In spite of the economic and political importance, fishery problems are being dragged in by the back door, to face decisions by diplomats who, for the most part, lack the requisite interest and competence to solve such problems. It is because of this that it seems timely and useful to raise a few points that might be considered by those who are (presumably) preparing themselves for the new conferences on the law of the sea. This Synopsis is an attempt to summarize legally significant events relevant to the law of the seas on a continuing yearly basis. This initial effort encompasses significant state, national, and international events which occurred between July 1, 1969, and March 15, 1970, indexed chronologically within each topic heading. The selection of the included events is arbitrary, due to the incompleteness of available resource materials and the lack of any established indices of significance. The Applicability Of The "New" Fourth Amendment To Investigations By Secret Agents: A Proposed Delineation Of The Emerging Fourth Amendment Right To Privacy, Robert L. Bergstrom

Washington Law Review

Recent Supreme Court search and seizure cases are the harbingers of a new conceptual way of analyzing fourth amendment questions. The author describes the separate fourth amendment issues of applicability and reasonableness and critically analyzes the Court's development of new privacy rules of applicability. The Court fails to recognize that privacy has both quantitative and qualitative aspects; the limited quantum of privacy analysis may account for this failure. This comment proposes a new fourth amendment privacy model and illustrates its application in various secret agent situations.

Collection of water quality data is also important for the purpose of determining the present and future needs for water resources and for the purpose of determining the proper allocation of limited financial resources among those needs. In addition, such data are necessary in order to conduct research studies and in order to determine water quality trends for the purposes of long-range planning.

Perhaps the best way to collect such data would be to establish a national surveillance system designed to monitor the quality of the nation's water resources. Such a national system is currently under consideration by the Federal …

The problem of state authority over motor vehicle air pollution was recently highlighted when the Illinois Air Pollution Control Board, for the first time, adopted regulations to deal with vehicle emissions. Those regulations are disappointingly feeble. Except for outlawing visible smoke and for making it unlawful to dismantle pollution control devices, the new rules do nothing but state that the Board may decide to do something in the future about pollution from automobiles.

In attempting to improve upon these regulations, however, one is struck with a sense of considerable futility. Given the present limits of technology and the necessarily legislative …

The Federal Water Pollution Control Act,1 which was originally enacted in 1948 and which has been amended five times from 1956 to 1970, has been the primary federal response to the problem of water pollution. The development of that Act in the past twenty-two years has been a story of delayed and inadequate response to the increasing problems of water pollution. The development of the Act's enforcement provisions is particularly representative of those problems. The management of "unwanted pregnancy" by the medical practitioner is changing radically in California and in the United States. This change is manifested by the rapid increase in the number of abortions being performed in accredited hospitals throughout the state. Before 1967, under the restrictive law in force up to that time, 1.8 abortions per 1,000 live births were performed in California hospitals. In the first year under the new Therapeutic Abortion Act, the statewide rate was 11.2 abortions per 1,000 live births. The Convention on the Continental Shelf has come under attack because it does not establish a precise outer boundary for the "legal" continental shelf. It is the author's opinion that the United States should propose or support a revision of the Convention which would rectify this situation. A suitable delimitation proposal must have considerable domestic support and should represent the best compromise between opposing domestic views. A proposed revision of the Convention must, also, have strong international support if it is to be adopted. Each nation will determine a preferred delimitation which depends on the configuration of its own continental …

It has been said that "[s]ex education, once the domain of the church and the home, has by necessity, become a responsibility of the schools." Indeed, by the operation of most state education statutes, sex education can be made compulsory in public primary and secondary schools if it is taught as part of otherwise compulsory classes or if the local school authorities have prescribed sex education courses as a compulsory part of the curriculum.
