The Dualist Model Of Legal Teaching And Scholarship, Marin Roger Scordato
The Dualist Model Of Legal Teaching And Scholarship, Marin Roger Scordato
Scholarly Articles
It is not the purpose of this Article to evaluate the accuracy of the claim that teaching and research can be mutually supportive functions. Instead, the following analysis focuses on an aspect of the current situation which has been given much less attention, the costs to both legal scholarship and to law school teaching that result from the predominant dualist model. Identifying and examining some of these costs is important because even if it were established conclusively that legal research and teaching are mutually supportive pursuits, the desirability of the dualist model ultimately depends upon a balancing of the benefits …
Legal Aid, Public Service And Clinical Legal Education: Future Directions From India And The United States, Frank S. Bloch, Iqbal S. Ishar
Legal Aid, Public Service And Clinical Legal Education: Future Directions From India And The United States, Frank S. Bloch, Iqbal S. Ishar
Michigan Journal of International Law
In this article, the legal aid traditions and broader public service agendas of clinical legal education in both countries are explored. These sections are followed by a comparison of the legal aid and public service components of the clinical curriculum in the two countries. It is observed that while clinical programs in the United States have tended to shift their focus away from legal aid and public service goals to broader academic and educational goals consistent with the integration of clinical legal education into the law school mainstream, clinical programs in India have remained firmly rooted in and closely tied …
The Making Of A Law Teacher, Odeana R. Neal
The Making Of A Law Teacher, Odeana R. Neal
All Faculty Scholarship
At a meeting of the Northeast Corridor in October, 1990, Paulette Caldwell wondered aloud whether black women law teachers might be carrying on a cultural tradition of teaching. Her inquiry struck a chord with me that I hadn't heard in a long time. When I was very young, I wanted to be a teacher. I tutored younger children when I was in elementary school and commandeered a math class in junior high school after the teacher challenged me to "get up here and teach the class if you think you can do it better than I can." I thought I …

Law Faculty Publications
Numerous women have experienced great difficulty securing tenure at many institutions during the 1980's, even though significant numbers of women entered law teaching in that period. There currently is only an imperfect understanding of the reasons why women have encountered problems in attaining tenure. It is imperative that an enhanced appreciation of these difficulties be developed. If the problems are allowed to persist, the career and the personal well-being of every woman who considers seeking tenure are jeopardized, legal education's commitment to fairness is threatened, and the prospects for improving the treatment of women in the legal profession are reduced. …

Clinical Legal Education Through The Looking-Glass, M Kathryn Munn
Clinical Legal Education Through The Looking-Glass, M Kathryn Munn
Dalhousie Law Journal
This paper describes the implementation of a clinical legal education program at the University of Western Ontario. By coincidence, the paper was completed just as a major change in direction was unfolding in the program. The origin and purposes of clinical education I will leave to another occasion. Suffice it to say that my answer to the question, "does a law school need clinical education?", is a resounding "yes".

Persuasion, Joseph William Singer
Persuasion, Joseph William Singer
Michigan Law Review
Lawyers spend a lot of time attempting to persuade other people. They persuade judges to promulgate rules of law that favor their clients. They persuade their law partners to adopt their interpretation of existing law or to adopt their strategy for litigation. They persuade clients to accept the dictates of the law. They persuade adversaries in settlement negotiations and their clients' business associates in contract negotiations. They persuade legislatures to fund legal services for the poor, to adopt or to reject law reforms.
Law professors spend most of their time teaching - or at least practicing - the art of …

History Of The University Of Puget Sound School Of Law, Anita M. Steele
History Of The University Of Puget Sound School Of Law, Anita M. Steele
Seattle University Law Review
This essay presents the history of the University of Puget Sound School of Law. Founded in 1972, the law school is a relatively young institution, still in its teens. Its gestation period, however, extends back at least sixty years. As long ago as 1912, prominent Tacoma attorneys proposed to found a law school associated with the University of Puget Sound (UPS). In the ensuing years, officials at UPS periodically raised the issue of creating a law school. Various studies were undertaken, but it was not until the late 1960s that a school of law was considered again as seriously as …

Empowerment And Achievement In Minority Law Student Support Programs: Constructing Affirmative Action, Leslie G. Espinoza
Empowerment And Achievement In Minority Law Student Support Programs: Constructing Affirmative Action, Leslie G. Espinoza
University of Michigan Journal of Law Reform
Part I of this Article reviews the findings of the LSAC Report. The LSAC Report is a good beginning for an understanding of the structure of current minority academic support programs. The data provided by the Report, particularly regarding student selection criteria, demonstrates the link between support programs and affirmative action. Part II explores the stigma exacerbated by many academic support programs and the prejudice that stigma perpetuates. Part III examines law school myopia in approach and design of academic support programs. Academic support should do more than reiterate, albeit at a slow and studied pace, earlier classroom material. Students …
