Court-Stripping, Court-Packing, And Court Defying: Revisiting The Supreme Court’S Essential Functions, Curtis A. Bradley, Neil S. Siegel

The "essential functions thesis" is one of the most famous structural arguments in the field of federal courts. The thesis, which has been endorsed by a number of prominent scholars and the executive branch, posits that there are implicit, structural limits on Congress's authority to "strip" the Supreme Court of its appellate jurisdiction. Court-stripping, the thesis contends, is not allowed if it would undermine the essential functions of the Court-in particular, maintaining the supremacy and uniformity of federal law. Reclaiming Fiduciary Duty: Esg, Wall Street Fee Minimalism, And The Case For Pension Divestment, Thomas Murray, R. Alexander Acosta

This Article examines two forces that have distorted the fiduciary obligations of American pension trustees: (1) ESG activism by the dominant index fund managers and (2) the fee-minimalism argument those same managers have deployed to discourage divestment. Part I establishes the legal architecture of fiduciary duty under ERISA and trust law, centering on the independent duties of loyalty and prudence. Part II traces the history of how ESG considerations migrated from the periphery of investment practice to institutional orthodoxy through the influence of investment consultants, global coalitions, and Department of Labor subregulatory guidance. Artificial Intelligence is rapidly altering the landscape of many industries, and for some, faster than the law can necessarily keep up, leaving those industries unprotected from AI-related concerns. For the healthcare industry in particular, the integration of AI presents large-scale data privacy concerns. The current law protecting patient data privacy, the Health Insurance Portability and Accountability Act (“HIPAA”), is potentially already outdated and inadequate; concerns about HIPAA’s efficacy have long-existed and AI’s integration has only solidified this concern. Subject-matter jurisdiction is critical to every case, small or large.  Establishing the court’s authority to adjudicate a present matter is tantamount to every case and for every judge.  Despite the importance of properly entering and remaining in federal courts, civil procedure cases often receive far less fanfare than most others before the Supreme Court.  Such was the case last term in Royal Canin U.S.A., Inc. v. Wullschleger, an overlooked case which silently reshaped removal jurisdiction jurisprudence. The Fourth Amendment And Geofence Warrants: Safeguarding Geofencing's Constitutionality Through Particularity And Reasonableness, Mathias Lang

Geofencing, a location-based investigative technique that uses digital mapping to identify individuals within a defined geographic area, has become an increasingly common yet constitutionally contentious tool for law enforcement. Federal courts remain deeply divided on whether geofence warrants comport with the Fourth Amendment. The Fifth Circuit has held that such warrants constitute unconstitutional general warrants, while the Fourth Circuit has concluded that they do not even amount to searches under the third-party doctrine. This circuit split exposes a broader tension between technological innovation and foundational constitutional privacy protections.

Being found in violation of probation has dire consequences. The person found in violation can be imprisoned, upending them from their job, family, and community. Unlike incarceration after a criminal trial, a sentence after a violation of probation is not the result of a legal process characterized by robust due process protections. It is also often not the result of a forceful and thorough defense. On July 30, 2025, U.S. President Donald Trump imposed 50% tariffs on imports from Brazil and sanctioned a sitting Brazilian Supreme Court Justice, both partially because of Brazil’s online content moderation decisions. This is an extreme, but not an isolated event: worldwide, legislators and regulators struggle to craft public policies that address problems of disinformation and online harassment while protecting the freedom of expression—leading to increasing international confrontations. In 2007, almost twenty years ago, the Magnuson-Stevens Act changed the landscape of fisheries management in the US. Through the establishment of Fisheries Management Councils (FMCs), it paved the way for top-down management approaches that helped the government combat nationwide declines or collapses in fish stocks. Among the myriad responsibilities of the FMCs was the expectation that amendments to existing fisheries management plans would be a necessity to adapt to modern circumstances. A Meta-Analysis On Joinder Effects: Do They All Have The Same Magnitude?, Amelia M. Tisk

Student Theses

The present meta-analysis examined whether different forms of joinder and procedural consolidation produce varying levels of prejudice in adjudicative decision-making. Although joinder procedures improve judicial efficiency, psychological research has suggested that combining charges, defendants, or plaintiffs within a single proceeding may increase conviction likelihood, liability judgments, and broader perceptions of wrongdoing. A random-effects meta-analysis was conducted across 22 independent study effects examining charge joinder, defendant consolidation, plaintiff consolidation, multiple-complainant procedures, and related aggregation paradigms. Effect sizes were converted to Pearson’s r whenever possible. Overall, procedural aggregation produced a moderate effect on adjudicative outcomes, r = .27, 95% CI [.22, .32]. …

In 2022, in New York State Rifle & Pistol Ass’n v. Bruen, the Supreme Court revolutionized the Second Amendment, achieving the long-held conservative goal of limiting gun restrictions by imposing an expansive, originalist view of the right to bear arms. However, within just three years, Bruen is showing cracks. Lower court judges are struggling mightily to apply it and are expressing their frustrations in exceptionally frank ways. Despite the long history of transgender people and transgender care, state legislatures suddenly rushed to pass a wave of bans on gender-affirming medical care for trans youth over a three-year period beginning in 2021—an alarming surge within a flurry of legal attacks on the transgender community. Adverse Childhood Experiences (ACEs) are especially common among youth involved in the juvenile justice system, and research has consistently linked these early traumatic experiences to a variety of negative behavioral and developmental outcomes. Still, we do not fully understand how strongly cumulative ACE exposure predicts whether detained youth will reoffend, or whether trauma-informed rehabilitation programs can help reduce that risk. This proposed quantitative study explores the relationship between ACE scores and recidivism among youth ages 11–18 detained at the San Bernardino County Juvenile Detention Center. It has been well established that memory of an event can be modified by introducing misinformation through questioning. This study fills a gap in the research literature by testing the potential relationship between perceived authority and susceptibility to misinformation. This was measured through showing participants a video of a traffic accident and asking them questions about the events they witnessed. Participants were also asked to rate their confidence in the correctness of each answer to determine if there are any correlations between authority, correct answers, misinformation, and confidence. In this research study, we discuss the social phenomenon of mass incarceration in the United States. Previous research has evidenced clear racial disparities within this social issue, but has yet to make a connection between high incarceration rates and the sheer volume of police officers in many communities. This descriptive study sets out to discover whether there is a difference in incarceration rates based on the level of police presence in select counties in Northern California. The study will measure police presence by the number of police officers, using secondary data from U.S. government and nonprofit agencies. The researcher hypothesizes …
