Reflection On The Law Reforming Process, Sanford J. Fox

This paper is based on three experiences as draftsman or reporter in penal law legislation projects. The first such experience was as sole draftsman for a New Hampshire criminal code, an undertaking commenced in November 1967, which produced a proposed code in April 1969. I am continuing this activity at the present time as assistant to a committee of the New Hampshire legislature that is currently holding hearings on the proposal in preparation for reporting out a criminal code bill this spring. Since work on the New Hampshire code represents the most extensive experience, it is the basis for most …

Use of underground and surface water is controlled so that the supplies are available to the general benefit of all domestic, industrial and agricultural users in a particular area.
Water is a valuable resource and its contamination and wastage must be avoided. This article outlines the provisions of the Rights in Water Act which is designed to protect water supplies from undue exploitation, contamination and wastage.

Introduction: By its nature the air pollution problem presents a suitable framework for an analysis of the concept of interest." Air pollution is a complex social and political problem as well as a complex scientific and technological one. This article will attempt to determine if the concept of interest is a concept through which satisfactory solutions to complex problems maybe derived. Industrial Water Pollution And The Refuse Act: A Second Chance For Water Quality, William H. Rodgers, Jr.

The primary purpose of this Article is to encourage a forceful implementation of the Refuse Act as a second chance to achieve water quality. The presentation commences in Section I with a brief outline of the dimensions of industrial water pollution and the legal and scientific barriers to effective control. Against this background, Section II summarizes the central features of the Refuse Act, presents a narrative history of its recent renovation, and analyzes the major issues arising under the statute.

Faculty Scholarship
Several important questions can be asked about criminal law and the population problem. One is how greatly overpopulation, with its contribution to poverty and urban crowding, is a cause of crime, and, obversely, the extent to which population control would be a form of crime control. Another question is how much population growth increases the range of behavior that is and should be covered by criminal sanctions. Although these and other questions deserve attention, the purpose of this article is more modest – to consider possible changes in criminal law that could help ease the population problem.

This poignant judicial cry out of the past, which I occasionally quote to put down my psychiatrist friends, contains the clue to almost all of the trouble that has attended the development of workmen's compensation law related to mental and nervous injuries. Drugs. Abortion. Race. War. Dissent. Civil disobedience and disruption. Air, water, noise pollution. The standard fare with which we are assaulted by the daily news. American society is swamped in a sea of questions that appear to defy answer. It is the thesis of this paper that the unanswerability of many social questions persists because of the inadequacy of the thought patterns through which they are approached.
