a code of statutes, known as Intellectual Property Law, enabling its citizens to protect and benefit from their own creativity. In the present global marketplace, these laws are increasingly vital to the competitive success of our country's technology-based economy. Patent law is one part of the larger field of Intellectual Property Law, which also includes copyright, trademark, and trade secret law.

Species Of The Cretaceous Tree Fern Tempskya From Utah, William D. Tidwell, Naomi Hebbert Sep 1992

Species Of The Cretaceous Tree Fern Tempskya From Utah, William D. Tidwell, Naomi Hebbert

Faculty Publications

Nine species of the permineralized stems of Tempskya were investigated from the Lower Cretaceous Cedar Mountain and Burro Canyon Formations, and the lower Upper Cretaceous Dakota Formation in central and southeastern Utah. Tempskya jonesii, T. stichkae, and T. readii are new and are differentiated on the basis of the radial orientation of their dorsiventral stems, their internodal lengths, the lack of sclerenchyma in the inner cortex of T. jonesii, the three nearly continuous zones of sclerenchyma in the inner cortex off T. stichkae, and the completely sclerotic inner cortex of T. readii. Specimens of T. jonesii and T. minor were …

The Prophetic Laments Of Samuel The Lamanite, S. Kent Brown Jul 1992

The Prophetic Laments Of Samuel The Lamanite, S. Kent Brown

Journal of Book of Mormon Studies

The wide-ranging sermon of Samuel the Lamanite, spoken from the top of the city wall of Zarahemla, exhibits poetic features in a censuring passage—features that bear similarities to laments found in the Bible, most notably in the Psalms. Like the laments in the Bible, those in Samuel’s speech show contacts with worship. In distinction to the biblical laments, but like the Thanksgiving Hymns of the Dead Sea Scrolls, the poetic pieces in Samuel’s sermon reveal a set of prophecies that find fulfillment in later periods, including the days of Mormon, the compiler and editor of the Book of Mormon.

When Lehi's Party Arrived In The Land, Did They Find Others There?, John L. Sorenson Jul 1992

When Lehi's Party Arrived In The Land, Did They Find Others There?, John L. Sorenson

Journal of Book of Mormon Studies

A number of statements in the Book of Mormon text indicate the presence in Lehi’s promised land of peoples other than those descended from Lehi’s party. Reasons the topic is not addressed more explicitly in the record include a focus on the Nephites (and not on other people), a generic treatment of Lamanites, an a desire not to waste space on something obvious or insignificant. Clear evidence for the presence of others in substantial populations is present in the Book of Mormon. The demographic or cultural history of Lehi’s literal descendants must take into account these other groups.

Limhi In The Library, John Gee Jul 1992

Limhi In The Library, John Gee

Journal of Book of Mormon Studies

Analysis of comparative data and historical background indicates that the quotations in Mosiah 7–22 are historically accurate. Further examination of the quotations of Limhi shows that they depend heavily on other sources. This implies some things about the character of Limhi and provides as well attendant lessons for our own day.

“Secret Combinations” Revisited, Daniel C. Peterson Jul 1992

“Secret Combinations” Revisited, Daniel C. Peterson

Journal of Book of Mormon Studies

The claim that the Gadianton robbers in the Book of Mormon are merely a reflection of nineteenth-century Masons, who were referred to in the late 1820s as “secret combinations,” is false since an 1826 use of the phrase establishes that those words were not used exclusively to describe Masons.

A Correlation Of The Sidon River And The Lands Of Manti And Zarahemla With The Southern End Of The Rio Grijalva (San Miguel), Janet F. Hilton, John L. Hilton Jul 1992

A Correlation Of The Sidon River And The Lands Of Manti And Zarahemla With The Southern End Of The Rio Grijalva (San Miguel), Janet F. Hilton, John L. Hilton

Journal of Book of Mormon Studies

We construct a detailed geographical model of the Nephite homeland areas of Manti, Zarahemla, and the river Sidon using the Book of Mormon text of around 80 BC. This model assumes that these areas are located in Mesoamerica, that the names of their surrounding seas do not necessarily correspond to local compass directions, and that the directions stated in the text are to be understood in the nontechnical normal English sense. We then describe the southern end of the Grijalva river basin, located across the southern part of the Mexico–Guatemala border. We nominate this area as a possible candidate for …

Ancient Aspects Of Nephite Kingship In The Book Of Mormon, Todd R. Kerr Jul 1992

Ancient Aspects Of Nephite Kingship In The Book Of Mormon, Todd R. Kerr

Journal of Book of Mormon Studies

Nephite kings were expected to fulfill the same roles that kings played in other ancient civilizations— commander of the military forces, chief judicial official, and leader of the national religion. A king’s success depended not only on the extent to which he performed each role, but also on the motives behind his service. Selfless rule by Benjamin-type kings commanded the respect and praise of the people, while King Noah’s quest for personal gain roused Old World disdain for the monarch. The Nephite experiment with kingship confirms that between “kings and tyrants there’s this difference known; kings seek their subject’s good; …

Anabaptist Emigration From The Old Republic Of Bern, Delbert Gratz Jun 1992

Anabaptist Emigration From The Old Republic Of Bern, Delbert Gratz

Swiss American Historical Society Review

From my living room window· I see several of the farms that were the cradle of our Bernese Mennonite Settlement made in Putnam County, Ohio, in the mid-183O's. My mind often wonders as I gaze at these old buildings, the fields and forests. I try to imagine: What these first Bernese saw when they arrived here; How they reacted to the wilderness and its animals and also to its few remaining aboriginal inhabitants; What they talked about - their memories, their concerns for themselves and their progeny; What their social, cultural, economic and religious life was like in the land …

Sound Symbolic Involvement, Janis B. Nuckolls Jun 1992

Sound Symbolic Involvement, Janis B. Nuckolls

Faculty Publications

This article examines an iconic form of communication, sound symbolism, which has been associated with oral cultures and implicated in paradigms of primitive mentality, I argue that Lowland Ecuadorean Quechua speakers use sound symbolic iconicity to create interlocutionary involvement. A speaker's performative foregrounding of a sound symbolic form simuhtes the salient qualities of an action, event, or process, and thereby invites a listener to project into an experience. This projected involvement, in turn, points the listener to deeper kinds of imaginative, intellectual, and emotional engagement with the narrative. The argument is based on an analysis of the formal and semantic …

Interface Cavitation Damage In Polycrystalline Copper, Brent L. Adams, David P. Field Jun 1992

Interface Cavitation Damage In Polycrystalline Copper, Brent L. Adams, David P. Field

Faculty Publications

The authors acknowledge the support of the Office of Basic Energy Sciences of the United States Department of Energy. Determination of an interface damage function (IDF) from a stereological procedure similar to that presented by Hilliard is described. The mathematical and experimental simplicity of the method is utilized in measuring an IDF for polycrystalline copper crept at 0.6T sub m under uniaxial tension. Whereas previous work focused on a five parameter description of the local state of a grain boundary, the domain of the IDF is increased to eight degrees of freedom in the present study to include the complete …

Relating Soil Chemistry And Plant Relationship In Wooded Draws Of The Northern Great Plains, Marguerite E. Voorhees, Daniel W. Uresk May 1992

Relating Soil Chemistry And Plant Relationship In Wooded Draws Of The Northern Great Plains, Marguerite E. Voorhees, Daniel W. Uresk

Great Basin Naturalist

Soils of the green ash/chokecherry habitat type in northwestern South Dakota were evaluated for 22 properties to determine whether any could be correlated with density of chokecherry (Prunus virginiana) and snowberry (Symphoricarpos occidentalis). Surface soils were moderately fertile, with high levels of all elements except phosphorus and nitrogen. Soils were fine textured with moderately high cation exchange capacity and saturation percentages. However, soils were nonsaline-nonalkaline with low amounts of exchangeable sodium. None of the soil properties showed good correlation with chokecherry and snowberry densities. Greatest correlations were found between each of the shrub species and grass.
