The law has failed to recognize recent advances in geriatric psychiatry. Moreover, where medical language has been used, the terminology is either outdated or misapplied. What follows is an attempt to describe the nature and policy of the legal standard for testamentary competency, to set forth the current medical approach to senility and mental disease, and to suggest practical ways for the lawyer to use geriatric psychiatry in behalf of the senile testator.

The current ferment in American legal education has been stimulated mainly by the American realists and a recent offshoot of that school, called policy science. The thrust of their reproof is that law to be studied is not to be found in the casebook and the law library, but is to be found in "law in action" in the context of economic, moral, political, psychological and social forces that shape law and the process of decision. To be blunt, the salmon boat fisherman is as obsolete as the buffalo hunter. The "secret'"—traps and weirs; they make salmon catching absurdly easy and can be operated at 1/20 to 1/30 the boat-catching costs. Hunting for salmon on the high seas is like chasing bees in a meadow. Why not wait until the bees return to their hive, or until the salmon return to their spawning stream? Hunting for salmon with boats makes economic sense as a temporary palliative to an unemployment problem; it makes economic nonsense as a permanent industry in a competitive society in a …

The Behavioral Sciences, Stability, And Change, Donald Young

Vanderbilt Law Review

Estimation of the potential contribution of behavioral research to social stability and social change may be attempted only in over-simplified terms. The necessary simplification here will be accomplished by considering the core behavioral sciences alone, by taking the position that social stability and change are two aspects of a single social process, by assuming that the problem is not whether behavioral research can contribute to understanding of that process but how the contribution best may be made, and by limiting illustrative references mainly to the medical and legal fields.
