America’s safety net is failing to protect its most vulnerable citizens from the growing pressures of climate change, according to new research from an Indiana University Maurer School of Law Professor Andrew Hammond.

In a new article forthcoming in the Iowa Law Review, Hammond argues that while policymakers, the press, and the public tend to focus on climate “shocks” like hurricanes and wildfires, millions of Americans face overlooked climate “strains”—the everyday stresses of extreme heat, deteriorating air quality, and failing infrastructure that disproportionately affect low-income Americans.

The Ethics Of Industry-Funded Speakers’ Bureaus—How They Disseminate Innovation And Could Corrupt Medicine, Jennifer E. Miller, Christopher Robertson

It is often said that a business without marketing is dead. But when a medical product is marketed irresponsibly, it is patients who may pay with their lives. In this context, Wieberdink et al1 examine participation in industry-sponsored speakers’ bureaus by academic clinical faculty, conceptualizing the practice as a form of conflicted and irresponsible pharmaceutical marketing. Reviewing 129 US allopathic medical school conflict-of-interest (COI) policies, they found that less than 40% prohibit industry speakers’ bureau participation outright, while 19% impose conditional restrictions, such as requiring that faculty retain control over presentation content. The Supreme Court's haphazard approach to allocating burdens of proof in criminal procedure has created a system in which constitutional rights can be rendered meaningless simply because defendants are required to prove things they cannot possibly know. Even though allocations of the burden of proof often drive litigation outcomes, the Court has failed to establish clear burden allocation structures for cases arising under the Fourth, Fifth, Sixth, and Fourteenth Amendments, leaving lower courts split about how to allocate the burdens. Climate change has accelerated the frequency and severity of natural disasters globally and wildfires are no exception. In part, wildfires have intensified due to climate change, short-sighted fire suppression policies, and the rapid influx of people and development in hazardous regions. Like other natural disasters, wildfires will continue to pose an ever-increasing threat to communities nationally. And the federal government's default approach of providing aid after disaster strikes will only continue to become more unsustainable as climate change worsens. United States, the Court determined that the President as Chief Executive is immune from conduct associated with official acts. The question that emanates from this opinion is how will this decision affect Indian Country and tribal court determinations of tribal sovereign immunity? The Consequences Of Declining Patriotism In The United States, Neil N. Snyder

The US Army War College Quarterly: Parameters

Patriotism, an important determinant of American civil-military relations, is in decline among many Americans. This article analyzes the results of an extensive national survey fielded to assess Americans’ attitudes and finds that more veterans value patriotism than Generation Z nonveterans, that Americans’ trust in their military is correlated with their value for patriotism, and that members of Generation Z are more likely to consider serving in the US military if they value patriotism. Although patriotism is normally a source of national unity, it may now be a source of division between veterans, nonveterans, and Generation Z.

This article argues that Russia’s Arctic land forces have been weakened by the Russia-Ukraine War and NATO’s northern expansion, creating a strategic window for Western militaries to bolster their Arctic capabilities. Unlike existing studies that focus on maritime operations and the Northern Sea Route, it integrates technical assessments of ground-based Arctic platforms with analysis of military-district reforms. Using a mixed methodology that incorporates equipment specifications, Russian government documents, media reports, and NATO strategic-response evaluations, this article constructs a comprehensive baseline understanding of Russia’s Arctic land-force potential and readiness. A popular view about the legal realists is that, either knowingly or inadvertently, they advanced ideas inconsistent with traditional values, democracy, and the rule of law. Another view about them suggested that the realists had no political theory: they only offered a descriptive (empirical) theory of adjudication, albeit one that has normatively “quietist” implications. In this essay, I challenge both views. I argue that there were two legal realist camps whose jurisprudential ideas presupposed two quite different political theories. Ai Enabled Autonomous Weapons And Human Control: Part Iii: Human Control And System Operators, Lena Trabucco

International Law Studies

This article is the third installment of a three-part series on AI-enabled weapons and human control. Artificial intelligence (AI) is shaping debates about military technology by challenging the role of human decision-making in the use of autonomous weapon systems (AWS). This article argues that effective governance of AI-enabled AWS requires moving beyond narrow conceptions of “meaningful human control” and instead recognizing a network of embedded human judgment throughout the weapon system’s lifecycle. This article focuses on the operator stage, examining the unique role of operators through guiding, observing, and terminating deployed AWS.
