Liability Of A Carrier Under A Bill Of Lading When The Goods Have Not Been Received By The Carrier, H S. Ross
Liability Of A Carrier Under A Bill Of Lading When The Goods Have Not Been Received By The Carrier, H S. Ross
Michigan Law Review
The coming into force on January I, 1917 in the United States of the FXDMAL BILL Or LADING AcT1 has given new interest to a question which was at one time much debated, namely: should a carrier whose shipmaster or agent has signed a bill of lading be liable to an innocent holder for value of such bill of lading if the carrier can show that the goods were never shipped?

The Mortgages in Possession in New York and in Michigan - It is interesting to observe how tenaciously the old common law of mortgages has persisted in the state of New York, the very cradle of the modem lien theory of the mortgage. As early as 18o2 Chancellor KENT began the importation into that state of Lord MANSFIELD'S Civil Law doctrines of mortgage. Johnson v. Hart, 3 Johns. Cas. 322. In 1814, in the case of Runyan v. Mersereau, ii Johns. 534, the lien theory definitely triumphed over the old law. In other cases, both before and since the statute …
Tort Liability For Negligence In Missouri, George L. Clark
Tort Liability For Negligence In Missouri, George L. Clark
University of Missouri Bulletin Law Series
It was stated, at the beginning of the first article in this series, that in order to make out a prima facie case in an action based upon a negligent tort of the defendant, the plaintiff must allege and prove not only that the defendant was negligent, but also that the defendant's negligent misconduct was at least a part of the legal or proximate cause of the plaintiff's damage. In this article will be discussed the subjects of legal or proximate cause and contributing misconduct of the plaintiff.

Form Of The General Acceptance, F Thulin
Form Of The General Acceptance, F Thulin
Michigan Law Review
Of the various subdivisions of the law of commercial paper, the form of the acceptance is one that in a way has had the most diversified history. Furthermore, from its very nature, and from the fact that the law merchant was very seldom touched by statute, and from the fact that the common law attached no particular significance toa writing (except as to writings under seal and as to writings required by the Statute of Frauds), the form of the acceptance was possible of a rather elaborate analysis.

The Register Vol. 2, No. 2, 1/1916, Suffolk University Law School
The Register Vol. 2, No. 2, 1/1916, Suffolk University Law School
Limited-run Student Newspapers
The Suffolk Law School Register, the first student publication, was published between 1915 and 1921. It includes images of early law school people and places and also includes class notes and anecdotes about Suffolk’s students and alumni; a history of the school, written by founder Gleason Archer; and articles about law. The Register functions much like a yearbook does today, capturing the who, what, where and when of the school, both inside and outside the classroom. Archer’s serialized history provides a first person narrative of his founding of the school and its early growth. The articles about the practice and …

Preliminary Stock Subscription Agreements In Missouri, Manley O. Hudson
Preliminary Stock Subscription Agreements In Missouri, Manley O. Hudson
University of Missouri Bulletin Law Series
Preliminary stock subscription agreements are no longer in general use. In the early part of the last century they were a popular means of organizing corporations, but the more modern general statutes of incorporation which now exist in all of the states have made it less convenient to resort to such methods of organization. In some instances they are still necessary, however. Whenever the organization of a quasi-public or cooperative undertaking is contemplated, they are not only convenient, but almost indispensable. If, for instance, it were proposed to build a railroad from Columbia to Jefferson City for which the capital …

Michigan Law Review
The Form of the Summons Under the Recent Michigan Judicature Act - It would be rather remarkable if in revising such a large portion of the statutes as was undertaken by the Commission on Revision and Consolidation of Statutes of the State of Michigan, appointed in 1913, which reported to the legislature the recently enacted Judicature Act (Public Acts of Michigan, 915, § 314), some ambiguity or uncertainty were not to appear in the revision. The Judicature Act is no exception to the general rule, as the lawyer who attempts to begin suit by summons under it will discover at …
Law Of Percolating Waters, Jno B. Clayberg
Law Of Percolating Waters, Jno B. Clayberg
Michigan Law Review
Percolating waters are well understood as being underground waters. Underground waters have been from time immemorial divided into two general classes, namely: (a) flowing stream's, and (b) percolating waters. Percolating waters are divided by text writers into several distinct classes. No two text writers seem to have adopted the same classification. Such classifications are all more or less unimportant insofar as the application of the law is concerned. There cannot be any difference between percolating water which is diffuse and percolating water which reaches the channel of a stream or its sub-flow. All percolating water, unless detained by some natural …
