240 Men: The Antebellum Lower Federal Judiciary, 1829-1861, Kermit L. Hall

Vanderbilt Law Review

Between 1829 and 1861 antebellum presidents nominated 200 judges to the federal lower courts. Earlier administrations had appointed another forty jurists who held their positions during part or all of the era. Of these judges, 108 served in the federal district courts, 126 in the territorial courts, five in the Court of Claims, and one in a special circuit court established in 1855 for the northern district of California. The number of appointments available to an administration involved fate and the pace of territorial expansion;thus, during the first eight years of the period, Jackson nominated thirty-two judges, while in the …

Studying Law As The Possibility Of Principled Action, Gordon A. Christenson

The study of law may be viewed as the critical analysis of a system of logically coherent rules governing action. In the United States, the responsibility for legal education has traditionally fallen upon the law schools. Within the legal profession and law schools a restive spirit now prevails, seeking to further clarify the meaning of that responsibility.' Two responses appear in the law schools, for good or ill.

In the folklore of American legal history the middle decades of the nineteenth century mark the nadir of professionalism in national life. While acknowledging the brilliant achievements of individual practitioners and judges during the years from 1830 to 1870, commentators from Charles Warren and Roscoe Pound to W. Raymond Blackard and Anton-Hermann Chroust have insisted upon the overall deterioration of the bar under the assaults of a militant democracy. The standard picture of professional development in the United States begins with a Golden Age of jurisprudence in the early Republic, fostered by a self-regulating fraternity of educated judges and lawyers. …
