Experimental Educating In The Classroom: Designing An Administrative Law Practicum Meeting New Aba Requirements And Student Needs, Jeffrey Thaler
Experimental Educating In The Classroom: Designing An Administrative Law Practicum Meeting New Aba Requirements And Student Needs, Jeffrey Thaler
Maine Law Review
In 1992, the American Bar Association ("ABA") published a lengthy report, which became known as the MacCrate report (the "Report"), examining the connection between the profession and legal education.2 In part, the Report recognized the value of a more practice-oriented curriculum that would include a combination of externships, clinics and classroom-based activities. One result of the Report was a significant increase in the number of clinical and externship programs offered by law schools, as well as many more law review articles on such programs. However, the concept of combining experimental educating techniques with traditional doctrinal case method courses utilizing simulations …
Bringing Purposefulness To The American Law School’S Support Of Professional Identity Formation, Louis D. Bilionis
Bringing Purposefulness To The American Law School’S Support Of Professional Identity Formation, Louis D. Bilionis
Faculty Articles and Other Publications
Ten years after the publication of Educating Lawyers, a growing number of American law schools are taking initiative to better support their students in the formation of professional identity. There is widespread recognition that success in these efforts requires an element of “purposefulness” on the part of law faculty and staff. Experiences, environments, and pedagogies that actually work for professional identity formation must be crafted and promoted with intentionality. Bringing the requisite purposefulness to the effort, however, will take a mindset about the education of a lawyer that will be new to many in legal education. This article explores that …
Liba2j! The Continuum Of Access To Justice Services, Yolanda Jones
Liba2j! The Continuum Of Access To Justice Services, Yolanda Jones
Library Faculty Publications
Some have urged law libraries to undergo what appears to be a large-scale transformation, where access to justice in incorporated as a core feature of the library mission. While Access to Justice (A2J) services are provided by many libraries, they can be seen by law library managers as costly, unfunded mandate. One way of approaching the issue is to consider library access to justice services as a continuum within the broader range of legal services. Within this Library Access to Justice Continuum (LIBA2J), librarians can select access to justice services consistent with their mission, budget, and general library resources. For …

Capital Lawyering & Legislative Clinic, Rex D. Frazier
Capital Lawyering & Legislative Clinic, Rex D. Frazier
Duquesne Law Review
This article outlines an approach for teaching law students about advocacy beyond the judicial branch, with particular emphasis on legislative advocacy. Given the long and well-documented shift away from the judicial branch as the primary source of original public law, it is critical to teach law students that legislative advocacy is more than just an "alternative"o r "non-traditional" legal career option and, instead, is one which regularly involves "real lawyering." Just as law students learn practical trial skills through moot court, shouldn't they learn practical legislative advocacy skills through simulated legislative hearings? Further, can law students move beyond traditional approaches …

Divided Selves: Professional Role Distancing Among Law Students And New Lawyers In A Period Of Market Crisis, John Bliss
Divided Selves: Professional Role Distancing Among Law Students And New Lawyers In A Period Of Market Crisis, John Bliss
Sturm College of Law: Faculty Scholarship
In the terms of Erving Goffman’s classic role distancing analysis, newly admitted law students often aspire to an “embraced” lawyer role that directly expresses their personal and political values. Empirical research has suggested that during law school these students are instructed in an amoral and apolitical vision of professionalism. The literature has paid less attention to how students internally experience these norms within their continual processes of self-construction. This article takes an exploratory microdynamic look at professional identity formation drawing on longitudinal interviews and identity mapping with three student cohorts. I find that over the course of their legal education …
Risks And Rewards Of Externships: Exploring Goals And Methods, Linda F. Smith, Jeff Giddings, Leah Wortham
Risks And Rewards Of Externships: Exploring Goals And Methods, Linda F. Smith, Jeff Giddings, Leah Wortham
Utah Law Faculty Scholarship
This article explored the risks and rewards of designing and teaching in an externship program, the goals one might have, and the methods one might use. We have argued that it is important to pay attention to the principles of intentional design when developing an externship program. In particular, we have identified and challenged the assumption that skills development must be the predominant goal for externships. This is a common assumption on the part of legal education regulators in our respective home countries, the USA and Australia, as well as in England and Wales. Skills development can, but does not …
The Public Service Loan Forgiveness Program: The Need For Better Employment Eligibility Regulations, Gregory S. Crespi
The Public Service Loan Forgiveness Program: The Need For Better Employment Eligibility Regulations, Gregory S. Crespi
Faculty Journal Articles and Book Chapters
People will start seeking tax-exempt debt forgiveness under the Public Service Loan Forgiveness (“PSLF”) program in October of 2017 after satisfying the requirements of 10 years of post-October 1, 2007 employment in a “public service job.” I estimate that eventually 200,000 people a year or more will obtain debt forgiveness under this program, at a total cost to the Treasury of $12 billion/year or more. Estimates are that up to one-quarter of all employment will qualify as a public service job.
For such a large and costly program the precise eligibility criteria are crucial. The statutory definition of a public …

Who’S Gonna Take The Weight: Using Legal Storytelling To Ignite A New Generation Of Social Engineers, 50 J. Marshall L. Rev. 231 (2017), Camille Lamar Campbell
UIC Law Review
So I ask the rhetorical question: “Who’s Gonna Take the Weight?” to mobilize law professors—the people responsible for shaping students’ professional identities—to use storytelling techniques to overcome the corrosive effects of stereotypes and implicit biases on controversial clients’ access to legal services and on the lawyer’s professional identity as a social engineer. This article precedes in two parts. Part II explores traditional client selection models and endorses a Houstonian approach to client selection, one that acknowledges the challenges of representing controversial clients within a framework that also acknowledges the social justice consequences of denying representation to controversial clients. Part III …
Beyond The ‘Resiliency’ And ‘Grit’ Narrative In Legal Education: Race, Class, And Gender Considerations, 50 J. Marshall L. Rev. 271 (2017), Christian Sundquist
Beyond The ‘Resiliency’ And ‘Grit’ Narrative In Legal Education: Race, Class, And Gender Considerations, 50 J. Marshall L. Rev. 271 (2017), Christian Sundquist
UIC Law Review
The narrative on modifying legal education to produce entrepreneurial students with resiliency and “grit,” however, often has a troubling class and race-regarding dimension. This Essay argues that the “grit” reform initiative has the potential to rationalize future disparities, by shifting the focus from responding to the continuing impact of poverty and identity bias on student outcomes to bolstering individual character traits and resiliency. Our country has a long and troubling history of adopting such post-oppression “distancing moves” in order to discount the effect that systemic bias has on inequality, including disparate legal outcomes, by focusing solely on personal responsibility and …
Risks And Rewards Of Externships: Exploring Goals And Methods, Leah Wortham, Linda F. Smith, Jeff Giddings
Risks And Rewards Of Externships: Exploring Goals And Methods, Leah Wortham, Linda F. Smith, Jeff Giddings
Scholarly Articles
This article grew from a presentation relating externship clinical programs to the theme of the July 2016 International Journal of Clinical Legal Education and Association of Canadian Legal Education conference: The Risks and Rewards of Clinical Legal Education Programmes. Externships or field placement programs involve students placed away from the law school and supervised by a person who is not employed by the law school. Externships offer many potential rewards for students as well as other stakeholders, including especially community institutions. But there are also risks—risks that the externship will be expected to accomplish too much with too few resources …
"Your Mission, Should You Choose To Accept It . . .": Taking Law School Mission Statements Seriously, Vanessa Merton
"Your Mission, Should You Choose To Accept It . . .": Taking Law School Mission Statements Seriously, Vanessa Merton
Elisabeth Haub School of Law Faculty Publications
Learning about the process and the results of mission definition in law schools has made palpable the tension between clarity and inflexibility, candor and marketing concerns, and the specificity that fosters accountability as opposed to the generality that embraces a vague multitude of approaches to the law school endeavor. Building on the strong endorsement of the use of mission statements in the original Best Practices for Legal Education, we present some “Best Practices” for both the development and the content of law school mission statements. We hope that this piece hastens further conversation and commentary that will foster a richer …

Another Look At The Need For Family Law Education Reform: One Law School's Innovations, Barbara A. Babb
Another Look At The Need For Family Law Education Reform: One Law School's Innovations, Barbara A. Babb
All Faculty Scholarship
The pressing need to change family law education stems from increased numbers and types of family law matters before the courts, changing legal standards, and the evolution of family law practice. The Family Law Education Reform Project, the Families Matter Report, and the IAALS Family Bar Summit recommend that traditional family law education be supplemented to reflect the importance of a holistic blend of theory and practice. This involves expanding student clinical or experiential programs, incorporating interdisciplinary studies specific to the context of family law, and enhancing continuing legal education opportunities. As one law school example, the University of Baltimore …

State Bar Efforts To Deny Accreditation To Faith-Based Cle Ethics Programs Sponsored By Religiously Affiliated Law Schools, Bill Piatt
Faculty Articles
Religiously affiliated law schools focus on the integration of faith in the formation of future attorneys and leaders. Yet our students are only our students for three years. We can extend our influence and continue to provide a faith-based perspective to them and to other attorneys during the thirty, forty, or more years of their careers by offering continuing legal education (CLE) courses, which bring attorneys and judges together to provide a model for incorporating faith and morality into our professional roles. However, CLE programs must receive accreditation by state authorities if participants are to receive credit for them. Recently, …
Whoosh - Declining Law School Applications And Entering Credentials: Responding With Pivot Pedagogy, Laura M. Padilla
Whoosh - Declining Law School Applications And Entering Credentials: Responding With Pivot Pedagogy, Laura M. Padilla
Faculty Scholarship
The number of law school applications and entering law students and the credentials of those students, declined all at once. This trend has continued for many years, however, given the cyclical nature of law school applications, it will likely reverse eventually and credentials will improve, but not overnight. The first part of the article briefly discusses the decline in law school applicants and applications, including the confluence of perfect storm factors that resulted in more of the crash landing we experienced than a gradual drop. It also details the corresponding drop in entering credentials which accompanied that decline. The article …
