Press Protection As Anticorruption, Zachary Reger Mar 2026

Press Protection As Anticorruption, Zachary Reger

Texas A&M Law Review

As the partisan press of the Founding Era gave way to the commercial press of the nineteenth century, then to the professional press of the twentieth century, American journalism assumed an increasingly skeptical attitude toward governmental power. Today, the investigatory and information-spreading functions of the “fourth branch” are more important than ever to checking public corruption in a vast administrative state. At the same time, the press faces financial crisis, threatening the anticorruption interest.

This Essay evaluates three mechanisms for shoring up the corruption-fighting role of American journalism: (1) constitutional speech protections for the corporate form taken by most modern …

Reverse Breakup Fees And Antitrust Approval, Albert H. Choi, Abraham L. Wickelgren Mar 2026

Reverse Breakup Fees And Antitrust Approval, Albert H. Choi, Abraham L. Wickelgren

Law & Economics Working Papers

The paper examines the antitrust implications of use of reverse breakup (termination) fees in mergers. By promising to pay a reverse breakup fee to the target if the proposed merger does not get the necessary antitrust approval, the acquirer can signal to the antitrust authority that the merger is more likely to be pro-competitive. A large reverse breakup fee can also function as a commitment device by the acquirer to spend more resources in case the merger is challenged by the antitrust authority. While the first, signaling function is efficiency enhancing, the second, commitment function can lead to an efficiency …

Transnational Private Environmental Regulation: Are States Striking Back?, Errol E. Meidinger Mar 2026

Transnational Private Environmental Regulation: Are States Striking Back?, Errol E. Meidinger

Contributions to Books

Published as Chapter 11 in Research Handbook on Environmental Regulation, David Williamson, Gary Lynch-Wood & Agne Prochorskaite, eds.

Rapid global trade expansion beginning in the 1990s spawned a parallel expansion in non-state (‘private’) environmental regulatory (PER) programs. They issue regulatory standards, monitor and judge performance, sanction poor performance, and sometimes regulate state activities. PER programs constitute extensive and complex transnational governance agglomerations encompassing environmental certification, corporate social responsibility, and environment-society-governance programs, typically intertwined with governmental and intergovernmental regulatory programs.

Using forestry and climate change examples, this article analyzes key features of PER programs, how they may be growing empirically more …

Redesigning Online Graduate Orientation To Foster Academic Resilience And Prevent Underperformance, Stella Michael-Makri, David E. Rodriguez Mar 2026

Redesigning Online Graduate Orientation To Foster Academic Resilience And Prevent Underperformance, Stella Michael-Makri, David E. Rodriguez

Journal of Academic Underperformance

Graduate students in fully online programs often begin their academic journey without adequate preparation for the emotional, structural, and cultural challenges of graduate-level work. For students who are first-generation, racially marginalized, international, or returning to education after time away, this lack of scaffolding can lead to early disengagement, underperformance, or attrition. Orientation, often treated as a checklist of logistical tasks, represents a missed opportunity for meaningful academic intervention. This manuscript proposes a five-module conceptual model for online graduate orientation designed to proactively support online graduate students in the domains of emotional regulation and academic identity, time management and executive functioning, …

Mitigating Uas Airspace Risks Through Policy Innovation, Christopher Daniel Sidor Mar 2026

Mitigating Uas Airspace Risks Through Policy Innovation, Christopher Daniel Sidor

Student Research Symposium (SRS)

Uncrewed Aircraft Systems (UAS), commonly known as drones, have become an everyday part of our lives. Once a technology reserved for the defense industry, UAS are now widely available and affordable in the commercial market. These systems have been used for intelligence, surveillance, and reconnaissance (ISR) missions, route mapping, and kinetic deployment of munitions. In modern warfare, drones have been at the forefront, leveraging new tactics, techniques, and procedures to enhance lethality and destruction. The integration of fiber-optic (FO) connected drones, first-person view (FPV) technology, and 3D printed munition-dropping devices in particular demonstrates a dire need for legislative intervention. These …
