Lessons From Forty Years Of Interference In Law School Clinics, Robert R. Kuehn, Bridget M. Mccormack Jan 2011

Lessons From Forty Years Of Interference In Law School Clinics, Robert R. Kuehn, Bridget M. Mccormack

Scholarship@WashULaw

Recently, there have been a number of well-publicized attacks on law school clinics over their legal representation of unpopular individuals and organizations, which brings them in opposition to powerful business and political interests. This article analyzes the effects of forty years of publicized interference in law school clinics on law clinic attorneys and clinical legal education, and the lessons that can be drawn from this extended history. The article includes a typology of outside interference in clinics, provides empirical support for the negative effects of this interference on the attitudes and actions of clinic attorneys, and argues that there are …

Climate Torts And Ecocide In The Context Of Proposals For An International Environmental Court, Patrick Foster Jan 2011

Climate Torts And Ecocide In The Context Of Proposals For An International Environmental Court, Patrick Foster

Dissertations and Theses

"This thesis is an exploration of two questions that are neither novel nor lacking in exploration: Is an International Environmental Court (IEC) needed? Is such a court feasible? Proposals for an IEC have a rich history, are well founded and numerous. On the issue of necessity, this thesis attempts to pull together historical and current information on two distinct areas of international environmental law and use these analyses to contextualize the need for an international environmental tribunal. Arguments for and against an IEC are presented within a discussion of environmental diplomacy. This thesis begins with a legal discussion of potential …

The Human-Environment Dialog In Award-Winning Children’S Picture Books, J. Allen Williams, Christopher Podeschi, Nathan Palmer, Philip Schwadel, Deanna Meyler

Department of Sociology: Faculty Publications

Picture books often play an important role in childhood socialization. Given the seriousness of environmental problems, we ask how natural, modified, and built environments have been portrayed in children’s books. To answer this question, we analyze the 296 books receiving Caldecott awards from 1938 to 2008. Two possibilities are explored with respect to content change. Growing concern about critical environmental problems, such as decline in biodiversity and deforestation, may have led to an increase in illustrations and stories about wild animals and the natural environment. Alternatively, the increasing isolation of people from the natural world may have resulted in a …

La Ola Verde: Female, Hispanic Consumers And The Green Movement, Stefanie Ann Ramirez Jan 2011

La Ola Verde: Female, Hispanic Consumers And The Green Movement, Stefanie Ann Ramirez

LSU Master's Theses

Due to their impact on the environment, apparel companies have gradually begun to change manufacturing and production processes and provide consumers with environmentally responsible apparel product options. Among these consumers are Hispanics, a consumer group which research has shown to have a strong purchasing power and astounding population increase. Between 2000 and 2010, the total population in the United States increased by 23.7million people, with Hispanics accounting for over 50% of that total increase (Humes, Jones, & Ramirez, 2011). It is estimated that by 2125 Hispanics will account for 50% of the total U.S. population (Day, 1996). Additionally, between 1990 …

The Lower Ninth Ward: Resistance, Recovery, And Renewal, Alexandra Giancarlo Jan 2011

The Lower Ninth Ward: Resistance, Recovery, And Renewal, Alexandra Giancarlo

LSU Master's Theses

After Hurricane Katrina of 2005, New Orleans’s Lower Ninth Ward became an icon for the failure of recovery efforts and the persistence of inequality and poverty in American society. However, for as long as this community has been marginalized it has been creating advocacy organizations and counter-narratives that battled discrimination and imbued its cultural practices with meaning. Residents often speak of a profound sense of community attachment, a commitment to educational prospects, and a deep historic and cultural identity. Historically, this area has been home to various social and legal campaigns, mirroring the contemporary protests that arose when residents encountered …

Nafta, Cafta And The Environment: The Role Of Institutions, Sherrie Baver Jan 2011

Nafta, Cafta And The Environment: The Role Of Institutions, Sherrie Baver

Publications and Research

This essay examines the institutionalization of environmental concerns, primarily focusing on NAFTA, and argues that the 1994 agreement should be seen as a positive first attempt to raise the profile of environmental concerns within discussions of expanding global trade. More specifically, NAFTA and subsequent U.S. FTAs have contributed to the growth of procedural environmental rights that have the potential to deepen democracy in the wider political system. Given that free trade agreements represent the U.S. approach to world trade at present, this paper takes the practical position that building on NAFTA’s foundation, opportunities exist to continue promoting environmental sustainability within …

Park Access And Distributional Inequities In Pinellas County, Florida, Kyle Ray Hirvela Jan 2011

Park Access And Distributional Inequities In Pinellas County, Florida, Kyle Ray Hirvela

USF Tampa Graduate Theses and Dissertations

Although environmental justice research has traditionally focused on environmental disamenities and health hazards, recent studies have begun to examine social inequities in the distribution of urban amenities such as street trees and parks that provide several direct and indirect health benefits to local residents. This thesis adds to this knowledge by evaluating distributional inequities in both distribution and access to parks in Pinellas County, the most densely populated and one of the most racially segregated counties in Florida. An important objective was to determine if neighborhoods with lower levels of park access are more likely to contain a significantly higher …

Tiebout Sorting And Jurisdictional Homogeneity: Empirical Validity And Ethical Implications, Lee Hachadoorian Jan 2011

Tiebout Sorting And Jurisdictional Homogeneity: Empirical Validity And Ethical Implications, Lee Hachadoorian

Dissertations, Theses, and Capstone Projects

In a seminal paper, Tiebout (1956) argues that a large number of small local governments will function as a market in local services, leading to efficient allocation of local public goods. This result only obtains if households actually move in response to local fiscal differences. Spatial dependence of socioeconomic variables confounds attempts to infer Tiebout-motivated residential choice from observed socioeconomic homogeneity. I correct for this by focusing on socioeconomic difference across local government borders. In an investigation of socioeconomic sorting in Queens and Nassau Counties, NY, I find strong evidence of income sorting at the level of small suburban municipalities …

Getting Around When You’Re Just Getting By: The Travel Behavior And Transportation Expenditures Of Low-Income Adults, Mti Report 10-02, Asha Weinstein Agrawal, Evelyn A. Blumenberg, Sarah Abel, Gregory Pierce, Charles N. Darrah

Mineta Transportation Institute

How much do people with limited resources pay for cars, public transit, and other means of travel? How does their transportation behavior change during periods of falling employment and rising fuel prices? This research uses in-depth interviews with 73 adults to examine how rising transportation costs impact low-income families. The interviews examine four general areas of interest: travel behavior and transportation spending patterns; the costs and benefits of alternative modes of travel; cost management strategies; and opinions about the effect of changing transportation prices on travel behavior. Key findings include: Most low-income household are concerned about their transportation costs. Low-income …

Assessing Rule-Based Governance Mechanisms In An Era Of Scientism, Maki Hatanaka Dec 2010

Assessing Rule-Based Governance Mechanisms In An Era Of Scientism, Maki Hatanaka

Journal of Rural Social Sciences

With neoliberal reforms and economic globalization, much of the regulation of food and agriculture is shifting from the state to the private sphere. Building on Busch’s work on science, the state, and the market, this paper examines the ways in which the governance of food and agriculture has become increasingly scientized with the use of third-party certification (TPC). TPC is a rule-based governance mechanism that consists of technical rules and procedures, which are based on scientific norms and practices. Using longitudinal research on an organic shrimp project in Indonesia, this paper examines the practices of TPC. Specifically, the focus is …

Racial, Ethnic, And Socioeconomic Disparities In Exposure To Fast Food In Hillsborough County, Florida, Dana Oppenheim Stein, Jayajit Chakraborty Nov 2010

Racial, Ethnic, And Socioeconomic Disparities In Exposure To Fast Food In Hillsborough County, Florida, Dana Oppenheim Stein, Jayajit Chakraborty

Florida Public Health Review

Recent studies have linked the alarming obesity epidemic in the U.S. to the growth of the fast-food restaurant industry, which offers convenient service alongside inexpensive and high-calorie food. As the number of fast-food outlets increases, research demonstrates that their geographic location plays a significant role in creating obesogenic environments, potentially exposing socially disadvantaged groups to unhealthy nutrition choices provided by these outlets. Whereas previous studies have examined the distribution of positive health amenities such as supermarkets and health-food stores, there is a growing need to evaluate the socio-demographic characteristics of neighborhoods that contain negative health entities such as fast-food outlets. …

The 'Goldilocks Hypothesis' : A Political Ecology Of The Land-Sparing/Wildlife-Friendly Farming Debate, M. Jahi Chappell Nov 2010

The 'Goldilocks Hypothesis' : A Political Ecology Of The Land-Sparing/Wildlife-Friendly Farming Debate, M. Jahi Chappell

Systems Science Friday Noon Seminar Series

Proposals for biodiversity conservation as related to the dominant form of human land use, agriculture, have broadly coalesced around two paradigms: "Land sparing" and "Wildlife-friendly farming." Neither paradigm is sufficiently grounded in the more complex socioeconomic realities of the food system with regards to another paramount problem of our time: widespread malnutrition. However, the "land sparing" paradigm's simplistic approach to food, policy, and ecosystem dynamics is arguably more egregiously out of sync with current knowledge. The talk will present a conceptual view of food systems, hunger, and biodiversity conservation, with the goal of generating discussion on how to systematically integrate …

This qualitative, exploratory study was designed to examine social change theater program participants' perspectives on the connection between their participation and their perceived capacity to create systemic social change. The research pursued the following questions: 1) How has participation in social change theatre affected the participants' sense of agency to create collective social change at the macro level; 2) What do participants perceive as their impact on systemic social change in relation to their participation in social change theater? 3) How do participants perceive the interaction of change at the level of the macro with change they may have experienced …
