Arbitrability Of Government Contracts Disputes Between State Sovereignty And Investors’ Guarantees: A Comparative Study, Arem Sayed Aboelazm, Fady Tawakol, Mohammad Rababa

This paper examines the balance between state sovereignty and the subordination of states to non-national jurisdictions. It explores jurisprudential and legal perspectives on arbitration in state contracts and highlights its implications for the legal framework governing such contracts (Alanzi, 2021a; Abbas, 2020). The analysis focuses on Egypt and the United Arab Emirates (UAE), assessing the legitimacy of arbitration in state contracts within both jurisdictions. A descriptive-analytical method is applied to investigate the debates among public law scholars regarding the admissibility of arbitration in disputes involving state contracts, as well as the arguments underpinning their positions. This research aims to study the impact of Artificial Intelligence (AI) applications, particularly smart contracts and smart agents, on the traditional rules of contract theory in civil law. The study analyzes and compares the extent to which the legislation and judiciary in Iraqi and Egyptian law (belonging to the Latin Civil Law family), French law (the historical origin), and English law (belonging to the Common Law family) accommodate the challenges posed by AI to the essential elements of a contract, primarily consent, object, and cause, in addition to the problem of legal liability arising from the errors of these applications. …

The Luristic And Legal Ruling On The Use Of Embryos After The Dissolution Of The Marital Relationship, Afrah Abdul-Karim Khalil

This research addresses the juristic ruling on the use of fertilized embryos in assisted reproduction after the dissolution of marriage due to death or divorce. It examines the balance between the wife’s desire for motherhood and the Sharīʿah requirement of maintaining a valid marital bond. Using a descriptive, analytical, and inductive approach, the study reviews contemporary juristic opinions and resolutions issued by fiqh councils. It concludes that both statutory law and the majority of jurists prohibit such use after marital dissolution in order to prevent confusion of lineage. Judicial expenses and costs represent a fundamental component of the justice system, constituting a financial burden on the parties to a civil lawsuit, which influences the decision to resort to litigation. Despite their importance, their legal regulation in Iraqi legislation, particularly in the Code of Civil Procedure, shows deficiencies. parallel proceedings, which arise when identical or related disputes are submitted to multiple judicial or arbitral forums, thereby threatening the stability of international commercial arbitration. The research examines the Iraqi legal framework and judicial practice, and provides a comparative analysis of key international approaches, including those of Egypt, France, and England. Using an analytical and comparative methodology supported by legislative texts, case law, and contemporary scholarly opinions, the study proposes practical recommendations to reinforce arbitrators’ independence and strengthen judicial–arbitral cooperation.
