From Civic Duties To Democratic Mandates: The Theoretical Framework Of Mill And Tocqueville On Compulsory Voting In The U.S., Olivia Claire Luttrell
Undergraduate Honors Theses
This thesis examines the treatment of jury duty and voting in the United States through the philosophical framework of John Stuart Mill and Alexis de Tocqueville. While jury duty is legally mandated, voting remains optional, despite both civic responsibilities being foundational to democratic participation. This research explores the historical, theoretical, and practical implications of voting becoming compulsory in the United States, as it is in other democratic nations. The analysis includes a comparative case study of the impact of Australia’s mandatory voting to evaluate whether it could become compulsory in the U.S. Both philosophers offer insightful knowledge on the role …

Probative Of Prejudice: Procedural Unfairness Underlying Security Threat Group Classifications In Canadian Prisons, Shane Martinez
Journal of Law and Social Policy
Achieving meaningful oversight and enforcement of prisoners’ rights has long been a challenge for those incarcerated in Canada’s prison system. This is illustrated in part by how the Correctional Service of Canada (CSC) applies the Security Threat Group (STG) classification to Black prisoners. CSC disproportionately classifies Black prisoners as being members or affiliates of STGS–even when those allegations are of unknown reliability. This paper analytically highlights how this practice impacts the liberty interests of these prisoners on the basis of unproven allegations. It also considers how a lack of procedural safeguards in this context contributes to a larger pattern of …

ในปี พ.ศ. 2541 (ค.ศ. 1998) องค์กรอุทธรณ์ขององค์การการค้าโลก (the World Trade Organization) ได้ให้ความสำคัญของค่านิยมเรื่อง “การอนุรักษ์สัตว์ป่าที่ใกล้สูญพันธุ์” ได้แก่ เต่าทะเล ว่ามีความสำคัญเทียบเท่ากับค่านิยมเรื่อง “ประสิทธิภาพทางเศรษฐกิจ” ตามทฤษฎีทางเศรษฐศาสตร์เรื่องความได้เปรียบโดยเปรียบเทียบ (Comparative Advantage) โดยตัดสินคดีข้อพิพาทระหว่างประเทศสหรัฐอเมริกากับประเทศอินเดีย ปากีสถาน มาเลเซีย และไทย ว่ามาตรการของประเทศสหรัฐอเมริกาที่ห้ามนำเข้ากุ้งจากประเทศอินเดีย ปากีสถาน มาเลเซีย และไทยนั้น แม้จะเป็นมาตรการที่ไม่สอดคล้องกับข้อ 11 ของความตกลงทั่วไปว่าด้วยภาษีศุลกากรและการค้า (General Agreement on Tariffs and Trade หรือ GATT) ก็ตาม แต่ก็ได้รับการนิรโทษตามข้อ 20 (จี) ของความตกลงฉบับดังกล่าวเนื่องจากเต่าทะเลเป็นทรัพยากรธรรมชาติที่ใช้แล้วสูญสิ้นหมดไป เมื่อวิเคราะห์เปรียบเทียบระหว่างคำตัดสินในข้อพิพาทดังกล่าวกับมาตรการเก็บคาร์บอนข้ามพรมแดนของสหภาพยุโรป (European Carbon Border Adjustment Mechanism หรือ EU-CBAM) แล้ว อาจชี้ให้เห็นได้ว่าในอนาคต หากมีข้อพิพาทที่เกี่ยวข้องกับมาตรการดังกล่าวเข้าสู่กลไกระงับข้อพิพาทขององค์การการค้าโลกแล้ว คณะพิจารณาข้อพิพาทและองค์กรอุทธรณ์ขององค์การการค้าโลกซึ่งตระหนักดีถึงปัญหา “วิกฤตโลกร้อน” ที่เกิดขึ้นในปัจจุบัน ก็มีแนวโน้มสูงที่จะให้ความสำคัญกับค่านิยมสากลเรื่อง “การอนุรักษ์ชั้นบรรยากาศโลก” อันได้แก่ การลดปริมาณการปล่อยก๊าซเรือนกระจกเข้าสู่ชั้นบรรยากาศของโลกเพื่อไม่ให้อุณหภูมิของโลกสูงขึ้นเกินกว่า 2 องศาเซลเซียส ภายใน พ.ศ. 2593 (ค.ศ. 2050) ไม่น้อยไปกว่าค่านิยมเรื่อง “ประสิทธิภาพทางเศรษฐกิจ” และคงจะตัดสินให้มาตรการ EU-CBAM ได้รับการนิรโทษตามข้อ 20 (จี) ของความตกลงทั่วไปว่าด้วยภาษีศุลกากรและการค้าเช่นเดียวกัน

ประเทศไทยมิได้มีกฎหมายภายในประเทศที่รับรองคุ้มครองสิทธิในการแสวงหาที่ลี้ภัยจากการประหัตประหาร (Right to Seek Asylum from Persecution) ของผู้พลัดถิ่น (Forcibly Displaced Persons) ซึ่งรวมถึงผู้ลี้ภัย (Refugees) เป็นการเฉพาะ ทั้งนี้ เมื่อเดือนกันยายน พ.ศ. 2566 สำนักงานตรวจคนเข้าเมืองได้เริ่มคัดกรอง “ผู้ได้รับการคุ้มครอง” ตามระเบียบสำนักนายกรัฐมนตรีว่าด้วยการคัดกรองคนต่างด้าวที่เข้ามาในราชอาณาจักรและไม่สามารถเดินทางกลับประเทศอันเป็นภูมิลำเนาได้ พ.ศ. 2562 หรือที่รู้จักกันในนาม National Screening Mechanism (NSM) โดยคนต่างด้าวที่ผ่านการคัดกรองจะได้รับการคุ้มครองจากการถูกบังคับส่งกลับไปยังประเทศต้นทางที่อาจมีภยันตราย (Protection Against Refoulement) แม้ประเทศไทยจะมิได้เป็นภาคีต่ออนุสัญญาว่าด้วยสถานภาพผู้ลี้ภัย ค.ศ. 1951 และพิธีสารที่เกี่ยวข้องก็ตาม แต่กระบวนการคัดกรอง NSM ปรากฏลักษณะสำคัญที่คล้ายคลึงกับกระบวนการพิจารณาสถานภาพผู้ลี้ภัย (Refugee Status Determination: RSD) ซึ่งสำนักงานข้าหลวงใหญ่ผู้ลี้ภัยแห่งสหประชาชาติ (UNHCR) ได้ดำเนินการในประเทศไทยมาหลายทศวรรษ อย่างไรก็ดี เมื่อกระบวนการคัดกรอง NSM ถูกดำเนินงานโดยหน่วยงานภาครัฐ อีกทั้งเป็นกระบวนการภายใต้กฎหมายว่าด้วยคนเข้าเมืองซึ่งยึดโยงกับความมั่นคงของชาติและผลประโยชน์ทางการเมืองในระดับภูมิภาค จึงอาจมีข้อพิจารณาอื่นนอกเหนือไปจากความเสี่ยงต่อการประหัตประหาร แตกต่างไปจากบริบทความคุ้มครองระหว่างประเทศ อันเป็นเจตนารมณ์ของกระบวนการคัดกรองผู้ลี้ภัยโดยทั่วไป ดังนั้น จึงเกิดข้อถกเถียงว่ากระบวนการคัดกรอง NSM อาจมิใช่กระบวนการพิจารณาสถานภาพผู้ลี้ภัยในระดับชาติตามความคาดหวังของประชาคมโลก แต่เป็นเพียงข้อโต้แย้งภายใต้กระบวนการตรวจคนเข้าเมืองที่ยังคงปรากฏข้อจำกัดแก่การเข้าถึงสิทธิขั้นพื้นฐาน และอาจยังมิใช่วิธีการแก้ไขปัญหาผู้ลี้ภัยอย่างยั่งยืน

คณะกรรมการกำกับกิจการพลังงาน (กกพ.) มีข้อจำกัดในการกำกับดูแลการประกอบกิจการไฟฟ้าเพื่อรองรับและส่งเสริมการเปลี่ยนผ่านด้านพลังงานสู่สังคมคาร์บอนต่ำตามพระราชบัญญัติการประกอบกิจการพลังงาน พ.ศ. 2550 (“พ.ร.บ. การประกอบกิจการพลังงานฯ”) ฉบับปัจจุบัน เนื่องจากยังไม่อาจออกใบอนุญาตประกอบกิจการไฟฟ้าสำหรับกิจการที่เกิดขึ้นใหม่ เช่น การประกอบกิจการนำเข้าและการส่งออกไฟฟ้า การรวบรวมโหลดไฟฟ้า การจัดการระบบจัดเก็บไฟฟ้า การประกอบกิจการโรงไฟฟ้าเสมือน และการประกอบกิจการไฟฟ้าและการให้บริการไฟฟ้าโดยผ่านระบบเทคโนโลยีสารสนเทศ ดังนั้น จึงควรมีการแก้ไขนิยามของกิจการไฟฟ้าตามกฎหมายให้ครอบคลุมการประกอบกิจการเหล่านี้ พ.ร.บ. การประกอบกิจการพลังงานฯ ควรถูกแก้ไขเพื่อรองรับสถานะของผู้ใช้ไฟฟ้าที่ผลิตไฟฟ้าได้เองให้ชัดเจน และมีบทบัญญัติที่รองรับสิทธิของบุคคลเหล่านี้ในการผลิต ใช้ และขายไฟฟ้าส่วนให้ผู้ใช้ไฟฟ้ารายอื่นได้ นอกจากนี้ เพื่อให้กฎหมายมีศักยภาพในการรับรองและคุ้มครองสิทธิในการเชื่อมต่อและใช้ระบบโครงข่ายไฟฟ้าเพื่อการส่งผ่านไฟฟ้าที่ผลิตจากพลังงานหมุนเวียนเพื่อรองรับการซื้อขายไฟฟ้าระหว่างเอกชนซึ่งมิได้เป็นเจ้าของโครงข่ายไฟฟ้าเอง กฎหมายจึงควรเพิ่มบทบัญญัติกำหนดหน้าที่ของผู้ประกอบกิจการไฟฟ้าที่มีระบบโครงข่ายให้คำนึงถึงการใช้ระบบโครงข่ายของผู้ผลิตไฟฟ้าจากทรัพยากรพลังงานหมุนเวียนอีกด้วย โดยยังคงรักษาความเชื่อถือได้ของระบบโครงข่ายไฟฟ้าเอาไว้ เมื่อการเปลี่ยนผ่านด้านพลังงานอาศัยการมีปฏิสัมพันธ์และการทำธุรกรรมแบบกระจายศูนย์ซึ่งผู้ผลิตและผู้ใช้ไฟฟ้าซื้อขายและส่งมอบไฟฟ้ากันโดยแบบที่มีการแข่งขันกัน กกพ. จึงควรมีอำนาจเพิ่มเติมในการเสนอให้คณะกรรมการนโยบายพลังงานแห่งชาติให้ความเห็นชอบการตั้งตลาดพลังงาน และเพื่อส่งเสริมตลาดไฟฟ้าในประเทศไทย พ.ร.บ. การประกอบกิจการพลังงานฯ และควรเพิ่มบัญญัติซึ่งกำหนดห้ามมิให้ผู้รับใบอนุญาตประกอบกิจการระบบโครงข่ายไฟฟ้ามีพฤติกรรมหรือการประกอบการอันมีลักษณะเป็นอุปสรรคต่อการจัดตั้งและพัฒนาของตลาดไฟฟ้า เพื่อให้การกำกับดูแลการประกอบกิจการไฟฟ้าสามารถก้าวตามพลวัตการเปลี่ยนผ่านด้านพลังงานในระดับสากล กกพ. จึงควรมีอำนาจกำกับกิจการพลังงานให้เป็นไปตามมาตรฐานตามกรอบความร่วมมือระหว่างประเทศด้านพลังงานและสิ่งแวดล้อมที่มีผลผูกพันประเทศไทย ในมิติของอัตราค่าบริการ พ.ร.บ. การประกอบกิจการพลังงานฯ ควรถูกแก้ไขให้เป็นฐานทางกฎหมายให้ กกพ. สามารถกำกับดูแลอัตราค่าบริการให้เหมาะสมกับกิจการไฟฟ้าแต่ละประเภท นอกจากนี้ กฎหมายควรกำหนดให้สัญญาเพื่อจัดหาไฟฟ้าโดยเฉพาะอย่างยิ่งที่รัฐรับซื้อไฟฟ้าจากเอกชนข้อสัญญาที่ทำให้เกิดความยืดหยุ่นในการคิดอัตราค่าไฟฟ้าซึ่งอาจลดต่ำลงจากการเปลี่ยนแปลงสภาพเศรษฐกิจ สังคม การลงทุน หรือเทคโนโลยีในมาตรฐานของสัญญาเกี่ยวกับการให้บริการพลังงาน

Precarity, Property, And Homelessness In Toronto, Alexandra Potamianos
Journal of Law and Social Policy
This article analyzes the relationship that unhoused people have to property, both public and private, in Toronto. It argues that in disputes over the use of certain city spaces by unhoused people their interests are subordinate to those of the state and the property- owning public. To advance this argument, this article uses the example of the conflict between unhoused individuals occupying a hotel leased by Toronto at the start of the COVID-19 pandemic and the surrounding residents of an affluent neighbourhood. Workers from the Global South with temporary immigration status provide a transitory, cheap, exploitable workforce that is responsive to economic vicissitudes and supremacist anti-migration discourse. They are created as an exceptional category of persons “essential” for their work but with no right to remain and claim citizenship-type entitlement to the Global North. The programs in agriculture are rooted in the legacies of indentureship, plantation, and other forms of racialized coerced labour. These programs continue to entrench a neocolonial racial capitalist global order where “unfree labour” is sanctified by contemporary liberal laws. The Effect Of An ‘Appearance, Presentation And Demeanour’ Instruction On Credibility And Deception Judgments In Mock Refugee Status Decisions, Hilary Evans Cameron, Sean Rehaag, Katrina Friesen

Can a written instruction convince refugee status decision-makers not to rely on a claimant’s ‘appearance, presentation, and demeanour’ in judging the claimant’s credibility? How else might such an instruction affect the decision-makers’ deception judgments? This study explored the effects of an APD instruction on the judgments of lay decision-makers making credibility judgments in a simulated refugee hearing (n=275). It sought, by means of an experiment, to quantify the instruction’s effects both on decision- making outcomes and on the written reasons that the decision-makers offered to justify their conclusions. The APD instruction in our study had no significant effect on whether …

Embedded within the United States educational system lies a history that is marked by centuries of exclusion, where students of color were denied the right to an equal education. Despite this legacy of injustice, a story of resilience and bravery also exists, as countless individuals fought for the right to access and succeed in an equal education. This literature review examines the historical exclusion of Mexican American, Asian, and Black students in the United States. สถานการณ์ความขัดแย้งในพื้นที่จังหวัดชายแดนภาคใต้ของประเทศไทย เดิมถูกจัดเป็นการขัดกันทางอาวุธที่ไม่มีลักษณะระหว่างประเทศภายใต้กฎหมายมนุษยธรรมระหว่างประเทศ บทความนี้มีจุดประสงค์เพื่อเปิดโอกาสให้มีการประเมินการจำแนกประเภทการขัดกันทางอาวุธดังกล่าวใหม่ โดยพิจารณาจากพัฒนาการของสถานการณ์ความรุนแรง ประกอบกับองค์ประกอบของการขัดกันทางอาวุธที่ไม่มีลักษณะระหว่างประเทศ กล่าวคือ เกณฑ์ความรุนแรงและเกณฑ์การจัดตั้งของกลุ่มติดอาวุธ นอกจากนี้ บทความนี้จะวิเคราะห์ถึงผลกระทบจากการปรับใช้กฎหมายมนุษยธรรมระหว่างประเทศและกฎหมายสิทธิมนุษยชนระหว่างประเทศ ต่อสถานการณ์ความขัดแย้งในพื้นที่จังหวัดชายแดนภาคใต้ โดยนำเสนอว่าการบังคับใช้กฎหมายระหว่างประเทศดังกล่าว ก่อให้เกิดข้อท้าทายทางกฎหมายในการให้ความคุ้มครองสิทธิของผู้ที่ได้รับผลกระทบ กล่าวคือ สิทธิในชีวิต, สิทธิในเสรีภาพและสิทธิที่จะได้รับการเยียวยา ซึ่งข้อท้าทายเหล่านี้ส่งผลเป็นการลดทอนความคุ้มครองแก่บุคคลดังกล่าวภายใต้กฎหมายสิทธิมนุษยชนระหว่างประเทศ รวมทั้งมีผลกระทบในเชิงลบต่อสถานการณ์ความขัดแย้ง

แม้สิทธิชุมชนจะเป็นสิทธิระดับรัฐธรรมนูญมากว่าสองทศวรรษก็ตาม แต่การขาดความชัดเจนในรายละเอียดของสิทธิ นับเป็นอุปสรรคสำคัญต่อการที่ศาลปกครองจะวินิจฉัยรับรองสิทธิชุมชนให้เกิดผลในทางปฏิบัติ จากปัญหาดังกล่าวจึงเป็นที่มาของงานวิจัยฉบับนี้ที่มุ่งศึกษาแนวคิดและทฤษฎีเกี่ยวกับสิทธิชุมชน และคำวินิจฉัยคดีปกครองเกี่ยวกับสิทธิชุมชนของต่างประเทศ เพื่อนำมากำหนดเป็นแนวทางทางกฎหมายในการวินิจฉัยคดีพิพาทเกี่ยวกับสิทธิชุมชนในศาลปกครองของไทย ผลการศึกษาพบว่า “สิทธิชุมชน” เป็น “สิทธิเชิงกลุ่ม” ซึ่งมีพัฒนาการมาจากกฎหมายสิทธิมนุษยชนและกฎหมายสิ่งแวดล้อมระหว่างประเทศ โดย “ชุมชน” สามารถใช้สิทธิทางศาลได้โดยการมอบหมายให้ปัจเจกบุคล และ/หรือ นิติบุคคล ที่เป็นตัวแทนหรือผู้แทนของชุมชนนำคดีไปฟ้องต่อศาลในนามของชุมชน และในกรณีที่ศาลปกครองพิจารณาแล้วเห็นว่า ผู้ฟ้องคดีเป็นผู้ทรงสิทธิชุมชนตามรัฐธรรมนูญและมีสิทธิในการเข้าถึงและใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อม เช่น มีสิทธิในการดำรงวิถีชีวิตในพื้นที่ป่า เป็นต้น แม้ว่าจะมีข้อจำกัดที่ทำให้ศาลไม่สามารถออกคำบังคับให้ผู้ฟ้องคดีเข้าไปดำรงวิถีชีวิตอยู่ในพื้นที่ป่าได้ก็ตาม หากแต่ผู้ฟ้องคดีฟ้องขอค่าสินไหมทดแทนจากการที่ต้องสูญเสียสิทธิในการกำหนดเจตจำนงของตนเอง และ/หรือ สิทธิในการเข้าถึงและใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อมมาด้วย ศาลปกครองย่อมสามารถกำหนดให้ฝ่ายปกครองชดใช้ค่าสินไหมทดแทนให้แก่ผู้ฟ้องคดีจากการที่ต้องสูญเสียสิทธิดังกล่าวในการดำรงวิถีชีวิตตามจารีตประเพณี ตามบรรทัดฐานคำวินิจฉัยของศาลต่างประเทศได้

การท่องเที่ยวแห่งประเทศไทย (ททท.) เป็นหน่วยงานรัฐวิสาหกิจซึ่งมีหน้าที่ในการประชาสัมพันธ์และส่งเสริมการท่องเที่ยวไทย ททท. มีสำนักงานสาขาที่ตั้งอยู่ในเขตสหภาพยุโรป รวมทั้งมีสำนักงานใหญ่และสำนักงานภูมิภาคหลายสำนักงานที่ตั้งอยู่ในประเทศไทยและมีการเก็บรวบรวมข้อมูลส่วนบุคคลในเขตของสหภาพยุโรปและในประเทศไทย ดังนั้น ททท. จึงอยู่ภายใต้บังคับที่จะต้องปฏิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลของสหภาพยุโรปและของไทย แต่อย่างไรก็ตาม ททท. มีการดำเนินกิจกรรมที่มีความหลากหลายที่เกี่ยวข้องกับการประมวลผลข้อมูลส่วนบุคคล จึงก่อให้เกิดปัญหาในการปฏิบัติตามภาระหน้าที่ตามกฎหมาย ยกตัวอย่างเช่น การบ่งชี้ว่า ททท. มีสถานะเป็นผู้ควบคุมข้อมูลหรือผู้ประมวลผลข้อมูล การบ่งชี้ฐานทางกฎหมายสำหรับการประมวลผลข้อมูลในแต่ละกิจกรรม งานวิจัยนี้จึงมุ่งศึกษาประเด็นปัญหาและอุปสรรคของ ททท. ในการปฏิบัติตามข้อบังคับทั่วไปเกี่ยวกับการคุ้มครองข้อมูล หรือที่เรียกกันว่า General Data Protection Regulation (GDPR) และพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 รวมทั้งมุ่งเสนอแนะวิธีการที่เหมาะสมในการบริหารจัดการปัญหาและอุปสรรคดังกล่าว เช่น การจัดทำคู่มือกำหนดแนวปฏิบัติขององค์กรในการปฏิบัติตามกฎหมาย ทั้งนี้ เพื่อเป็นการลดความเสี่ยงที่ ททท. จะมีความรับผิดที่เกิดขึ้นจากการไม่ปฏิบัติตามกฎหมาย อันจะส่งผลเสียต่อชื่อเสียงของ ททท. และประเทศไทยต่อไป

Pembatasan akses aborsi di Indonesia menyebabkan banyak perempuan dengan kehamilan tidak diinginkan terpaksa berhadapan dengan hukum. Metode original intent lazimnya menghasilkan penafsiran yang bersifat rigid sesuai niat perumusnya. Selama konstitusi tidak diubah, maka tafsiran original intent pun tidak berubah. The phenomenon of single candidates in regional elections in Indonesia has created a dilemma in applying democratic principles, especially regarding ballot design that often confuses voters. The Constitutional Court’s Decision Number 100/PUU-XIII/2015 mandated a plebiscite design with “agree” or “disagree” options for single candidates.
