Dolphin Conservation In The Tuna Industry: The United States' Role In An International Problem, Laurel Lee Hyde

San Diego Law Review

Thousands of dolphin die annually in the international tuna fishery. This Comment explores the history of that problem and the domestic and international attempts to alleviate it. Foreign legislation, positions of international organizations, and documents of the United Nations Law of the Sea Conference are reviewed as potential sources of an international solution. The Comment emphasizes the need for active United States involvement in international programs, comprehensive data on the dolphin populations, and immediate action to avoid excessive exploitation. It concludes with a suggestion that increased public concern for dolphin may be utilized effectively to support conservation initiatives.

Washington Law Review

This comment suggests that professional schools constitutionally need not and, as a matter of policy, should not be deterred from considering at least some noncognitive criteria in admissions decisions. An exhaustive constitutional analysis of the standard of inquiry appropriate for each noncognitive criterion is not attempted. Instead, the comment shows in Part I that, regardless of the standard of scrutiny applied, any constitutional adjudication will involve some inquiry into the relationship between the school's articulated admissions goals and the admissions criteria used to implement them. This Article examines the sea otter, it's history, and its present status with regard to federal safeguards now protecting otters and California 's attempts to prevent economic burdens caused by these federal safeguards. The Article begins by discussing the sea otter in general and man's exploitation of the sea otters for their fur. Sea otters came close to being exterminated by man, but are now heavily protected by federal laws including the Marine Mammal Protection Act, which endeavors to maintain all species of marine mammals at their optimum sustainable population, and the Endangered Species Act. This comment will analyze the relative success of the various approaches taken to implement Indian treaty rights in the international fishery. It will discuss the domestic litigation resulting from these approaches and will identify the key legal issues involved. Finally, it will suggest possible means of resolving the dilemma in which the United States currently finds itself. By providing an appreciation of both the scientific complexities of managing this valuable resource and the limitations on unilateral judicial efforts in the United States, it will become apparent that the solution to this sensitive problem rests not in unilateral, but in cooperative …
