American schools have served as battlegrounds for competing social policies for generations. Major national disputes have centered on racial problems, busing, and federal funding. Local debate continues over curricula, teacher competence, pedagogical methods, textbooks and library books, discipline, and such trivial matters as hairstyle. Nationally, the current debates about school prayer and tax credits for the payment of private school tuition have consumed the time and resources of numerous individuals. These disputes show no sign of abating. Teachers are the most significant participants in the educational process. Their work involves those activities--speaking, writing, and questioning--that constitute the core values protected …

After years of debate, perpetuity reform is still controversial. To be sure, there is agreement among virtually all of the commentators and experts in the field that the Rule Against Perpetuities is in need of reform. The disagreement, on the surface, centers on the methods of reform to be employed. At least three basic methods have been advanced: (1) specific statutory repair of discrete problem areas; (2) reformation; and (3) wait-and-see. Each method has its sponsors, and each has in one form or another been adopted as part of the law of a few states. These methods are not mutually …

Federal Water Pollution Laws: A Critical Lack Of Enforcement By The Environmental Protection Agency, Edward E. Yates

This Comment critiques the EPA's use of its discretionary power in enforcing water pollution problems under the Clean Water Act, arguing that the EPA's use of its discretionary power to stay enforcement of environmental standards has resulted in the continued existence of many environmental problems. The author traces the federal role in water pollution enforcement and the development of the use of federal discretionary powers. The author further examines the viability of citizen suits and other alternatives to EPA enforcement. The author presents a proposal to strengthen the enforcement of the Clean Water Act by limiting discretionary enforcement.

In Re Lattouf's Will And The Presumption Of Lifetime Fertility In Perpetuity Law, Lawrence W. Waggoner
San Diego Law Review
This Article provides a brief discussion on the presumption of lifetime fertility and the decision in In Re Lattouf's Will, which allowed the presumption of lifetime fertility to be rebutted. The author argues that the adoption of children is an ever present complication of class gifts and the Rule Against Perpetuities and that any effort to find the presumption of lifetime fertility to be rebuttable is illusory. Analyzing the decision in In re Lattouf's Will, the author concludes that the gift could have been sustained even in the face of an irrebuttable presumption.

Water-Quality Standards, Maximum Loads, And The Clean Water Act: The Need For Judicial Enforcement, Lawrence S. Bazel

The Clean Water Act of 1972 regulates the cleanliness of the nation's waters by requiring federal and state pollution-control agencies to set water-quality standards and establish maximum loads. Confusion surrounds the requirement for maximum loads and federal courts have declined to enforce it. This Comment first examines the history of the Clean Water Act of 1972, then discusses four cases in which courts have refused to enforce maximum load requirements. The Comment analyzes the procedural and substantive requirements of judicial enforcement of maximum loads, as well as the nature of the pollution involved. This Article attempts to compile the latest information available concerning this difficult problem. Part I reviews the scientific literature, explaining the biological basis of increased risk of occupational disease. Part II explores the efforts of various employers to incorporate this research into their personnel practices. Part III surveys the legal response to these practices. Employees may challenge medical screening on a variety of theories, most of which were not designed to deal with the problem of susceptibility to occupational disease. Not surprisingly, none of the approaches offers an entirely satisfactory response to the problem. This Article offers no clear answers. …

The signing of the United Nations Conference on the Law of the Sea (UNCLOS) Treaty was the maturation of an idea that was born thirty-six years ago. That treaty placed into effect the 200 mile exclusive economic zone (EEZ). A universal 200 mile EEZ could be a death knell for the high-seas fishing fleets we know today as the majority of the major fishing grounds lie within 200 miles of the coast. The Soviet Union presently has the largest fishing fleet in the world and will perhaps feel the largest impact from the treaty signing. This paper intends to evaluate …
