Shared Deliberations: Learning From The Voices Of Social Justice Lawyers On Their Aspirations, Challenges And Roles, Ian Head

Dissertations, Theses, and Capstone Projects

Lawyers in the U.S. who attempt to advocate for social justice issues, often on behalf of those communities most targeted by government institutions and oppressive legal systems, have unique perspectives into the challenges of using the law to create transformative change. This thesis examines the voices of over a dozen attorneys fighting not only on behalf of their clients, but also wrestling with how to best use a set of legal tools not meant for dismantling systems of power. Listening to how these legal advocates navigate their roles inside a system of laws created to consolidate rather than distribute power …

Structural Justice: A Critical Feminist Framework Exploring The Intersection Between Justice, Equity And Structural Reconciliation., Camille Burnett, Michael Swanberg, Ashley Hudson, Donna Schminkey

Journal of Health Disparities Research and Practice

Violence against women is a human rights violation (UN, 2006). It affects the health of women globally (UN, 2009) and its elimination is at the heart of many international and national goals. Intimate partner violence (IPV), one of the most common forms of gender-based violence, affects one in three women worldwide (WHO, 2013). The consequences of IPV create negative health outcomes for women that diminish their quality of life and their overall well-being. Abused women access community supports such as shelters to seek safe refuge from the abuse and restore their lives. While shelters play an extensive role in helping …

Detroit People And Transitions In Housing-3 (Dpath-3): Changes In The Composition And Service Needs Of The Homeless Adult Population, Kiel Opperman

Wayne State University Dissertations

The current research study explores the composition and service need of the homeless community in Detroit, Michigan and its surrounding county, Wayne. The project aims to 1) examine differences in composition and social service characteristics across three decades and 2) access service utilization and unmet needs of the homeless population. The study’s central hypothesis is that demographic shifts in the homeless population indicate the need to make specific and substantive shifts in the distribution of the limited resources allocated to homelessness. Results demonstrated significant changes across the three time points, where the current sample of homeless people were older, spent …

Part 3: Mind The Gap: Women's Leadership In Hampton Roads, Dragas Center For Economic Analysis And Policy

State of the Region Reports: Hampton Roads

We examine whether there is a leadership gap between women and men in Hampton Roads. While a gap in earnings can be explained partly by occupational choice, part-time versus full-time employment and the risks of certain occupations, there remains the challenge of women being able to ascend to the higher levels of their chosen profession. We explore the extent of the leadership gap in our region and discuss what can be done to narrow it.

In Fiscal Year 2019, the Community Mediation Center Grant Program continued to make progress in implementing its mission to increase public access to community mediation in Massachusetts. Out of an appropriation of $990,000, operational funds amounting to $785,600 were distributed to 12 community mediation centers that did their part to advance public access to community mediation throughout Massachusetts. Evaluating Counseling Modality Based On Recidivism For Misdemeanor Offenders, Erin D. Prisbrey Jan 2019

Evaluating Counseling Modality Based On Recidivism For Misdemeanor Offenders, Erin D. Prisbrey

Walden Dissertations and Doctoral Studies

Illegal substance use in the United States is a growing problem, and a western state has a higher than average rate of drug offenders. Many courts, including misdemeanor courts, have limited to no budget for drug treatment programs outside of the drug court treatment programs. As such, many court-ordered drug treatment programs, when drug counseling is ordered in exchange for a reduction in charges, are outsourced to privately owned companies. The drug counseling entails a single 8-hour outsourced drug counseling course, which includes either in-person, online, or correspondence-based counseling. The purpose of this study was to investigate the effectiveness of …

Courtroom Psychology During Criminal Trials And Its Therapeutic Role On Victims And Offenders, Tierra Wilson Jan 2019

Courtroom Psychology During Criminal Trials And Its Therapeutic Role On Victims And Offenders, Tierra Wilson

Walden Dissertations and Doctoral Studies

In the legal and mental health fields little is known about the therapeutic impact of courtroom psychology during criminal trials. The purpose of this research study was to investigate the inter-relating factors of law and psychology throughout criminal trials as experienced by lawyers and psychologists. Research questions explored the influence of courtroom psychology on criminal trial proceedings and challenges as experienced by both criminal trial attorneys in presenting mental health evidence, and by psychologists when testifying during criminal trials. Further exploration focused on the significance of courtroom psychology, and how lawyers and psychologists perceived courtroom psychology impacting justice for victims …

The Psychology Surrounding Legal Standards Of Competency And Representation For Children In U.S. Immigration Court, Natasha Reyes Jan 2019

The Psychology Surrounding Legal Standards Of Competency And Representation For Children In U.S. Immigration Court, Natasha Reyes

CMC Senior Theses

In recent years, immigration detentions have spiked. Further, the Zero Tolerance Policy enacted by President Trump has separated thousands of children from their families. Because many children are without their parents, and immigration court is civil in nature, thousands of children are placed in deportation hearings without representation each year. Child psychological research is at odds with the current deportation practices as psychological research deems children unable to understand the complexities of the court system or the impacts of deportation proceedings. A minimum competency to stand trial must be enacted to protect young children’s due process rights, regardless of citizenship. …

Expanding Access To Remedies Through E-Court Initiatives, Amy J. Schmitz Jan 2019

Expanding Access To Remedies Through E-Court Initiatives, Amy J. Schmitz

Buffalo Law Review

Virtual courthouses, artificial intelligence (AI) for determining cases, and algorithmic analysis for all types of legal issues have captured the interest of judges, lawyers, educators, commentators, business leaders, and policymakers. Technology has become the “fourth party” in dispute resolution through the growing field of online dispute resolution (ODR), which includes the use of a broad spectrum of technologies in negotiation, mediation, arbitration, and other dispute resolution processes. Indeed, ODR shows great promise for expanding access to remedies, or justice. In the United States and abroad, however, ODR has mainly thrived within e-commerce companies like eBay and Alibaba, while most public …

The Lived Experiences Of Male Victims Of Intimate Partner Violence, Arielle Chieko Woodyard Jan 2019

The Lived Experiences Of Male Victims Of Intimate Partner Violence, Arielle Chieko Woodyard

Walden Dissertations and Doctoral Studies

This qualitative study explored the lived experiences of male victims of intimate partner violence (IPV). Few studies exist about the experiences of men who are victims of female-perpetrated IPV and there are not many studies about these men's experiences in seeking and receiving psychological help. Maslow's hierarchy of needs and Peck's gender role strain paradigm guided this study to understand victimology and perceptions of gender roles. Research questions attempted to understand the lived experiences of male IPV victims of female-perpetrated IPV, accessing supportive and psychological services, and their experiences of these services. Seven male individuals were recruited through flyers in …

Practice-Based Learning: Observations On One-Stop Centers In Refugee Settings, Chi-Chi Undie, Josephine Ngebeh, Jane Harriet Namwebya, Joanina Karugaba

Reproductive Health

One-Stop Centers’ (OSCs) have grown in popularity for responding to sexual and gender-based violence (SGBV) in the East, Horn, and Great Lakes regions of Africa. OSCs attempt to provide an integrated, multisectoral response to SGBV survivors’ needs in one location. In resource-constrained settings, the most common services offered at OSCs include health care, psycho-social support, police and judicial services, as well as social support. Studies demonstrate that health-facility-based OSCs that are owned and run by health-facility staff are more effective than NGO-run OSCs in achieving the broadest range of desired health and legal outcomes for SGBV survivors. In collaboration with …

How Improving Prison Systems In The United States Will Positively Impact The Economy, Jordan Laube Jan 2019

How Improving Prison Systems In The United States Will Positively Impact The Economy, Jordan Laube

Empirical Economic Bulletin, An Undergraduate Journal

This paper examines the causes of high recidivism in the United States and offers a solution to theoretically bring these numbers down. This study is compiled of data over the past twenty years (1998-2018) as there have been spikes in recidivism rates during this time period. Some of the independent variables that this paper will take into account are economic and labor market freedom, race, cost, sentence length, and prison population under discretionary review. A one percent increase in state economic freedom is associated with a 0.47 % decrease in parolee recidivism. The relationship is stronger and more statistically significant …

Tribal Governance In American Indian Country, Terry E. Mcdonald Jan 2019

Tribal Governance In American Indian Country, Terry E. Mcdonald

School of Business Student Theses and Dissertations

Public Administrators seek to synthesize, comprehend, and clarify challenging problems of social progress as it relates to the administration of public services. We must, therefore, think about all forms of governance to have a comprehensive understanding of the discipline. If civilization ignored the prehistory of the past 600 million years, from the Late Precambrian Era through the Mesozoic, there would be a consequential loss of knowledge. A comprehensive understanding would be absent regarding one of the fundamentals in our evolution – life's ability to avoid demise by symbiosis and adaptation. In the same way, we may have overlooked an essential …

Bill Ong Hing outlines the long history of anti-immigration policies from past administrations. In the Bay Area, immigration service providers have continued their work to protect immigrants and their families.
