The theory of racial capitalism offers insights into the relationship between class and race, providing both a structural and a historical account of the ways in which the two are linked in the global economy. Law plays an important role in this. This article sketches what we believe are two key structural features of racial capitalism: profit-making and race-making for the purpose of accumulating wealth and power. We understand profit-making as the extraction of surplus value or profits through processes of exploitation, expropriation, and expulsion, which are grounded in a politics of race-making. Knowledge and application gaps exist for women farmers in Sub-Saharan Africa who are key agricultural players for economic growth and food security. This study examined capacity development for Sanitary and Phytosanitary (SPS) measures and empowerment of women farmers considering Rappaport (1984) and Zimmerman’s (1995, 2000) lenses of empowerment theory. The central research question was, how does capacity development for sanitary and phytosanitary measures empower women at the individual, organizational, and community levels in Sub-Saharan Africa? Findings suggest that an eight-week mindfulness compassion-based program, Cultivating Healthy Intentional Mindful Educators (CHIME), is a feasible professional development intervention for early childhood (EC) teachers to support their emotion regulation and psychological and workplace well-being. We offer preliminary evidence that learning about mindfulness, self-compassion, and social-emotional learning supports EC teachers in strengthening their knowledge and application of practices to be more mindful and less emotionally reactive and emotionally exhausted at work. In analyzing both EC teacher feedback and survey data from two pilot studies, there was promising evidence that participating in CHIME enhanced awareness of emotions and the development of …

The COVID-19 pandemic has generated social and economic disruptions, resulting in cascading effects on the health and well- being of global citizens. However, little research has focused on how COVID-19 has affected rural regions, despite rurality being a critical factor for understanding community impact and response to the pandemic. The purpose of this phenomenological study was to explore the experiences of rural Nebraskan parents with young children during the COVID-19 pandemic and school shutdown, and the strategies they used to support their families during that time. This thesis discerns the relationships between three interrelated movements of the post-war period (circa 1945-1959): the overwhelming concern among leading intellectuals regarding the relationship between the individual and society, the post-war debates over education, and rising religious observance. Following WWII, the nation’s leading scholars and social critics addressed the most important problem facing the country and, for that matter, the world: how to avoid totalitarianism. Almost naturally, such anxieties influenced new debates over education. Dystopia is often thought of as a simple fictional device or some far off possibility of an unrecognizable Earth. But what if dystopias are actually allegorical devices warning of the long-term effects of social controls like criminalization as well as reflections on current socio-political conditions? In Canada, over 235,000 people experience homelessness per year. The COVID-19 pandemic has increased the visibility of homelessness and the use of homeless encampments across Ontario. As visibility has increased, so too have community members’ expectations to manage homelessness or find a solution to minimize the visibility of homelessness. Children of parental incarceration are often forgotten victims and have been noted to experience collateral consequences such as stigma, poor mental health, and isolation. Since children are often forgotten, there is a lack of information regarding their experiences, what resources are available to them, and whether or not these resources intended to be beneficial. Animal Sentience

Resistance to the idea that non-human animals are sentient resembles erstwhile resistance to the theory that the earth is not the centre of the universe, or that humans evolved from “apes”. All these notions are psychologically threatening. They can remind people of their own creatureliness and mortality and might make them feel guilty or uncertain about their way of life. An honest debate over animal sentience, welfare and rights should consider the human motivation to deprive animals of these things in the first place. I briefly review empirical evidence on the psychological function of denying animal minds.

Principally due to unhealthy food choices, almost half of adults worldwide are overweight or obese. Current food retail practices bear some responsibility for such public health issues. We argue that numerous attempts to promote healthy eating have been unsuccessful due to the failure to account for our outdated evolved food selection mechanisms. Building on the evolutionary mismatch hypothesis and contrasting ancestral versus present-day foraging environments, we discuss how marketing activities exploit evolutionarily old food preferences and elicit unhealthy food choices for profit maximization at the expense of public health in terms of food consumption. PURPOSE: Hispanic/Latino adults on the Texas-Mexico border have high rates of chronic disease. Neighborhoods can influence health, though there is a limited research on neighborhood environment and health in Hispanics/Latinos. The purpose of this study was to assess the relation of neighborhood environment with health variables in Hispanic/Latino adults, including physical activity [PA], depression, anxiety, and lab-assessed conditions (type 2 diabetes, metabolic syndrome, and chronic inflammation).

METHODS: Participants were randomly-selected from a Hispanic/Latino cohort on the Texas-Mexico border. This study analyzes the factors, internal and external, that affect the relationship between community identity and the social construction of animals, and the ways in which that social construction impacts the environment. Studied through the lens of the relationship between Atlantic Puffins and the human communities they live near, these questions situate our understanding of human societies as within, as opposed to above, the environment. Without this perspective, enacting environmental protections across the globe is ineffective. This paper calls for the establishment of a comprehensive academic and theological center to be created and located at a prestigious secular university in the United States. As the first of its kind in North America, it should be affiliated with both American Muslim and Jewish institutions. Credit scoring is central to people’s financial growth and prosperity or financial decline and stagnation. People with a good credit score and accompanying credit report can buy opportunities to advance economically. The benefits they reap from their attractiveness to lenders and employers helps feed their future success. In contrast, people with a fair or poor credit score become stuck in cycle of high interest rates and costly loan terms, large required down payments, and denied applications for rentals, cell phone plans, and employment. Antitrust law has a race problem. To spot an antitrust violation, courts inquire into whether an act has degraded consumer welfare. Since anticompetitive practices are often assumed to enhance consumer welfare, antitrust offenses are rarely found. Key to this framework is that antitrust treats all consumers monolithically; that consumers are differently situated, especially along lines of race, simply is ignored.

We argue that antitrust law must disaggregate the term “consumer” to include those who disproportionately suffer from anticompetitive practices via a community welfare standard. As a starting point, we demonstrate that anticompetitive conduct has specifically been used as a tool …

วิทยานิพนธ์เล่มนี้ได้ทำการศึกษาความเปลี่ยนแปลงในการรับรู้ประวัติศาสตร์ของสังคมไทยจากปฏิสัมพันธ์ทางสังคมเชิงเวลาที่กลุ่มนักเรียนเลวได้สร้างขึ้นในสังคมไทยผ่านแคมเปญและกิจกรรมทางการเมืองต่างๆ โดยงานวิจัยชิ้นนี้ได้ใช้มโนทัศน์ “การร่วมเวลา” และ “เขตแดนเวลา” ที่เกิดจากการบรรจบกันของปฏิสัมพันธ์ทางสังคมภายใต้พลวัตของ "ความเป็นสังคม” แบบสมัยใหม่ที่แยก “ความเป็นประวัติศาสตร์” และ “ความเป็นประวัติการณ์” ออกจากกัน และใช้ชาติพันธุ์วรรณนาเชิงสถาบันที่ใช้จุดยืนทางสังคมของผู้ถูกศึกษาอย่างกลุ่มนักเรียนเลวและแนวร่วมเป็นวิธีวิทยาหลักในการสืบเสาะกระบวนการทางสังคมและเล่าผ่านการเขียนวิทยานิพนธ์ชิ้นนี้ จากการศึกษาปฏิสัมพันธ์ทางสังคมในระดับต่างๆ ของกลุ่มเครือข่ายนักเรียนเลวและแนวร่วม ผู้วิจัยได้ทำการเล่าออกมาเป็น 3 บท โดยการใช้การข้องเกี่ยวทางสังคมเชิงเวลา 3 แบบเป็นแกนในการเล่า ได้แก่ ความทรงจำของการเป็นนักเรียน การต่อสู้สิทธิเสรีภาพเหนือเรือนร่างของนักเรียน และสถานะของนักเรียนในฐานะเยาวชนในการเมืองระดับชาติ อันสะท้อนถึงการร่วมอดีต ปัจจุบัน และอนาคตในการต่อสู้ทางการเมืองร่วมสมัย ซึ่งกลุ่มนักเรียนเลวได้ใช้กลวิธีและทรัพยากรต่างๆ ในการเคลื่อนไหวได้อย่างโดดเด่น จนทลาย "พรมแดนเวลา" ของการเติบโตทางความคิดเกี่ยวกับความเป็นผู้เยาว์แบบอนุรักษ์จารีตนิยมในวัฒนธรรมไทยได้สำเร็จ ซึ่งมีนัยยะสำคัญต่อแนวคิดเรื่องความก้าวหน้าทางสังคม แต่ก็ทำให้เห็นถึงการแบ่งขั้วทางเวลาที่เข้มข้นขึ้นในสังคมไทยไปด้วย ส่งผลให้ความเป็นผู้เยาว์กลายเป็นวาระทางการเมืองในสังคมไทยไปโดยสมบูรณ์

“ระบบเจ้าโคตรกับระบบงานยุติธรรมชุมชน: กรณีศึกษาบ้านเสียว ตำบลวังชัย อำเภอน้ำพอง จังหวัดขอนแก่น” เป็นงานวิจัยเชิงคุณภาพมีวัตถุประสงค์เพื่อศึกษาความเป็นมา รูปแบบและกลไกดำเนินงานของระบบเจ้าโคตรที่เป็นงานยุติธรรมเชิงจารีต ประเภทคดีหรือลักษณะข้อพิพาทที่ใช้ยุติปัญหา รวมถึงข้อดีและข้อจำกัดของการใช้ระบบเจ้าโคตร สภาพการดำรงอยู่ภายในชุมชนและการเปลี่ยนแปลงที่เกิดขึ้นต่อระบบเจ้าโคตรเมื่อมีการนำงานยุติธรรมชุมชนรูปแบบอื่น ๆ ของภาครัฐเข้ามาใช้ปฏิบัติ ซึ่งสะท้อนถึงการรับรู้และมุมมองต่อการใช้ระบบเจ้าโคตรของหน่วยงานภาครัฐ และให้ข้อเสนอแนะเรื่องการเชื่อมโยงระหว่างระบบเจ้าโคตรกับระบบงานยุติธรรมชุมชนเพื่อให้เกิดประโยชน์ต่อการพัฒนากระบวนการยุติธรรม ผู้วิจัยเก็บรวบรวมข้อมูลด้วยวิธีการศึกษาเชิงเอกสาร วิธีการสนทนาแบบกลุ่ม และวิธีการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญ จำนวน 12 คน เพื่อนำมาวิเคราะห์ข้อมูลเชิงเนื้อหา ผลการศึกษาพบว่า 1) ระบบเจ้าโคตรมีผู้อาวุโสที่คู่กรณีและชุมชนเคารพนับถือ เชื่อใจ และยอมรับในความประพฤติและการพูดจาให้เหตุผลเมื่อตัดสินความขัดแย้งให้เข้ามาทำหน้าที่คนกลางไกล่เกลี่ยระงับข้อพิพาทระหว่างบุคคลที่เกิดขึ้นในชุมชน โดยกระบวนการระงับข้อพิพาทจะเป็นแบบเรียบง่ายที่คนกลางพูดคุยซักถามเรื่องราวและเหตุผลจากคู่กรณีทั้งสองฝ่ายแล้วตัดสินความ แล้วจึงให้คู่กรณีตกลงเรื่องการชดใช้เยียวยากันโดยตรงต่อหน้าคนกลางและเริ่มต้นไกล่เกลี่ยสมานฉันท์ และร่วมกันการสร้างข้อตกลงจากการระงับข้อพิพาทที่คำนึงถึงความต้องการของคู่กรณีทั้งสองฝ่าย หมู่บ้านเสียวจะใช้ระบบเจ้าโคตรกับความผิดที่มีเด็กหรือเยาวชนเป็นผู้กระทำ การใช้ความรุนแรงภายในครอบครัว ความผิดที่กระทำต่อกันโดยประมาท ความผิดอาญาต่อส่วนตัวซึ่งรวมถึงคดีอนาจาร และความผิดลหุโทษ ระบบเจ้าโคตรมีข้อดี คือ ช่วยรักษาสภาพจิตใจคู่กรณีและดำรงสัมพันธภาพร่วมกันเอาไว้ ช่วยลดภาระของทางราชการและลดความขัดแย้งในสังคม ช่วยประหยัดเวลาและลดค่าใช้จ่ายประชาชนไปพร้อมกับลดปัญหาการดำเนินงานซึ่งกระบวนการยุติธรรมกำลังประสบอยู่โดยระงับไม่ให้ข้อพิพาทเล็กน้อยเข้าสู่กระบวนการยุติธรรม ทว่ามีข้อจำกัด ได้แก่ การยึดโยงอยู่กับศรัทธาต่อตัวบุคคลทำให้ระบบขาดเสถียรภาพ อาจมีความเหมาะสมที่จะใช้ในสังคมขนาดเล็ก และไม่มีกฎหมายรองรับผลของการไกล่เกลี่ยหากเจ้าโคตรไม่ใช่ผู้ผ่านการอบรมเพื่อขึ้นทะเบียนเป็นผู้ไกล่เกลี่ยภาคประชาชน 2) ระบบเจ้าโคตรดำรงอยู่อย่างมีสัมพันธภาพกับงานยุติธรรมชุมชนแบบอื่นๆของภาครัฐ โดยการปรับตัวเปลี่ยนแปลงไปตามเงื่อนไขการดำเนินงานยุติธรรมชุมชนของภาครัฐ ได้แก่ การมีคนกลางมากกว่าหนึ่งคน และการให้จัดทำเอกสารลายลักษณ์อักษรในกระบวนการระงับข้อพิพาทเพื่อเป็นหลักฐานอ้างอิงตามกฎหมาย 3) ภาครัฐมีการรับรู้ระบบเจ้าโคตรที่ใช้จัดการความขัดแย้งภายในชุมชนอย่างจำกัด แม้ว่าจะมีมุมมองว่าระบบเจ้าโคตรมีศักยภาพต่อการระงับข้อพิพาทเบื้องต้นแต่ยังมีท่าทีแบ่งรบแบ่งสู้หากจะต้องส่งเสริมเข้ามาเป็นส่วนหนึ่งของระบบงานยุติธรรมชุมชนในพื้นที่ 4) ข้อเสนอแนะของผู้วิจัยต่อการเชื่อมโยงระบบเจ้าโคตรกับระบบงานยุติธรรมชุมชนเพื่อให้เกิดประโยชน์ต่อกระบวนการยุติธรรมคือ ควรส่งเสริมให้ชุมชนนำระบบเจ้าโคตรซึ่งเป็นยุติธรรมเชิงจารีตเข้ามาเป็นส่วนหนึ่งของระบบงานยุติธรรมชุมชนในหมู่บ้านอย่างจริงจัง และควรเข้ามาให้ความช่วยเหลือด้านความรู้ทางกฎหมายที่จำเป็น และสนับสนุนให้ผู้ใหญ่บ้าน คณะกรรมการหมู่บ้าน สมาชิกเครือข่ายศูนย์ยุติธรรมชุมชน และเจ้าโคตรรุ่นปัจจุบันอีกจำนวน 2 คนได้รับการอบรมในหลักสูตรผู้ไกล่เกลี่ยตามพระราชบัญญัติไกล่เกลี่ยข้อพิพาท พ.ศ. 2562 เพื่อขึ้นทะเบียนเป็นผู้ไกล่เกลี่ยภาคประชาชนตามกฎหมาย

การศึกษานี้มีวัตถุประสงค์เพื่อศึกษาองค์ประกอบต่างๆ ที่ทำให้เกิดการการประกอบสร้างอัตลักษณ์ตัวตนจนลิขสิทธิ์กลายมาเป็นสิทธิผูกขาดจนสามารถนำเอามาตรการทางอาญามาปรับใช้กับผู้ละเมิดสิทธิผูกขาดนี้ได้อย่างกลมกลืน ตลอดจนศึกษาองค์ความรู้ด้านอื่นๆ ที่อาจนำมาใช้เพื่อสร้างดุลยภาพในการคุ้มครองลิขสิทธิ์และลดความเป็นอาชญากรรมจากการคุ้มครองลิขสิทธิ์ในสังคมไทยลง โดยใช้วิธีการศึกษาเชิงคุณภาพจากการวิจัยเอกสาร (Documentary Research) การศึกษาและวิเคราะห์วาทกรรม (Discourse Studies and Discourse Analysis) โดยเปรียบเทียบกับข้อมูลเชิงประจักษ์จากกรณีศึกษา ผลการศึกษาพบว่า ความเป็นอาชญากรรมที่เกิดขึ้นจากการคุ้มครองลิขสิทธิ์เป็นผลมาจากแนวคิดสิทธิผูกขาดแห่งลิขสิทธิ์ของประเทศตะวันตกที่ไหลหลากเข้าสู่สังคมไทยเพื่อใช้เป็นเครื่องมือในการแสวงหาประโยชน์ทางเศรษฐกิจในยุคทุนนิยมและบริโภคนิยม สังคมไทยได้ยอมรับนับให้ลิขสิทธิ์ซึ่งเกิดจากภูมิปัญญาของมนุษย์มีค่าเหนือกว่าทรัพย์สินที่เกิดขึ้นตามธรรมชาตินำไปสู่การประกอบสร้างวาทกรรมความเป็นอัตลักษณ์ตัวตนและความสำคัญให้เกิดขึ้น การกระทำใดๆ อันเป็นการล่วงละเมิดสิทธิผูกขาดนี้เป็นการกระทำที่สังคมไม่อาจยอมรับได้ นำไปสู่การนำมาตรการทางอาญามาปรับใช้กับผู้ล่วงละเมิดจนเกิดความเป็นอาชญากรรมอย่างล้นหลามขึ้นในสังคมไทย การเกิดวาทกรรมนี้อาศัยบริบท ปรากฏการณ์ต่างๆ ในสังคมโลกและในสังคมไทย กอปรกับการประกอบสร้างจากมนุษย์โดยตรง ด้วยการใช้มาตรการทางอาญาสร้างความรุนแรง การสร้างความเป็นอื่น การปิดฉลากตีตรา การทำลายผลิตภัณฑ์ที่เกิดจากละเมิด การสร้างความชอบธรรมจากเหตุผลกระตุ้นการสร้างสรรค์และความเจริญทางเศรษฐกิจ ส่วนการกำหนดสร้างนิยามความหมายใหม่ซึ่งเป็นผลจากการแสดงปฏิกริยาตอบโต้ แข็งขืนของผู้ยึดถือวาทกรรมรองนำไปสู่กระบวนการรื้อสร้างใหม่ เพื่อตีแผ่ ขุดคุ้ยเอาสารัตถะองค์ความรู้ ความจริงที่แฝงฝัง ลืมเลือนอยู่ในสังคมไทยในด้านเศรษฐกิจ สังคม เทคโนโลยีการสื่อสารและกติกาสากลออกมาให้ปรากฏ เพื่อนำไปใช้ประโยชน์ในการช่วยสร้างความสอดคล้องกับสังคมไทย สร้างความสมดุลและช่วยลดความเป็นอาชญากรรมที่เกิดขึ้นจากการคุ้มครองลิขสิทธิ์ในสังคมไทย

Using hermeneutical methodology, this paper examines some of the legal fictions that form the foundation of Federal Indian Law. The text of the U.S. Supreme Court’s 1823 Johnson v. M’Intosh opinion is evaluated through the lens of the Convention on the Prevention and Punishment of the Crime of Genocide to determine the extent to which the Supreme Court incorporated genocidal principles into United States common law. This led to the “Sanctions Decade” of the 1990s which saw the most devastating impacts on civilians in nations like Haiti and Iraq. วัตถุประสงค์หลักของบทความวิจัยมุ่งอภิปรายการใช้ภาพเล่าเรื่องเพื่อเป็นเสียงสะท้อนผ่านการสื่อสารที่สามารถมองเห็นในชุมชนท้องถิ่นโดยคนในชุมชนเป็นผู้เล่าและสะท้อนเสียงส่วนลึกที่สุดในการแก้ไขปัญหาที่ดินในอุทยานแห่งชาติทับลาน อนึ่ง ผู้เข้าร่วมในการศึกษามีจำนวน 6  คน จาก18 คนในงานวิจัยเพื่อร่วมในการวิจัยภาพถ่ายเล่าเรื่อง ได้แก่ ชาวบ้าน เอ็นจีโอ และพระนักพัฒนาในตำบลไทยสามัคคี ซึ่งประโยชน์จากการใช้ภาพถ่ายเล่าเรื่องจะช่วยบันทึกเรื่องราว สะท้อนแง่มุม และแลกเปลี่ยนเรียนรู้ ถือเป็นประจักษ์พยานในการศึกษาปัญหาที่ดิน อีกทั้งช่วยพัฒนาความสามารถของพลเมืองในการถกแถลงสาธารณะโดยใช้ภาพถ่าย ดังนั้นการศึกษานี้นำมาสู่การจุดประกายให้เห็นถึงบทบาทของการใช้ภาพเล่าเรื่องว่าเป็นวิธีการในการเข้าถึงแก่นแท้ในความรู้สึกเชิงศีลธรรมของประชาธิปไตยแบบปรึกษาหารือผ่านมุมมองของประชาชนในการพัฒนาชุมชนร่วมกันและเข้าถึงผู้กำหนดนโยบาย ทั้งนี้การนำผลงานวิจัยไปใช้เน้นเพื่อการพัฒนานโยบายสาธารณะและการเติมเต็มการศึกษาประชาธิปไตยแบบปรึกษาหารือในการจัดการปัญหาความขัดแย้งเรื่องที่ดิน

Broadening participation in early science, technology, engineering and math (STEM) learning outside of school is important for families experiencing poverty. We evaluated variations of the Teaching Together STEM pre-kindergarten program for increasing parent involvement in STEM learning. This informal STEM, family engagement program was offered in 20 schools where 92% of students received free/reduced lunch. The core treatment included a series of family education workshops, text messages, and family museum passes. The workshops were delivered at school sites by museum outreach educators. Widespread availability of cell phones has given most Americans the ability to record events as they happen. This has included recordings of increasing instances of police brutality directed at African Americans by White officers, including the shooting and killing of unarmed People of Color, particularly males.
