King Solomon's Judgment Expressing Principles Of Discretion And Feedback In Legal Rules And Reasoning, Lawrence C. George

The Anglo-American legal system requires rules of law that are expressed directly and concisely. As a result, the full content of some legal principles remains unstated, occasionally giving the directly stated rule the appearance of a paradox in its application. Professor George examines three examples of such apparent paradoxes, terming them "Loops," "Reversals," and "Hitches." He explores their use in providing understandable statements of law, in allowing the use of feedback in judicial decisions, and in providing a cover for the exercise of judicial discretion.

Asbestos Litigation: The Dust Has Yet To Settle , Jean O'Hare

Asbestos litigation presents numerous problems as a result of industry inaction and government inattention to the situation. Through statistics, this article addresses two major impediments to asbestos litigation claims: statute of limitations and multiple defendants. Understanding that those affected by asbestos may not know for many years and that more than one company could be responsible is vital to finding equitable solution to the problems.

Cross-Certification Teacher Tenure Problems In Ohio, Jim Michael Hansen

Cross-certification is the process by which a teacher seeks to satisfy the statutory requirements of tenure by relying on a professional, permanent, or life certificate in a field other than the field in which the teacher is employed. The Ohio Revised Code does not directly address the question of whether a teacher can cross-certify to obtain tenure. The appellate courts of Ohio are evenly divided on the question of whether cross-certification is statutorily permissible: three decisions have concluded that it is permissible, and three have concluded that it is not. The Adoption Trilemma: The Adult Adoptee's Emerging Search For His Ancestral Identity, Marshall A. Levin

In 1974, while presiding over Circuit Court Number 2 of Baltimore City, a court having jurisdiction over domestic relations cases, the author was struck by the searing emotionalism often arising when adoptees' quests to learn about their genealogical heritage were frustrated by Maryland's "sealed record" rule, which denies adoptees access to the records of their adoption proceedings except upon an order of court (which, in effect, means a showing of "good cause"). In this Article, the author critically examines such rules (and similar statutes) in light of the interests of the parties to the adoption process. He recommends that these …

Evaluating Vertical Mergers Under Section 7 Of The Clayton Act, Lawrence P. Postol

Analyzing mergers between firms in a customer-supplier relationship under section 7 of the Clayton Act requires identification of anticompetitive effects pertinent to that relationship. This Article examines the chief analytical tools which the courts have developed in this area, providing needed clarification in a complex field and highlighting areas of continuing uncertainty.

The United States is faced with a nuclear dilemma. On the one hand, nuclear power seems to be the only significant energy source that is presently capable of meeting the country's electrical energy needs. On the other hand, it is uncertain whether the United States has the technological and managerial capability to make nuclear power reliable and safe. In view of this situation, the United States should begin to develop less dangerous alternatives such as solar power. But development of an efficient solar energy system may require 30 years or more. In the meantime, the United States must learn to …

The rapid development of science and technology, particularly in the last generation, has had a tremendous impact on human rights. Many, perhaps most, human rights are adversely affected - in actuality or potentiality - by modern machines.' The subject has been discussed at great length by scientists and statesmen, lawyers and laymen, preachers and futurologists. But, to understand it in its proper perspective, it is believed that a typological approach is called for.
