Towards A Critical Legal Tech Education: A Decolonial Approach, Diego H. Alcalá Laboy

The intersection of law, technology, and decolonial theory offers a critical framework for exposing and challenging power asymmetries embedded in both legal and technological systems. Drawing from his experience as a criminal defense attorney and legal academic, Diego H. Alcalá Laboy critiques how surveillance technologies, often framed as tools for justice, disproportionately harm marginalized communities. Grounded in Latin American decolonial theory, particularly the modernity/coloniality/decoloniality triad and the concept of pluriversality, he argues for reimagining legal scholarship and pedagogy to disrupt Eurocentric and universalist assumptions. The Supreme Court’s historic decision to overturn the Chevron doctrine in June 2024 received national attention due to its implications for how much power agencies will hold in the years to come. The Chevron doctrine originally comes from the Supreme Court’s 1984 decision in Chevron, U.S.A., Inc. v. Natural Resources Defense Council.Chevron addressed the requirements imposed on states by The Clean Air Act Amendments of 1977. Heterogeneity In Hospital Consolidation, Christina Depasquale

DePaul Journal of Health Care Law

This paper examines the heterogeneity between two types of hospital consolidations—mergers and system-joinings. I examine changes in admissions, employment outcomes, beds in different medical units, surgeries, costs, case mix, and discharges. I find that hospital mergers and system-joiners are fundamentally different among almost all outcomes examined. Additionally, I extend my analysis by examining those hospitals that, at the time of consolidation, are closer to either their fellow merging hospital or a fellow system-member hospital. I find no meaningful correlation between distance and outcomes.

To fully understand the present, it is useful to trace the past. The relationship between the rule of law and economic development has been a significant topic in the literature. In the 1960s, it was believed that economic development required regulated markets in which the state played an active role. However, when it became evident that the state's involvement in the economy yielded few of the promised benefits, economic neoliberalism emerged. Research suggests that mock jurors impose harsher sentencing (including death sentencing) when defendants are described as psychopathic, but reasons for this are unclear. This preregistered study investigated the role of juror anger and cognitive biases (predecisional distortion [PDD]) in the relationship between defendant psychopathy descriptions and mock juror decision-making. In an online experiment, participants (undergraduates in a large Southeastern university [n=410] and a US Census-representative online sample [n=384]) reviewed case facts of a murder, were randomized to expert witness testimony of defendant psychopathy or control conditions and read the prosecution and defense arguments before sentencing the defendant to death or …

This article challenges the informal and uncoordinated attempts by governments worldwide to hinder technological innovations that could potentially disrupt established monetary systems and undermine the significance of banks, stock exchanges, and financial institutions. The authors argue that the outcome, which effectively sacrifices governments' ability to tax crypto capital appreciation, impedes the widespread adoption of decentralized tokens and is more detrimental than beneficial. Instead of applying outdated tax rules developed a century ago, the article proposes the development of a new regulatory tax framework that takes into account the unique characteristics of decentralized virtual tokens. Tax arbitration mechanisms, which are provided both at the international and EU level, play a significant role in solving international tax disputes. However, such mechanisms do not seem to be fully compliant with the concept of Rule of Law that seems to arise from International and EU Laws. In fact, tax arbitration mechanisms appear to lack —mainly— certain due process guarantees that allow such procedures to comply with the equality principle.

After a century of convergence and consolidation, the international tax regime is at a crossroads. A recent program promoted by the OECD, known as the two pillars program, departs in many ways from long standing norms of the regime. But the OECD and many states insist that the foundations of the regime have not changed, portraying the two pillars as a negotiated, pragmatic compromise that responds mainly to the challenges that the digital economy presented to the old rules. The foreign tax credit has been a cornerstone of the United States international tax system since as early as 1919. However, there have been a number of recent developments in the international tax landscape that warrant a significant revision to the foreign tax credit rules as they apply to controlled foreign corporations (“CFCs”). The 2025 Nebraska state Unicameral dealt with major state budget challenges but also managed to enact four bills affecting Nebraska agriculture and holding three other bills over for possible action in the 2026 legislative session. Enacted legislation dealt with a ban on laboratory-grown meat, the merger of state natural resource and environmental agencies, amending the 2024 paid sick leave initiative, and establishing a School Financing Review Commission. Agricultural-related bills carried over to the 2026 legislative session include modifying cattle feedlot brand inspection fees, inheritance tax reductions, and modifying the 2022 minimum wage initiative.

A More Perfect Peace: Can The Russia-Ukraine War End Justly?, Nathaniel B. Davis, Marlon A. Thomas

The US Army War College Quarterly: Parameters

This article argues that thinking creatively about war termination, both philosophically and politically, utilizing jus post bellum principles and counterintuitive political trade-offs, reveals an opportunity to achieve a sustainable peace that approximates justice. The article surveys how war aims among belligerents have changed, indicating that further change is possible, particularly at the point of war termination. Next, the article examines jus post bellum principles and their application to the Russia-Ukraine War. Finally, the article contends that Ukraine relinquishing Crimea and the Donbas in exchange for NATO membership might be the key to achieving a durable peace that addresses long-term security.

Strategic Narratives To Counter Global Threats, Jerry E. Landrum, Chase Metcalf, Michael M. Posey

The US Army War College Quarterly: Parameters

This article argues that the current National Security Strategy lacks the necessary coherence and fidelity to mobilize collective action against the emerging Russia-China axis. It merges multiple theoretical concepts to assert that the “rules-based order” theme is insufficient for mobilizing public support. Using textual analysis of the strategy compared with publicly available polling to determine levels of popular resonance, the authors find that the “rules-based order emphasis” does not resonate. This study’s conclusions will assist practitioners as they develop an updated National Security Strategy in the new presidential administration.

This article argues that China’s intervention in a Korean conflict will hinge more on North Korea’s ability to hold territory than on bilateral ties. Rather than treat Chinese intervention as a yes-or-no proposition, this study models three scenarios—full intervention, sustained support, and limited support—based on North Korean resilience. Using Chinese-language sources and scenario-based analysis, it assesses how each model would shape key functional areas such as ISR, cyber, materiel, and force posture. The findings offer US defense planners a framework for anticipating variable People’s Liberation Army involvement in a future Korea contingency.

This thesis explores the tragedy of incommensurability between indigenous rights and international human rights law. Despite the emergence of frameworks like the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), indigenous calls for sovereignty remain fundamentally unintelligible within a liberal order structured to preserve settler-state legitimacy. Tracing the historical and theoretical evolution of indigenous advocacy, this study critiques the strategic shift from demands for self-determination to claims of cultural rights. It argues that this shift offers no real alternative: self-determination and cultural rights are functionally equivalent, as both are ultimately filtered through legal and political frameworks that cannot …

Several measures have been advocated by the industry’s practitioners in an attempt to avoid disputes and their adverse impacts.
