The Emerging Framework For The Recognition & Enforcement Of Annulled Arbitral Awards In U.S. Jurisprudence, Sarah Klim

The recognition and enforcement of foreign awards are governed almost universally by the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the “New York Convention”). However, this recognition and enforcement necessarily invokes national judicial power. The New York Convention does not devise a harmonized set of rules for courts to follow when faced with a request to recognize and enforce an annulled award.3 This has resulted in divergent approaches by national courts, which derive “not from any perversity of judges but from good faith variants in perspectives on how to construe the treaty.” This paper seeks …

Mixed Review Of Constitutional Rights In Cuba, Ngoc Son Bui

Cuba’s 2019 Constitution and the 2022 Law on the Process of Protection of Constitutional Rights create a mixed model of review. Accordingly, the legislature and the executive review the constitutionality of legislation and regulations, while the courts review the constitutionality of state actions. Synthesizing comparative constitutional law and new institutionalism in political science, this article argues that the mixed constitutional review in Cuba is shaped by different historical influences; competing socialist and liberal ideas and discourse; competing political interests; and competing socialist and universal values. The changing landscape on abortion following Dobbs has not only sparked a vigorous debate in the United States, but also abroad. Its recriminalization in America led to an outcry in peer Western democracies, whose leaders widely condemned the U.S. Supreme Court’s decision. Yet the social and historical reasons for this international divide are poorly understood.

The 2025 Fiscal Year National Defense Authorization Act contains multiple provisions relating to artificial intelligence (AI). These congressionally mandated provisions direct various sections of the Department of Defense (DOD) and individual U.S. armed service branches to execute congressional intent for AI policymaking. Examples of such intent include identifying and planning DOD's AI workforce, demonstrating AI biotechnology applications for national security, improving the human usability of AI systems, and establishing an AI security center. New York City Misses the Exit to Traffic Safety investigates New York City’s mounting traffic violence crisis through the lens of a devastating crash that killed a Brooklyn mother and her two daughters. It examines the city’s inconsistent enforcement of reckless driving and the failure of the Dangerous Vehicle Abatement Program (DVAP), which aimed to reform recidivist speeders. The piece investigates the imperfections of Vision Zero, public backlash to automated enforcement, and the broader failure to prevent recidivist speeding. Say It Once, Say It Twice: Abrogating The Rebuttal Requirement Of The Prior Consistent Statement Hearsay Rule, Natashja Atherton

Federal Rule of Evidence 801(d)(1)(B) limits the introduction of a witness’s prior statements during court proceedings, even if those statements are consistent with the witness’s in-court testimony. A witness’s previous declarations can only be solicited if (a) the adversarial party directly attacks the witness’s credibility and (b) the offered prior consistent statement directly rebuts the basis of the attack. This Comment refers to these restrictions as the “rebuttal requirement” of Rule 801(d)(1)(B) and argues for its revocation to make statements substantially consistent with a witness’s in-court testimony admissible, subject to the other rules of evidence, regardless of whether the witness’s …

This Article seeks to identify new ways to respond to critiques of international human rights practice as hierarchy-reproducing, extractive, and imperialist. It proposes one model for how human rights lawyers can better work in solidarity with oppressed communities organizing around common grievances: transnational movement-lawyering. While the framing of community-led lawyering has become rapidly popularized in the human rights field, work remains to ensure that this theoretical and discursive shift translates into a transformation of the day-to-day mechanics of human rights practice. Energy transition has a governance problem. And much of the literature fails to address this problem. That is, it discusses who should make energy transition decisions (the President, Congress, state governments, etc.). But this perspective misses the core substantive problem: how should we share the benefits and burdens of transition? Without answering this energy transition “how” question, any answer to “who” risks appearing as arbitrary decision-making. In this Article, I am the first to submit that we can solve this “how” question using the property-law doctrine of correlative rights. The whereabouts of a decedent’s heirs are sometimes unknown, and consequently some inheritances go unclaimed. Generally, most states regulate unclaimed inheritances by naming a custodian to safekeep the inheritance, and if the absent heir fails to claim it within a prescribed time, then the inheritance escheats to the state. The specifics of the law, however, vary considerably across the country, particularly with respect to the identity of the custodian and the length of the custodial period. A new Indiana law that expands the state’s prescribed burning capacity was signed by Indiana Governor Mike Braun on April 30, in part due to efforts by Indiana University Maurer School of Law students through the school’s Conservation Law Clinic.

The law expands a prescribed fire training program administered through the Indiana Department of Natural Resources and defines the standard of liability for those certified through the training program. Before the bill was signed, Indiana was one of only a few states nationwide without a certification program or standard of liability clearly defined through legislation. This new law will allow …

This article examines whether the U.S. nuclear umbrella provided to allies is currently viable and whether it is time for the United States to share nuclear weapons technology with its allies in the Asia-Pacific to counter the growing nuclear threat posed by China, North Korea, and Russia. The article discusses the current capabilities and nuclear doctrine of States possessing nuclear weapons, as well as Iran’s nascent nuclear weapons program.
