Privatizing Regulatory Enforcement: A Preliminary Assessment Of Citizen Suits Under Federal Environmental Laws, Barry Boyer, Errol Meidinger

This article provides a preliminary assessment of the potential effects of the privatization of regulatory enforcement and speculates on what such a realignment might portend for the regulatory process. Based primarily on an indepth review of the first wave of citizen suits brought under the federal Clean Water and Clean Air Acts, it identifies four key problems that can undermine the citizen suit as a device for regulatory enforcement: (1) Citizen suits must surmount a series of doctrinal barriers that could make it difficult or impossible to mount an effective private enforcement campaign. A Critical Evaluation Of U.S. Fair Trade Policy, George Kleinfeld

Vanderbilt Journal of Transnational Law

This article utilizes economic analysis to critique fair trade rhetoric and expose the inconsistencies and protectionist consequences of United States antidumping and antisubsidy laws. Proposed reforms deemphasize the ambiguous concept of fair trade, and focus instead on balancing the conflicting economic interests at issue in most trade disputes. Between the elusive, impractical ideal of unfettered free trade and the protectionist objective of strict "fair trade" sanctions, lies a principled middle ground toward which trade policy-makers should be urged to gravitate.

Recent Development--U.S. Legislation To Prosecute Terrorists: Antiterrorism Or Legalized Kidnapping?, Catherine C. Fisher

Vanderbilt Journal of Transnational Law

This Recent Development examines the jurisdictional bases for the proposed extraterritorial extension of The Terrorist Prosecution Act to crimes that do not occur within the territory of the United States and to persons who are not United States citizens. The historical basis for allowing the prosecution of persons who have been forcibly brought into the court's jurisdiction and constitutional due process concerns that accompany such enforcement means are also detailed. As the consultants to the New York State Law Revision Commission for its Recommendation concerning the child custody dispute resolution process, we share significantly in the credit for and the criticism of the Commission's work. One goal of our effort was to focus attention on the needs of parents and children involved in divorce ─ needs to which the legal system must respond. In May 1982, the International Committee of the Red Cross negotiated an agreement that facilitates prisoner of war exchanges from the Afghan conflict. Despite its creation, numerous problems exist that hinder its effective implementation. This Article examines those problems and discusses the benefits of these types of agreements. Ultimately, it is proposed that the ICRC should continue its efforts to develop these agreements to continue improving the international law that governs civil war and internal conflict.
