Racial Subordination Through Formal Equal Opportunity, Roy L. Brooks Sep 1988

Racial Subordination Through Formal Equal Opportunity, Roy L. Brooks

San Diego Law Review

In this Article, Professor Brooks examines the current state of "formal equal opportunity" and finds it may not be the final expression of interracial relations in the United States. The inquiry begins with the realization that after the passage of hundreds of civil rights laws, Black Americans seem worse off socially and economically than Black Americans were under Jim Crow. The author criticizes civil rights analysis for its failure to ask the right question - the "subordination question." This question would require scholars to analyze the subordinating force or mechanism in civil rights law which the author believes to be …

In Defense Of State Takeover Laws, Theodore W. Grippo

Northern Illinois University Law Review

This Article argues that an economic efficiency model of corporate takeover fails to take into account a number of important, and oftentimes local concerns. The Article further argues that there are a number of deficiencies and inadequacies in the current federal legislation. These factors support the conclusion in this Article that state anti-takeover legislation has an important role in the area of corporate acquisition and its regulation.

Translated Opinions

The military commanders of the various occupied territories, acting pursuant to the Defence (Emergency) Regulations, 1945, ordered the deportation of the Petitioners from the territories, on the ground that they are involved in hostile activities against the State of Israel, such as to endanger the security of the state and the public peace. The Petitioners contend that the deportation orders violate Article 49 of the Fourth Hague Convention of 1949. Sitting in a panel of five Justices, the court denied the petitions, holding:

Risk Communication Law And Implementation Issues In The United States And European Community, Michael S. Baram

Faculty Scholarship

Risk communication has become an important element of public policy in the United States and the European Community (E.C.) for reducing technological risks to workers, product users and community residents. The risk communication process involves disclosure by an industrial firm (or other party) of information about the hazardous attributes of its activity or product to a regulatory agency or to persons who may be at risk, thereby facilitating a shared understanding of the risk and enabling interpretation of various risk prevention and response measures.

There are two general patterns of risk communication. One involves industrial disclosure to a government agency, …

Biotechnology And The Law: Social Responsibility V. Freedom Of Scientific Inquiry?, George P. Smith Ii

Scholarly Articles

At American University in Washington, D.C., on November 20, 1973, Julius Stone presented the tenth annual Mooers Lecture, entitled, "Knowledge, Survival, and the Duties of Science."' The central question and thesis that he propounded could and, indeed, should be raised anew today; they form the very core of the province and function of law, science, and medicine. In our brave new world they point to the leeways of choice and patterns of discourse that exist in grappling with the central issue of social responsibility in scientific inquiry. Perhaps they will assist in forging a consensus opinion for a subsequent course …

This Comment first surveys the world copper industry, its recent history, and present condition."t It then addresses the ability of the domestic copper industry to compete on …
