Illegitimacy has been a basis for discriminatory treatment throughout legal history. The common law termed the illegitimate filius nullius, or the child of nobody. This curious legal fiction (and biological impossibility) originally related to inheritance rights, but was later expanded so as to disavow any cognizable legal relationship between the male parent and his bastard child. While the natural mother, if she is a suitable person, has generally been regarded as the proper guardian of her illegitimate child, the unwed father has not enjoyed a position equal to that of the mother. It is not my purpose here to criticize the abortion decisions in detail. Professor Robert M. Byrn has exposed the many specific errors and evasions found in the majority opinions in those cases. As Professor Byrn demonstrates, the Supreme Court's opinions in Wade and Bolton are an intellectual shambles. I will not try to cover the same detailed ground that Professor Byrn did. Rather, after examining the medical evidence which establishes that the unborn child is a human being from the moment of conception, this article will evaluate the propriety of excluding this class of human beings from the protections …

In the 1973 abortion cases, the Supreme Court quoted this language from an 1871 report of the Committee on Criminal Abortion of the American Medical Association. The Court, however, did not follow the advice. Instead, the seven man majority held that the child in the womb is not a "person" within the meaning of the fourteenth amendment, which provides, "No State shall . . . deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. The most useful aquatic areas in the world are in serious danger of destruction. The estuaries, where fresh water, land and sea meet in a dynamic and highly productive zone, are today gravely threatened through unwise and unplanned excessive use of their valuable but finite capacities. Estuaries include the coastal zone which is affected by both the run-off of fresh water from the land and the salt water from the sea. This zone includes tidal rivers, marshes, bays and river mouths. The basic premise of American criminal jurisprudence is that individuals are capable of controlling their behavior.' The threat of incarceration is intended to be a deterrent to antisocial conduct. State and federal penal systems are called "correctional institutions"--implying that a person is incarcerated in order to modify unacceptable behavior. Criminal laws are drafted with goals of discouraging antisocial conduct,punishing and reforming the guilty, and protecting society against dangerous individuals. The first two purposes are served only if a person can respond to negative reinforcement by conducting himself in socially acceptable ways. The rights of children to succeed to a deceased ancestor's property interests in Virginia are treated in some fifteen separate sections of the Virgina Code. When one considers that these fifteen sections were enacted over a period of 189 years, as the result of legislation introduced by various individuals who were at any given time focusing on a particular portion of this larger problem area without always taking into account the "spin-off' effect that their particular legislation might have on all of the other sections dealing with the succession rights of children, it is not surprising to find that there …

This case came here as an appeal, on the representation that Texas courts had sustained the constitutionality of 4.02. c. 4. of the Texas Family Code and Articles 602 and 602a of the Texas Penal Code, over a challenge to those statutes under the Equal Protection Clause of the Fourteenth Amendment.
