Three forms are discussed—bibliographies, U.S. government documents, and current awareness materials. Electroconvulsive therapy (ECT) is a psychiatric procedure that induces a convulsive seizure in the patient in order to treat severe depression. Recently, courts, legislatures, and the medical profession have paid increasing attention to the regulation of ECT. Their interest has been stimulated by the growing recognition of the rights of mental patients, the developing role of consent in medical transactions, and the results of recent scientific research on the efficacy and consequences of ECT.

The Extraterritorial Scope Of Nepa's Environmental Impact Statement Requirement, Michigan Law Review

This Note analyzes the extent to which NEPA's section 102(2) procedural requirements, specifically the impact statement requirement of section 102(2) (C), apply to federal agencies in their activities abroad. After determining that Congress does possess the authority to extend the requirements of NEPA to all federal agency actions, and that legislative intent will thus control the territorial scope of these requirements, consideration will be given to the presumption against the extraterritorial application of congressional enactments. It will be concluded that a "clear statement" of congressional intent is not required in the case of NEPA and that the scope of the …

Washington Law Review

My purpose in this essay is to criticize Mill's principle of liberty as a limit on the legitimate scope of legal coercion. I shall do so not by focusing on previously examined justifications for frustrating individually chosen lifestyles, but rather by examining the arguments in favor of the principle of liberty itself. I shall argue that at least two of its principal bases do not support its conclusion that communally determined elements of lifestyle cannot be legitimately imposed on unwilling individuals except to prevent harm to others. Death is a very individual matter which does not readily lend itself to collective decision. Medical ethicists frequently conclude that to allow a person to die from malice is more reprehensible than to help a person to die from mercy. The most striking change which is taking place in consideration of the problem is recognition of the need to reinforce the patient's right to decide on the course of medical treatment.

San Diego Law Review

The custody determinations involving Lesbian mothers raise constitutional issues which must be examined against our society's strongly anti-homosexual background. Generally, problems the women face result from Western culture's ancient homophobia—a combination of fear, hatred and ignorance—which has produced a heritage of persecution directed at homosexuals. Because anti-homophile attitudes are so deeply rooted and widely accepted, they of course influence legislative and judicial responses to the homophile's demands for equal rights. Therefore, before considering the relevant constitutional issues, this Note will discuss the history and development of Western homophobia.
