If You Want Peace, Work For Justice: An Evaluation Of International And Sustainable Peace Building In The Former Yugoslavia, Elizabeth Wasson
If You Want Peace, Work For Justice: An Evaluation Of International And Sustainable Peace Building In The Former Yugoslavia, Elizabeth Wasson
Global Studies Student Scholarship
This thesis paper provides an evaluation of international criminal tribunals and their ability to incite sustainable peace in ethnically conflicted regions of the world. This research focuses particularly on the International Criminal Tribunal for the Former Yugoslavia (ICTY) and the role it has played in reconciling ethnic tensions in the Balkans. First, an extensive review of the literature concerning international jurisdiction provides background information on the two opposing views of international relations: realism and legalism. Both perspectives of international relations have significant implications for the effectiveness of this UN Tribunal and whether or not such supra-national institutions are ultimately effective. …
Timing Justice: Lessons From The Tribunals In Yugoslavia, Rwanda, Sierra Leone, And Cambodia, Zoe B. Whaley
Timing Justice: Lessons From The Tribunals In Yugoslavia, Rwanda, Sierra Leone, And Cambodia, Zoe B. Whaley
Political Science Honors Projects
Scholarship on tribunals for mass human rights violations overlooks how the presence or absence of conflict influences its effectiveness. I argue that implementing a tribunal during conflict undermines its ability to effectively pursue justice—as I demonstrate with a case study of the Yugoslav Tribunal. Ongoing conflict makes challenges of transitional justice more acute. The absence of conflict eases a tribunal’s ability to carry out certain necessary activities such as collecting evidence. I demonstrate this using a case study of the Rwanda Tribunal. Examining tribunals in Sierra Leone and Cambodia suggests that hybrid structures influence the effectiveness of these accountability mechanisms.

International Criminal Justice Must Not Only Be Done, It Must Be Seen To Be Done, Rhona Smith
Human Rights & Human Welfare
“[U]ntil a time in which the global governance structure is not reliant on states, humanity will continue to fail in its attempt to protect global human rights” (Eric Leonard, June 2008 Roundtable). Discourse across a range of disciplines (e.g. Roundtable comments by Landman in October 2008, and Thomson-Jensen and co-panelists in May 2007), irrespective of the methods of evaluation, conclude that the existing system of “human rights protection” fails those whose rights are heinously violated: millions die annually as a direct result of violations of basic human rights (food, clean water, adequate health); gross and systematic violations of human rights …
Political, Economic, And Legal Influences On Gender Inequality, Brittani Melvin
Political, Economic, And Legal Influences On Gender Inequality, Brittani Melvin
XULAneXUS
Abstract Obtaining equality has been a continuous struggle in the United States. Race, class, and gender inequality are extensive in this country, so much so that these aspects of inequality often intersect, making the effects of inequality more prevalent. In discussing gender inequality, many only consider the variations in income, employment, and opportunity that exist between men and women. The purpose of this paper is to examine the inequalities that occur within gender inequality, namely on the basis of race and class. This paper will attempt to answer how the political, economic, and legal practices that often govern this nation …

A Miscarriage Of Juvenile Justice: A Modern Day Parable Of The Unintended Results Of Bad Lawmaking, Amy Vorenberg
A Miscarriage Of Juvenile Justice: A Modern Day Parable Of The Unintended Results Of Bad Lawmaking, Amy Vorenberg
Law Faculty Scholarship
Sensationalized cases increasingly create the context for public policy discussion. Stories about violent crime are a common feature of the local evening news and their emotional nature can often create the hook politicians need to showcase their “tough on crime” agendas. Often anecdotal and lurid, stories of criminal misdeeds are widely used to convince the public of a need to create or change laws. This article demonstrates the perils of making law by extrapolating from a few random, albeit attention-grabbing, events. Specifically, the article examines the impact of a 1995 change in New Hampshire state law that lowered the age …

2009: Final Report "Is It Time To Change The Drinking Age In The United States?"
CACTUS--Citizens' Assembly for Critical Thinking About the United States
The 2009 Citizens' Assembly for Critical Thinking about the United States must study proposals for changing the current legal drinking age, identify and analyze the perceived problems leading to these proposals as well as arguments in support of the current legal drinking age, and decide if a change is warranted, at what level of government should it be implemented, and whether other provisions should be mandated as part of the change.
Victim And Witness Intimidation, Elsa Y. Chen
Victim And Witness Intimidation, Elsa Y. Chen
Political Science
Victim or witness intimidation is the practice of threatening, harming, or otherwise instilling fear in a victim of, or witness to, a crime, in an effort to prevent him or her from reporting a crime or testifying in court. It may also be used to convince a victim or witness to recant testimony that has already been made. The intimidation may involve physical violence, explicit threats of physical violence, implicit threats, and/or property damage. Threats may be made by the defendant or by his or her friends, family, fellow gang members, or other associates. Most victim and witness intimidation takes …
Trafficking Of Women And The Harmonious Society: The Chinese National Plan Of Action On Combating Trafficking In Women And Children Within The Context Of Chinese Patriarchy And Reform, Sean Michael Barbezat
Trafficking Of Women And The Harmonious Society: The Chinese National Plan Of Action On Combating Trafficking In Women And Children Within The Context Of Chinese Patriarchy And Reform, Sean Michael Barbezat
Human Rights & Human Welfare
The Chinese National Plan of Action on Combating Trafficking in Women and Children, an evolution of prior regional cooperative work in coordination with the United Nations Inter-Agency Project on Trafficking (UNIAP), is a considerable accomplishment. It represents a comprehensive, practical foundation for counter-trafficking work, and addresses the most serious concerns raised by Chinese and international anti-trafficking research over the last dozen years. However, a statement of this magnitude produced by a state not known for its sweeping human rights instruments leads to suspicion.
Political Oppression In Sub-Saharan Africa, Alayna Hamilton
Political Oppression In Sub-Saharan Africa, Alayna Hamilton
Human Rights & Human Welfare
Relative to social and economic rights, there is little discourse on the issue of political rights in sub-Saharan Africa (SSA). This fact is attributable to the pressing problems of lack of access to food and healthcare that plague millions of people in the region. However, without the observance of political (and civil) rights, economic development, wealth redistribution, and basic social order may be compromised. Contrary to arguments that insist that economic growth and social stability often require the limitation of political rights, political rights are a necessary requisite for promoting civilian support of governmental policies. Without political rights, equitable policies …
Indigent Defense In America: Racially Or Geographically Unjust?, Lisa Karen Akre
Indigent Defense In America: Racially Or Geographically Unjust?, Lisa Karen Akre
Honors Program Theses
The purpose of my research is to investigate the link between indigent defense funding and race. First, I explain the various approaches that states have implemented to deliver legal defense to the indigent. Second, I describe the current lack of funding and its consequences. Third, I examine what effect race has on the indigent defense system. Finally, based on the conclusions drawn from examining both race and funding for indigent defense, I evaluate the effectiveness of the delivery of indigent defense to individual states and regions within the United States.
Impact Of A Proposed Federal Shield Law, Lisa Dahlke
Impact Of A Proposed Federal Shield Law, Lisa Dahlke
Honors Program Theses
This study will examine how current proposals for a federal shield law compare to protections offered by state legislatures and state courts. My research will address the effectiveness of current state-level protections for journalists' use of confidential sources using analysis of data from a national survey of news outlets. By determining how different aspects of state protections influence subpoena frequency and compliance, I attempt to evaluate the key aspects of legislation currently being considered in Congress, the Free Flow of Information Act of 2009. I find clear evidence that the presence of a statute and a number of its provisions …
Federalism, Intergovernmental Relations And Implementation : A Broad Examination Of The Politics Of Medicaid Disenrollment, Kathleen Marie Dalton
Federalism, Intergovernmental Relations And Implementation : A Broad Examination Of The Politics Of Medicaid Disenrollment, Kathleen Marie Dalton
Legacy Theses & Dissertations (2009 - 2024)
Variation in the Medicaid program has frequently been studied across states, and considered a product of political, fiscal and administrative factors. Few studies have considered variation in Medicaid as a product of federal bureaucratic behavior. This study examines federal variation, and uses federalism, intergovernmental relations and public policy lenses to compare two cases where classes of recipients were being disenrolled from Medicaid, in apparent conflict with federal regulations. In one case, when individuals moved from county-to-county and became disenrolled in Medicaid, the federal bureaucrats used most of the implementation tools at their disposal to try to bring states back into …
Republicanism And Crime, Richard Dagger
Republicanism And Crime, Richard Dagger
Political Science Faculty Publications
These are but two of the difficult questions that arise when one examines the claim that crime is a public wrong. I take it, though, that their difficulty is an indication of the importance of thinking through the presuppositions and implications of this conception of crime, not a reason to abandon it. A thorough 'thinking through' is too large and complex a task for this chapter, but it is possible to make a case here for the right way to proceed with such an undertaking. That right way, in my view, is to look to the republican tradition of political …
Money, Politics, And Impartial Justice, Joanna Shepherd
Money, Politics, And Impartial Justice, Joanna Shepherd
Faculty Articles
A centuries-old controversy asks whether judicial elections are inconsistent with impartial justice. The debate is especially important because more than 90 percent of the United States’ judicial business is handled by state courts, and approximately nine in ten of all state court judges face the voters in some type of election. Using a stunning new data set of virtually all state supreme court decisions from 1995 to 1998, this paper provides empirical evidence that elected state supreme court judges routinely adjust their rulings to attract votes and campaign money. I find that judges who must be reelected by Republican voters, …
Democratic Institutions Create Civic Health: How Local Jurisdictions Can Enhance Their Problem-Solving Capacities Through Inclusive Governance, Including A Case Study Of Newark, Delaware, Ezra Temko
SIUE Faculty Research, Scholarship, and Creative Activity
Civic health is a community’s economic, civic, and social infrastructure – its capacity to solve its problems. This paper explores how contemporary local governments address the opportunities and challenges facing their communities and how local governments could utilize civic engagement to enhance civic health. It also evaluates the status of Newark, Delaware’s civic health and offers pragmatic steps Newark’s government can take to enhance the community’s civic health. Democratic governance is the 21st century engine for communities like Newark, Delaware to enhance their civic health. Collaborative and inclusive governance can improve a community’s abilities to solve problems. The Newark community …

Privacy, Surveillance And The State: A Comparison Of U.S. And British Privacy Rights, Angelina Lander
Electronic Theses and Dissertations
This study investigates the effects of institutional structure on the privacy rights regimes in the United States and the United Kingdom, from 2000-2006. The goal of this research is to analyze how variation in the institutional arrangements across these two countries allowed for more or less protection of privacy rights for citizens. Domestic terrorist attacks during the time period represent a catalyst for changes in police and government surveillance activities. Veto points literature provides the framework for institutional comparison. The first part of the research provides a discussion of the historical evolution of privacy rights in both states, focusing on …
Boxing With Shadows: Contentious Politics, Culture Jamming, And Radical Creativity In Tactical Innovation, David Matthew Iles, Iii
Boxing With Shadows: Contentious Politics, Culture Jamming, And Radical Creativity In Tactical Innovation, David Matthew Iles, Iii
LSU Master's Theses
Dominant theories of tactical innovation in contentious politics suggest that actors innovate in times of crisis or at the margins of familiar forms of action in order to achieve strategic advantage. I argue that these theories do not satisfactorily account for the tactical creativity of a form of contention called culture jamming. Instead, I employ a biographical theory of tactical innovation to explain their distinct repertoire of contention. This theory claims that tactics are partially explained as emanations of or congruent with the life experiences, identities, dispositions, and values of actors. Bourdieu’s field theory allows me to identify a social …
The Personal And The Political: Forgiveness And Reconciliation In Restorative Justice, Ari Kohen
The Personal And The Political: Forgiveness And Reconciliation In Restorative Justice, Ari Kohen
Department of Political Science: Faculty Publications
At the center of this paper are three questions: in the absence of a religious worldview, can one gain access to the concepts of forgiveness and reconciliation, can reconciliation be achieved in the absence of forgiveness or does the former depend in some way upon the latter, and can we make sense of a restorative approach to justice in the absence of either forgiveness or reconciliation? To answer these questions, I look closely at the concept of forgiveness in the first section of this article with the goals of disentangling it from its religious undertones and emphasizing its importance to …
How Should We Study District Judge Decision-Making?, Pauline Kim, Margo Schlanger, Christina L. Boyd, Andrew D. Martin
How Should We Study District Judge Decision-Making?, Pauline Kim, Margo Schlanger, Christina L. Boyd, Andrew D. Martin
Scholarship@WashULaw
Understanding judicial decision-making requires attention to the specific institutional settings in which judges operate. Yet much of the existing empirical work on federal district courts has failed to take account of the setting in which those judges operate. Too often, empirical studies of the district courts rely on an implicit assumption that judging at the trial court level is fundamentally the same as judging at the appellate level. We argue that this approach is misguided, because the nature of district judges’ work is substantially different from that of appellate judges. For example, unlike in the typical appellate case, a district …
Gender Politics: A Case Study Of Feminism In Iran, Sara A. Hoff
Gender Politics: A Case Study Of Feminism In Iran, Sara A. Hoff
Browse all Theses and Dissertations
The literature on feminism and Islam shows that there is a distinct relationship and conflict between identity groups in Iran. An alliance between Muslim and secular feminists has been observed in the past in Iran; however, a breakdown of the alliance has occurred in recent years. It is my assumption that in order for feminists in Iran to unite, several principles of Iris Young's communicative democracy and coalition building practices have to be applied. Communicative democracy stresses that individuals' ideas often change when interaction with other people and their experiences occurs. Further, communicative democracy emphasizes the importance of recognizing the …

This study compares and contrasts two distinct regimes, the Brazilian military regime (1964-1985) and Brazil's current democratic regime (1985-2007). The focus of this thesis is to determine why, compared to the authoritarian regime, human security has improved measurably under democracy in some areas but not in others. To assess this paradox, one variable has been chosen: the rule of law, specifically conceptualized as violations of physical integrity. This research centers on the metropolitan areas of São Paulo and Rio de Janeiro and is based on a qualitative examination supplemented by quantitative evidence. The study finds that violations of physical integrity …
Youth Movements In Latin America: 20th Century Stories Of Age, Struggle, And Socio-Political Independence, Amaris Delcarmen Guzman
Youth Movements In Latin America: 20th Century Stories Of Age, Struggle, And Socio-Political Independence, Amaris Delcarmen Guzman
Open Access Theses & Dissertations
Throughout the latter half of the 20th Century, the very nature and everyday functions of Latin American governments under dictatorship, authoritarian-like governments, and military regimes were questioned and challenged by many of its citizens, especially its young citizenry. Literary journals and books suggest that many young people in the late 1950's to early 1980's were very aware of their government's practices, did not agree with such practices of the government, and therefore created youth movements in countries as the case in the Dominican Republic, Mexico, and Brazil to bring about change. This topic was brought about as an interest to …
South Park And Absurd Culture War Ideologies, The Art Of Stealthy Conservatism, Drew W. Dungan
South Park And Absurd Culture War Ideologies, The Art Of Stealthy Conservatism, Drew W. Dungan
Open Access Theses & Dissertations
South Park serves as an example of satire and parody lampooning culture war issues in the popular media. Since it targets culture war issues, it is relevant to analyze its political and social stance on the issues as presented within. Both extremes in political and social ideology are targeted. Although the program notes an ideological absurdity in extremist points-of-view, the presentation of the issues attempts to create a sense of moderate ideology criticizing both the far left and far right, when in fact, closer analysis provides evidence that South Park serves a stealthy conservative perspective. Stealthy conservatism presents itself as …

Reconciliation in Divided Societies: Finding Common Ground. By Erin Daly and Jeremy Sarkin. Philadelphia: University of Pennsylvania Press, 2007.
Healing is widely seen as an essential component of socio-political reconciliation, helping to promote a more peaceable future after violent conflict. At the same time, however, little is known about what exactly “healing” means to traumatized people and whether particular reconciliation efforts do indeed constitute healing. Instead, social healing is described usually in metaphorical terms, compared to the way …

Institutionalizing Torture: The Case Of Hospitals And Prisons In China, Leighann Mcchesney
Human Rights & Human Welfare
The People’s Republic of China (PRC) has a notorious reputation, especially within the international human rights community, concerning its state-implemented practices of torture. Although the government of China has been charged by many international organizations with having a gruesome human rights record, on anything from freedom of speech to freedom of religion, the accusations of state-sanctioned torture undoubtedly have caused some of the strongest reactions around the world. This article seeks to address the various manifestations of torture that take place inside two of the most prominent public institutions in China: the prisons and the mental hospitals. By utilizing these …
