Against Marriage, Steven K. Homer
Against Marriage, Steven K. Homer
Faculty Scholarship
What is marriage? In the debate surrounding same-sex marriage, the central term has gone undefined. Using the Hawaii Supreme Court's decision in Baehr v. Lewin as a starting point, this Note argues that marriage lacks legal as well as experiential coherence. A series of legal and social moves intended, on the one hand, to preserve the dominance of heterosexuality over gays and lesbians and, on the other, to allow, heterosexuals to escape the dominance of heterosexuality over themselves, has left little conceptual space for marriage. That is, to speak of "extending marriage" to same-sex couples creates the illusion that marriage …

One Piece Of The Collection Development Puzzle: Issues In Drafting Format Selection Guidelines, Jonathan A. Franklin
Librarians' Articles
New electronic formats have made collection development decisions more complex. Mr. Franklin discusses how to incorporate a library's primary goals and resource limitations into library-specific format selection guidelines, and proposes criteria to help selectors choose the appropriate format for specific resources. A format selection checklist is appended. para This paper won the student division of the American Association of Law Libraries / LexisNexis Call for Papers Award in 1994.

A Place For The Privileged Will, Jack Tsen-Ta Lee
A Place For The Privileged Will, Jack Tsen-Ta Lee
Research Collection Yong Pung How School Of Law
Most people consider the proper distribution of their property on death a vitally important matter. For those who are elderly, ill or engaged in risky occupations, it is often urgent to get such things settled fast. But some people may be in circumstances where they cannot comply with the formal requirements for a valid will. The law has long recognized this concern in the case of soldiers and sailors by allowing them to create privileged wills. Many jurisdictions, including Singapore, have legislation to this effect. This article seeks to determine if there remains a place for the privileged will today. …

Adolescent Family Survivors Of Sexual Trauma: Program Development, Cara Lynn Carlson
Adolescent Family Survivors Of Sexual Trauma: Program Development, Cara Lynn Carlson
Theses and Graduate Projects
This thesis will explore theory and propose a program specific to the needs of a particular population of adolescent female survivors of child sexual trauma. This population of adolescent and young adult females are the runaway, throwaway, and homeless survivors of child sexual trauma that i have had the opportunity to work with for the past three years as an outreach worker. These survivors have had a history of sexual violence and too little support to enable them to heal from these experiences. This thesis focuses on expanding current outreach services to this population of young women grounded in the …

A Lost Opportunity: A Review Of The American Law Institute's Reporters' Study On Enterprise Responsibility For Personal Injury, Jeffrey O'Connell, Chad M. Oldfather
San Diego Law Review
This is a critical analysis of the Reporters' Study on Enterprise Responsibility for Personal Injury. Although recognizing that the Study is comprehensive and well researched, the authors express disappointment at the lack of vision contained in the Study. They find that the authors of the Study failed to find their way out of the maze of the tort system, and in exploring so many nooks and crannies they become lost in the details, rather than looking at the big picture. The authors of this Article provide a brief overview of the Study, and proceed with analysis. They conclude that the …
