From Trauma To Resilience: The Cases Of Beirut Syndrome By Alexandre Najjar And Beirut 2020 Diary Of A Collapse By Charif Majdalani (Comparative Study), Ilham Slim-Hoteit, Lama Farhat
BAU Journal - Society, Culture and Human Behavior
This study is an attempt to think, interpret and analyze the concept of resilience and to study the factors and mechanisms that result from it under the influence of historical, psychic, social and cultural challenges. Boris Cyrulnik defines resilience as a "biological, psycho-affective, social and cultural process that allows a new development after psychic trauma". It is thus presented as an experience that can only be lived after going through various shocks, turbulences and disturbances, whether individual or collective. The two novels of Alexandre Najjar Le syndrome de Beyrouth and Charif Majdalani Beyrouth 2020 Journal d'un effondrement seem to offer …

Abstract
A dispute over ownership of land rights between the real Original Owner and a Good Faith Purchaser can be assumed as a dispute over legal principles in the field of civil law, namely: the legal principle of Nemo Plus Iuris Ad Alium Transferre Potest Quam Ipse Habet, and the legal principle of Nemo Dat Quad Non Habet (Nemo Dat Rule) against the legal principle of good faith (bona fides). The legal principle of Nemo Plus Iuris Ad Alium Transferre Potest Quam Ipse Habet and the legal principle of Nemo Dat Quad Non Habet (Nemo Dat Rule) are legal principles …

Traditional Knowledge And Twail, Gunjan Deshpande
Indonesian Journal of International Law
Traditional Knowledge (TK) is a deep-rooted notion in the Indian culture, it is the knowledge that has been passed on for centuries and is governed by the traditional customary laws. It applies to everything from food storage, agriculture to medicine to the preservation of the environment. TK are protected by national or regional laws that provide limited protection. Northwestern University Law Review
The state grants residents who live within a school district’s border an ownership interest in that district’s schools. This interest includes the power to exclude nonresidents. To attend school in a school district, a child must prove that she lives at an in-district address and is a bona fide resident. But in highly-sought-after districts and schools, establishing a child’s bona fide residence may be highly contested.
In this Essay, I show that education law, policies, and practices fail to recognize a child’s residence when the child’s family and living situation do not comport with a particular ideal of family life. …
Streaming Property, Lee Anne Fennell
Streaming Property, Lee Anne Fennell
Northwestern University Law Review
People acquire property rights in objects and real estate in order to capture the stream of services that these assets can provide over time. The thing or parcel itself is merely a delivery mechanism, a way of packaging and protecting rights to that value stream. And, significantly, these assets cannot stream services to anyone without a set of facilitating conditions and complementary goods, such as public infrastructure, that do not lie within the asset owner’s individual control. This Essay argues that we can gain fresh traction on inequality by recasting property as service streams rather than as owned things. Doing …

**Risk-Taking Or Risk-Negotiating Model Of Vaccine Liability? Legal And Policy Considerations For Pandemic Vaccines**, Yu-Wei Chen
Lincoln Memorial University Law Review Archive
Vaccine liability determines vaccine availability. The allocation of vaccine liability is a determinant in reaching a procurement contract. Particularly during a pandemic, vaccine accelerated production poses new challenges to vaccine safety, quality, and efficacy. Solving the issue of vaccine liability is as equally important as vaccine equity in ensuring access to vaccines. For COVID-19 vaccine procurements, there are two discernible models of liability allocation around the globe: the United States risk-taking model and the European Union risk-negotiating model. The United States' risk-taking model shows that vaccine liability is borne by the government; in contrast, the European Union's risk-negotiating model shows …

Free-roaming domestic cats (i.e., cats that are owned or unowned and are considered ‘at large’) are globally distributed non-native species that have marked impacts on biodiversity and human health. Despite clear scientific evidence of these impacts, free-roaming cats are either unmanaged or managed using scientifically unsupported and ineffective approaches (e.g., trap-neuter-release [TNR]) in many jurisdictions around the world. A critical first initiative for effective, science-driven management of cats must be broader political and legislative recognition of free-roaming cats as a non-native, invasive species. Designating cats as invasive is important for developing and implementing science-based management plans, which should include efforts …
