Chains Of Equity: How Nationwide Injunctions Are Unconstitutional, Irfan Mohamed
Themis: Research Journal of Justice Studies and Forensic Science
Since the early judicial beginnings in the English Courts of Chancery, the principles of equity have guided judicial remedies for centuries. Modern American courts inherited these principles through reception statutes passed by newly independent states, which adopted English common law, including the concept of equity as a means of providing narrowly tailored remedies to resolve specific injuries. This paper examines the historical foundations of equity and argues that nationwide injunctions, which extend beyond the immediate litigants to affect the general public, are inconsistent with these principles and, therefore, unconstitutional. A major problem within law enforcement is police sexual misconduct (PSM), where law enforcement officers commit sexual offenses while using the power of their position. Bonds of loyalty and trust between fellow officers are strong enough that offenders have no worries about being reported, even if they are caught. Studies have shown that most offending officers were new to the field or recently completed their training at a policing academy. Since many of the officers committing PSM were fresh out of their training, it indicates that the academy is not training its recruits properly on topics of sexual assault and …

This literature review examines the ongoing issue of rape kit backlog in the United States. Rape kits are a means of evidence collection from victims of sexual assault that can be used in court. Across the nation, many state jurisdictions have hundreds and thousands of rape kits left untested and locked away in storage facilities. Consent for testing, police bias, and funding issues are the main issues that will be addressed. Many victims choose not to have their kits tested. By analyzing firsthand accounts of Mauritanian migrants gathered at The Migrant Center of St. Francis Church of Assisi, this paper explores the systemic inequities of U.S. immigration law and enforcement, particularly its impact on African migrants. The research argues that these lived experiences expose the disconnect between official narratives of welcoming migrants and the harsh realities of the immigration system, making a case for a more humane and equitable framework. The Lre Provision Of Idea's Impact On Deaf Students' Socio-Emotional Satisfaction In K-12th Grade Education, Shealyn Junge

The education of Deaf and Hard of Hearing (DHH) students represents a unique challenge in implementing inclusive practices that balance physical integration with meaningful language and communication access. The Individuals with Disabilities Education Act’s Least Restrictive Environment (LRE) provision reflects a federal commitment to educating students with disabilities alongside their non-disabled peers whenever possible. This mixed-methods study examined how mainstream, co-enrollment settings, and Deaf schools shape the socio-emotional development of DHH students, including those transitioning between settings. While participants across placements reported increasing DHH identity pride, their social experiences diverged markedly: mainstream-educated participants universally reported loneliness by high school. This research investigates the institutional constraints shaping the adoption of AI-assisted proposal evaluation in federal ICT procurement, using U.S. Customs and Border Protection (CBP) as a case study. Although AI tools are increasingly used by contractors to generate proposals, their integration into government evaluation processes remain limited. Using institutional theory as an analytical framework, this study examines how regulative rules, normative expectations, and cognitive assumptions jointly reinforce a risk-averse procurement culture that inhibits automation. Through a mixed-methods approach—comprising policy analysis, procurement data from FPDS and USAspending.gov, and an elite interview with a CBP contracting officer—the research identifies key barriers to …

This research-to-practice brief explores innovative strategies to enhance digital accessibility for Deaf or Hard of Hearing (D/HH) learners, focusing on practical applications for inclusive K-12 education. Despite advances in digital learning, D/HH learners face unique barriers due to auditory-centered designs. Accessibility legislation such as the ADA, Section 504, and IDEA mandate educational inclusion for these learners. Adults with intellectual and developmental disabilities (IDD) experience inequities in access to timely, accurate, and understandable information and communication technology (ICT), which increases risk for public health emergency (PHE)-related health disparities and impedes opportunities to achieve optimal health. This study assessed federal COVID-19 webpage accessibility levels and explored existing knowledge of and experience with filing accessibility complaints for federal ICT among adults with IDD. Through a mixed-methods approach, we evaluated compliance with accessibility standards for 18 federal agencies’ COVID-19 webpages (study 1) and interviewed 16 adults with IDD about experiences accessing federal webpages and filing accessibility complaints (study 2). The Rhonda Weiss Center for Accessible IDEA Data’s (Weiss Center) mission is to improve state capacity to collect, report, analyze, and use IDEA data in accessible formats for individuals with disabilities. IDEA stands for Individuals with Disabilities Education Act. One of the ways we at the Weiss Center aim to achieve this is through the development and adoption of our Accessible Data Analysis and Publishing Tool (ADAPT). States are responsible for numerous federal reporting requirements on performance indicators related to infants, toddlers, and children with disabilities. Artificial intelligence (AI) is increasingly integrated into everyday life. From customer service chatbots and marketing strategies to player protection tools and surveillance systems, casino operations are embracing the trend. However, without a systematic framework to track the current and emerging use cases across the industry, concerns about transparency, ethical use, and potential consumer harm continue to grow. Rather than aiming to establish binding regulatory practices for an industry and technology that are both quickly evolving, this policy brief advocates for the creation of an AI-use case registry. With the rise in political tension in the United States, the call for transparency from elected officials has reached an all-time high. While the role of American democracy is to promote a sense of participation from constituents, the lack of information regarding policy decisions has exempted the public from the halls of the legislature. This policy brief examines legislative transparency in Nevada through the concept of self-government theory. Law enforcement’s relationship with the Deaf community, particularly the African American/Black Deaf population, has historically been tense, leading to wrongful arrests, police brutality, and even fatalities. This capstone project examines the barriers to effective interaction between law enforcement and the Deaf community, specifically in first-encounter situations, highlighting the Black Deaf experience. Past research has addressed the language barriers that Deaf individuals face in situations such as traffic stops and legal proceedings. However, it rarely examines the specific experiences of Deaf Black/African American families impacted by police-induced trauma caused by an unfair power dynamic. The notion of care refers to activities that satisfy the basic needs of existence and reproduction. Within rural communities, care work such as the production and preparation of food contributes to food security at the household level. Care work supports the paid workforce, allowing workers to focus on commercial productive activities that generate economic income in rural communities. Women perform 6.3 to 29.5 more hours per week than men in unpaid care work, reducing their time for income-generating activities and personal nutrition management. Serving as both a barrier and a bridge that connects Africa and Europe, the Mediterranean is today the focal point of global controversies around migration, where humanitarian interests balance against border policing and meet securitization policies. This thesis examines the questions: How do irregular migrants adapt, interpret, and maneuver around securitized Moroccan and Italian migration policies, and what do their strategies tell us about the relationship between humanitarianism and securitization in Mediterranean bordering processes? You Are What You Spray: How New Mexico Can Better Protect Farmworkers From Pesticides, Rachel Swanteson-Franz

The impact of pesticides on farmworkers is at the intersection of environmental and labor law. Existing federal regulations designed to protect farmworkers from pesticide exposure and illness have failed to adequately do so. While some states have tried to fill these gaps by enacting state regulations, New Mexico is not one of them. However, by borrowing and combining regulatory protections from other states, New Mexico could become a leader in this area. This note first provides a detailed summary of the federal protections and the regulatory history while summarizing criticisms from farmworker advocates. The shift to a low-carbon economy will require a massive build out of low-carbon technologies, which in turn will require millions of new laborers with specific skills. Similarly, the decline of fossil-fuel industries will require retraining and new job opportunities for laborers in these fields. At the same time, there is an emerging scholarly focus on a “just transition” to a low-carbon economy. This essay conceptualizes inclusive workforce development as a key component of a just transition.
