In the mid-1980s, the focus in this area of the law was on nuisance closures and license revocation actions affecting adult bookstores and other kinds of establishments where either obscenity or illicit sexual activities were taking place. In our last committee report focusing on the first amendment area we reported on those areas of the law in light of the Supreme Court's decision in Arcara v. Cloud Books, Inc. Since then, there has been one important Fifth Circuit decision, FW/PBS Inc. v. City of Dallas, that the Supreme Court has agreed to review, with a decision expected in 1989. There …

Housing is a major economic factor for any region. Over the last several years, dramatically increased housing prices in New England have cast doubt on the region's ability to sustain continued economic growth. Indeed, New England's lack of affordable housing has caused labor shortages and other problems for New England businesses. With the federal government slashing its housing assistance in the 1980s, New England states and localities have started to address the region's housing problems by developing a variety of housing programs. Disability Rights Mandates: Federal And State Compliance With Employment Protection And Architectural Barrier Removal, Stephen Percy, United States Advisory Commission On Intergovernmental Relations

The findings of this study indicate that the existence of national mandates does not necessarily eliminate the need for citizen groups to be attentive to state capitols and city halls. Ironically, one factor in the rise of regulatory federalism has been the desire of interest groups to concentrate their resources on one government, namely, the national government, rather than 50 different state governments. Yet, success in the national arena is often only partial, and sometimes only largely symbolic. It is the implementation of national rules that takes one back to states and localities.

Human Immunodeficiency Virus In Minnesota: Summary Of 1988 Statewide Hiv Risk Reduction And Disease Prevention Plan, Kristine L. Macdonald M.D.

The AIDS epidemic continues to grow in Minnesota. As of December 10, 1988, 447 cases of AIDS had been reported to the Minnesota Department of Health (MDH), and 252 Minnesotans had died from AIDS. An effectively implemented risk reduction and disease prevention plan that has broad support and involvement of all segments of the statewide community is essential to reduce the tragic morbidity and mortality caused by this disease in Minnesota. The Commissioner's Task Force on AIDS approved a statewide human immunodeficiency virus (HN) risk reduction plan in the spring of 1986.

The Longterm Psychosocial Impacts Of Caregiving On The Caregivers Of Persons With Stroke, Alice Updike Scannell

This study is a Time 4 (T4) follow-up interview of ninety-three caregivers of persons who experienced a first stroke between 2 to 4 years (mean = 36 months) prior to the T4 interview. The first wave of data collection occurred within two months after the stroke. The second and third waves occurred six and twelve months, respectively, after the first interview. The caregivers were identified by the person with stroke as being the person closest to him/her who would be responsible for care after the stroke.

Data were gathered at all four interviews using reliable and valid measures for depressive …

The following study consists of a series of brief reports summarizing information collected by the Center for Applied Urban Research (CAUR) for the Boys Clubs of Omaha. This information can be used by the Boys Clubs for strategic planning. The information was collected to determine: If clients' needs are being addressed; if the current program is effectively meeting clients' needs; and if service delivery should be expanded. To address these issues, CAUR designed a work plan containing five elements. Each element focuses these issues using . a different data gathering approach, and is presented separately.

Commercial Activities And The Geography Of Movement In A West African Urban Market: A Study Of Market-Stall Traders In Onitsha With Implications For Transport Policy, Krys Chukwuma Ochia

The purpose of this study is to understand the non home-based travel behavior of urban market traders in Onitsha, Nigeria, where 58-70% of the labor force is engaged in trading.

Relevant trip-inducing variables--gender, location, a means of personal transportation, size of stall and, type of good sold--were selected to assist in theorizing about the travel behavior of traders. Using a systematic sampling methodology, 246 stalls were selected and the MLR model was applied in data analyses.

The results show that a typical stall is occupied by either one or two traders. There are three male traders for every female trader …

Hospitals, Health Care Professionals, And Aids: The "Right To Know" The Health Status Of Professionals And Patients, Lawrence O. Gostin

This article addresses why patients and health care professionals (HCPs) with human immunodeficiency virus (HIV) should have autonomy and privacy rights to choose whether to consent to an HIV test and to disclose their serologic status. It also demonstrates that the risk of HIV transmission in health care settings is exceedingly low, that it is probably lower than other well-accepted risks taken by patients and professionals, and that there are other less intrusive ways to further reduce the risk. The article concludes that knowledge of a patient's serologic status is unlikely to reduce risk, since no effective action could be …

The Politics Of Aids: Compulsory State Powers, Public Health, And Civil Liberties, Lawrence O. Gostin

This article argues that compulsory public powers are justified only if they meet the following criteria: there is a significant risk of transmission of the acquired immune deficiency syndrome (AIDS) virus; the public health response is efficacious in preventing a primary mode of transmission of the virus; the economic, practical, or human rights burdens are not disproportionate to the public health benefits; and the public health power is the least restrictive alternative that would prevent viral transmission.

This project is a part of the 1989 Comprehensive Planning Workshop, the capstone of the Graduate Urban Planning curriculum at Portland State University. The goal was to develop a regional Housing Plan for Southeast Portland. Southeast Uplift Neighborhood Coalition, a non-profit organization offering administrative and technical support to Southeast neighborhood associations and other citizen groups agreed to cooperate in this endeavor. Curry's (1983) model of learning style framework with Claxton & Murrell's (1987) adaptations was used to study the profile of the non-major in a college biology course. The purpose of the study was to provide empirically derived data in both a qualitative and quantitative format of the non major (both successful and unsuccessful students) to improve the course. Over 600 students were administered the Learning Style Profile [(LSP) (National Association of Secondary School Principals) Indicator (MBTI) (NASSP) and the Myers-Briggs Type (Consulting Psychologists Press)] to determine the students' learning styles as a predictor for Success in the course. The purpose of this article is to describe Medicaid's financial structure and examine cost containment efforts to limit future growth of the program, particularly pertaining to Massachusetts. The principal focus is the Massachusetts Department of Public Welfare and the Massachusetts Medicaid Fraud Control Unit, the two agencies most responsible for Medicaid cost containment in the commonwealth. Because elected officials are unwilling to face directly the troublesome issues surrounding Medicaid and its growth, the government agencies responsible for cost containment have been left to define the scope of the problem, design remedial strategies, and evaluate their success. This article is a qualitative study of the lives of homeless elders in Boston. It examines the concerns uppermost in the minds of the homeless including the art of integrating their past lives into the values and milieu of their current homeless situation. Concern about the reinstitutionalization of the mentally ill in public shelters, domiciles once reserved for the older alcoholic, the pressures and stress of shelter life, victimization, the shrinking supply of SRO units, and the role of alcohol are also examined. The Southwest Corridor is a narrow strip of land running five miles from the South End of Boston through Roxbury and ending in Jamaica Plain. Twenty years ago, neighborhoods through which the Corridor passes experienced tremendous upheaval as space was cleared for the proposed construction of Interstate 95. The communities were able to stop the highway project, but not without a long and difficult struggle and the eventual support of then Governor Francis Sargent.
