Governmental Control Of Research In Positive Eugencis, I. Scott Bass
University of Michigan Journal of Law Reform
This article examines the potential societal problems that would accompany the implementation of eugenics programs and considers possible mechanisms for dealing with these problems. Governmental control of research in positive eugenics is identified as a practical means of preempting the undesirable consequences of scientific advances. Since proposed government research controls would infringe upon academic freedom of inquiry, the constitutional issues raised by this clash are framed and analyzed.

The trial court is an escape valve for the excessive heat generated by conflicts within the society. Its role is to resolve disputes pursuant to procedures calculated to permit a full and fair hearing to the litigants. It is widely known among members of the bar that a lawsuit is not a scientific investigation for the discovery of truth. Rather, it is a mechanism by which society seeks to resolve the disputes which arise between or among its members and/or institutions. The litigants frame the issues and determine the matters to be studied. They marshall their own evidence and present …

The Legal And Social Implications Of Psychopharmacology, Thomas P. Dugan

One out of every four adults in the United States has taken a psychotropic agent in the last year; one out of every two has taken a psychotrope at some time in his life. Since their introduction in the 1950s, the new psychotherapeutic drugs have attained a position of importance in the armamentarium of the physician. Whether the increase in the use of these drugs is the result of "turbulent times," of promotional efforts, or "of sloppy prescribing practices of clinicians is uncertain." Real Property- The Rule Against Perpetuities- Option Contract Held Void Due To Violation Of The Common Law Rule

The Rule against Perpetuities as originally developed in England and crystalized over two centuries is still alive and thriving in the Commonwealth of Virginia as evidenced by the recent supreme court case of United Virginia Bank v. Union Oil. While a number of states have enacted legislation or judicially adopted ways and means to avoid the harsh results often dictated by the common law rule, it appears that Virginia may be defending a rearguard position which may not be functional in terms of today's commercial world.

The recent trend of claims to the ocean and its riches has led far beyond the liberal twelve nautical mile territorial sea limit that the United States is prepared to recognize. In particular, two documents, the Declaration of Santo Domingo, proposing a "patrimonial sea" of 200 miles, and the draft articles on an "exclusive economic zone" of 200 miles submitted by Kenya, are likely to find much favor at the substantive session of the Third Law of the Sea Conference to be held at Caracas in the summer of 1974. Queries 'N Theories: An Instructional Game On The Dot, Dot, Dot... Approach To Scientific Method, Layman E. Allen

QUERIES 'N THEORIES provides a parallel to the strong inference approach to scientific method - designing experiments, observing data, and theorizing. The reiter- ated use of the DOT approach (Design, Observe, Theorize) in the problem-solving required by the game mirrors the regular, systematic application of strong inference in some areas of science (e.g., high energy physics and molecular biology) that have moved ahead much more rapidly than others. Moreover, the game embodies and provides practice in two aspects of scientific theorizing and designing which John Platt has pointed out as central to scientific advance: (1) the usefulness of multiple hypotheses …

Identifying just principles for minimizing and resolving disputes over child custody remains one of the law's knots. King Solomon's renowned gambit for resolving the claims of two women to a newborn child was in fact the easy case: only one of the two contenders had a just claim; only one of the two contenders was prepared to be responsible; and in that first of reported cases, the judge had the advantage of surprise. As Western man approaches the last quarter of the twentieth century, he is developing the power to control the forces of nature. Few areas of human behavior have not been affected by new technologies. In health care, progress has been dramatic in such areas as the determination of prenatal genetic defects through amniocentesis, asexual reproduction through artificial insemination, the use of an artificial placenta, cloning,artifical modification of man-especially through transplantation, ' modification of human behavior through psychosurgery and chemotherapy,' and the mechanical postponement of death. No aspect of health care has escaped the impact of technology.
