Mandatory Aids Testing, Mathew Hoch
Mandatory Aids Testing, Mathew Hoch
Brigham Young University Prelaw Review
In October of 1991, Kimberly Bergalis, a weak and frail AIDS victim, made a physically taxing journey to Washington D.C. She went, despite her deteriorating condition, to testify on behalf of a proposed bill that would require health care practitioners to be tested for the HIV virus before performing any invasive procedures. Kimberly was unknowingly infected by her dentist, who had the HIV virus.
Abortion: The Rights Of Whom?, Jennifer Ferguson, Yvette Young
Abortion: The Rights Of Whom?, Jennifer Ferguson, Yvette Young
Brigham Young University Prelaw Review
The morality of abortion is not as pressing a question as whether a woman has a right to an abortion based on the rights granted her in the ninth and fourteenth amendments. Morality cannot be completely extricated from the issue of abortion. Nonetheless, the constitutional rights determine the legality of abortion, thus having the greatest effect on the woman and her fetus. Two questions must therefore be addressed: first, what are the rights of the woman as stated in the Constitution? second, what are the rights of the fetus?
Original Intent V. Revisionism: The Great Constitutional Debate, Eric Barnes
Original Intent V. Revisionism: The Great Constitutional Debate, Eric Barnes
Brigham Young University Prelaw Review
The due process clause is one of the many battlegrounds upon which two diametrically opposed camps of judicial decision makers fight out their rulings-rulings which effect the mass of citizenry and the balance of power in America's constitutional system. These opposing camps are the originalists and revisionists.
Optimal Response To Periodic Shortage: Engineering/Economic Analysis For A Large Urban Water District, Anthony Fisher, David Fullerton, Nile Hatch, Peter Reinelt
Optimal Response To Periodic Shortage: Engineering/Economic Analysis For A Large Urban Water District, Anthony Fisher, David Fullerton, Nile Hatch, Peter Reinelt
Faculty Publications
The problem addressed by this study is how a large urban water district can best respond to a drought or the prospect of a drought. Specifically, what is the least cost combination of alternatives to meet periodic shortages? A solution to this problem may involve structural approaches (such as developing new local storage capacity), a mix of structural and nonstructural (such as conjunctive use combined with water exchanges or sales), or purely nonstructural approaches (such as changes in water pricing). The application is to the East Bay Municipal Utility District (EBMUD), which includes portions of Alameda and Contra Costa counties …

Flagburning: A Constitutional Freedom, Craig Mordock
Flagburning: A Constitutional Freedom, Craig Mordock
Brigham Young University Prelaw Review
The United States stands apart from many other nations of the world because of institutions which grant American citizens specific freedoms. America's founding fathers drew up the U.S. Constitution to ensure fundamental rights for American citizens. The First Amendment asserts one of these basic rights: freedom of speech and expression. Most Americans respect this freedom, and they revere the Bill of Rights which protects it. Unfortunately, some Americans choose to exercise this freedom in a way that offends other people. Recently, a controversial issue has confronted Congress: should Americans be allowed to express themselves by burning the U.S. flag? A …
Saturday's Women: Female Characters As Angels And Monsters In Saturday's Warrior And Reunion, Nola Diane Smith
Saturday's Women: Female Characters As Angels And Monsters In Saturday's Warrior And Reunion, Nola Diane Smith
Theses and Dissertations
Using theories of feminist criticism as explained by Sandra Gilbert and Susan Gubar, the study concludes that both Saturday's Warrior, a "home literature" style play, and Reunion, a more artistically challenging play, reflect repressive cultural images of women. Both plays cast female characters into the roles of passive Angel, domestic Angel/Monster, and active Monster.
Glottal Airflow And Electroglottographic Measures Of Vocal Function At Multiple Intensities, Christopher Dromey, Elaine T. Stathopouloss, Christine M. Sapienza
Glottal Airflow And Electroglottographic Measures Of Vocal Function At Multiple Intensities, Christopher Dromey, Elaine T. Stathopouloss, Christine M. Sapienza
Faculty Publications
Summary: Ten normal female subjects produced syllables at 5 dB increments from soft to loud. The differentiated electroglottogram (dEGG) open and speed quotients were compared to similar quotients from the inverse-filtered airflow waveform. The latter were measured according to objective and subjective criteria. The data indicate that the open quotient from the airflow waveform decreased as the intensity increased. The dEGG open quotient did not demonstrate this trend. The speed quotient from airflow increased initially with vocal intensity and decreased again as the intensity ceiling was approached. The ratio of closing to opening slopes calculated from peaks in the dEGG …
