Commercial law is not a single, monolithic entity. It has grown into a dense thicket of subject-specific branches that govern a broad range of transactions and corporate actions. When one of such dealings or activities falls concurrently within the purview of two or more of these commercial law branches—such as corporate law, intellectual property law, secured transactions law, conduct and prudential regulation—an overlap materializes. We refer to this legal phenomenon as a commercial law intersection (CLI).

As climate change regulation from the federal level becomes increasingly unlikely, states and local governments emerge as the last stand against climate change in the United States. This tension ushers in questions of separation of powers and federalism, with which the courts have wrestled since the country’s founding. The doctrine of preemption is one of the federal government’s strongest tools to limit states’ authority to regulate climate change. Preemption challenges have been increasing lately and have largely succeeded under judicial deference to the executive branch. Anthropogenic climate change is among the gravest problems humanity faces. Nonetheless, global greenhouse gas emissions are not slowing, and the complete elimination of greenhouse gas emissions is not currently foreseeable. American culture and industries rely on activities and technologies that overuse greenhouse-gas-emitting fuel. Despite ever-increasing awareness and concern, many Americans feel apathetic and discouraged regarding behavioral changes for the benefit of the environment, even those who acknowledge the existence and exigency of climate change. Mitochondrial replacement therapy (MRT) is an in vitro fertilization technique designed to prevent women who are carriers of mitochondrial diseases from passing on these heritable genetic diseases to their children. It is an innovative assisted reproductive technology that is only legal in a small number of countries. The United States has essentially stagnated all opportunities for research and clinical trials on MRT through a rider in H.R.2029 – Consolidated Appropriations Act, 2016. The rider bans clinical trials on all therapies in which a human embryo is intentionally altered to include a heritable genetic modification. This note argues that the rider …

Our current criminal justice system does not adequately consider the effects of abuse on drug crime offenders during the process of determining their sentences. Despite the fact that abuse has very real scientifically corroborated effects on a defendant’s culpability, judges sometimes misinterpret how abuse suffered by (predominantly female) defendants affects their participation in a drug crime. Furthermore, the safety valve—a provision that allows downward departure on a sentence for low-level nonviolent drug offenders who meet certain conditions—does not account for abuse at all. This research project discusses school funding instruments of rural and urban schools in South Carolina and uncovers its effect on student academic achievement. Educational achievement is assessed based on report card datasets between 2018 and 2019, containing South Carolina Assessment of State Standards (SCPASS) score data and South Carolina College and Career Ready Assessment (SCREADY) score data. This research project uses a comparative analysis to evaluate each group’s performance in the subjects of English Language Arts and science. The statistical analysis tools that this research project uses include analysis of variance (ANOVA), linear regression analysis, and Microsoft Power BI. The …

The field of criminology and criminal justice have widely ignored the experience of being a trans person and interacting with the criminal legal system, despite the reality that trans folx experience discrimination and harm at the hands of criminal legal practitioners. This dissertation explores these experiences, as well as how trans folx navigate a myriad of other issues to include their identity and institutional discrimination. America has long been plagued by the legacy of slavery and white supremacy. The new scrutiny that has been applied to the forensic sciences since the emergence of DNA profiling as the gold standard three decades ago has identified numerous concerns about the absence of a solid scientific footing for most disciplines. This article examines one of the lesser-considered problems that afflicts virtually all of the pattern-matching (or “individualization”) disciplines (largely apart from DNA), and even undermines the validity of other forensic disciplines like forensic pathology and medical determinations about child abuse, particularly Shaken Baby Syndrome/Abusive Head Trauma (SBS/AHT). Branded Drug Companies Are Successfully Asserting The Doctrine Of Equivalents In Hatch-Waxman Litigation, Christopher M. Holman

This article reports the results of a study analyzing every Federal Circuit decision the author could find dating back to 2005 that applies the doctrine equivalents (DOE) in the context of pharmaceutical patent litigation, and in particular infringement lawsuits brought against Abbreviated New Drug Application (ANDA) applicants by branded drug companies under the Hatch-Waxman Act. The results of this study show that pharmaceutical innovators were prevailing against would-be generic competitors under the DOE both prior to, and subsequent to, a 2007 article by Professors Lemley and Allison describing the demise of the doctrine equivalents, but that patentees’ success rate has …

In The Color of Creatorship, Anjali Vats offers a compelling analysis of intellectual property (IP) laws through the lens of critical race theory. Providing a persuasive account of the role of racialized perspectives and colonial histories in the making of IP laws, Vats calls on activists to "persuade lawmakers that knowledge production comes in a variety of forms." She makes a valuable contribution to the literature on race and IP, asking us to think about IP citizenship and how this has been framed in the United States. Quarantine and isolation are methods employed by public health officials to control the spread of dangerous disease pathogens through physical isolation of those exposed or symptomatic. While use of these methods has declined in the last century through advances in medical knowledge and treatment, emerging disease threats will likely require increased reliance on them. Despite this, quarantine statutes and related regulations fail to provide compensation to those subject to them, and little recourse exists to make those individuals whole for losses incurred, though the pandemic has highlighted a need for work in this area. This white paper first explains the federal and state wind energy siting approval processes and the military’s current involvement in those processes. In particular, the paper focuses on permit-issuing agencies as opposed to policy-making agencies. Parts I and II outline the federal and state permitting process, respectively. In Part III, the paper discusses the military’s concerns regarding wind energy siting. Part IV moves to the current status of Virginia’s onshore and offshore wind industries. After more than 25 years of Republican political control, Virginia passed thirteen pieces of pro-equality legislation in 2020, the most sweeping of which was the Virginia Values Act. That legislation modernized Virginia civil rights law, bringing the state into line with the overwhelming majority of other states in addressing discrimination. Through the identification of this fidelity within this subset of school law, this Article reclaims the thicket theory pejoration as a constitutionally correct and significantly beneficial theory that embodies the original purposes of the Framers in their adoption of the First Amendment. In doing so, this Article demonstrates that the Court’s educational Establishment Clause jurisprudence has formed a protective thicket around American schoolchildren—a political minority that merits special constitutional shielding from the divisive forces of state-established religion. It is a positive thicket that safeguards the freedom of conscience of all American schoolchildren, no matter their beliefs, while balancing respect for …

Previous research suggests that judges make more favorable rulings for female litigants in family court cases and in criminal sentencing. Although such trends might arise from real differences between men and women, they might also arise from stereotypes that cause judges to favor mothers over fathers and to show leniency towards female defendants. We test for benevolent sexism among hundreds of sitting trial judges with two experiments in which we presented judges with hypothetical cases in which we only varied the gender of the litigants.
