Attorney Fees: Handling Bankruptcies Without Getting There Yourself, Edwin F. Flowers
Attorney Fees: Handling Bankruptcies Without Getting There Yourself, Edwin F. Flowers
West Virginia Law Review
By enacting the Bankruptcy Reform Act of 1978, Congress significantly increased the stature and influence of bankruptcy law in our legal system and in society. Consistent with this, Congress sought to improve the quality of legal services rendered to clients in bankruptcy. cases by enhancing the recoverability of attorney fees for such services. In this article, the author treats the criteria a bankruptcy court will likely employ in deciding the reasonableness and recoverability of an attorney fee for services in cases under the Reform Act. The author attempts to show that an attorney who uses some forthought and attention to …

The Civil Rights Lawyer In The 1980'S, Thelton E. Henderson
Cleveland State Law Review
There has been a lot of discussion recently about civil rights and the future, if any, of the civil rights movement. Some ask whether the civil rights movement in this country is dead. In response, I hope to answer this question by examining the civil rights movement along with the role of the civil rights lawyer in the 1980's.

Legal Aid For The Poor: A Conceptual Analysis, Marshall J. Breger
Scholarly Articles
In this Article Professor Breger examines the competing justifications that have been advanced for the provision of free legal aid to those who cannot afford to engage a private attorney. Professor Breger argues that every citizen has the right to effective access to the courts to resolve disputes in that they aret he only state-sanctionedd ispute resolution mechanism. Because of the complexity of our legal system, effective access to the courts often requires the services of an attorney. Under this theory of "access rights" a person is entitled to free legal aid when necessary for the enforcement of a legal …

Is America Over-Lawyered, Shirley M. Hufstedler
Is America Over-Lawyered, Shirley M. Hufstedler
Cleveland State Law Review
Are we over-lawyered? The answer that a lawyer must give is the kind of response that always exasperates laypersons-yes and no. We do have far more lawyers than we can absorb in the existing professional structures, at costs that can be paid by persons who need those services. The unmet need for legal services is very large and growing. Program after program designed to fund legal aid for the poor has been cut or extinguished. Even in a profession that is as crowded as our own, there is always room for the very best, the dedicated and the least selfish.
Lawyer Advertising: Permissibility Of Indicating The Nature Of Legal Practice In Advertisements, Kenneth J. Alcott
Lawyer Advertising: Permissibility Of Indicating The Nature Of Legal Practice In Advertisements, Kenneth J. Alcott
University of Richmond Law Review
Canon 27 of the ABA Canons of Professional Ethics, adopted by the American Bar Association in 1908, provided that it was "unprofessional" for lawyers to advertise or solicit professional employment. This prohibition made sense in a time when most lawyers were general practitioners and communities were small, so that a lawyer's reputation was well known. However, the increasing size and complexity of both society and the law have made it necessary for lawyers to select certain areas of law in which to practices in order to develop the expertise necessary to deal with today's complex legal issues. A corresponding need …
