The Right To Die In Illinois: A Comprehensive Scheme, David B. Collins

This Comment looks at the difficult issues surrounding living wills, and how courts or legislatures will treat cases where no living will exists. The Comment focuses on a series of New Jersey cases, and concludes with a suggested comprehensive statute which would cover loopholes left open by the current Illinois statutory scheme. The Comment is followed by two appendices which set out the text of the original Illinois Living Will Act and the 1988 changes to the Illinois Living Will Act.

It is now almost six years since the adoption of the LOS Convention and over ten years since the general acceptance of unilaterally extended fisheries jurisdiction, but we are still only in the early phases of working out the implications of these events for wealth and other value distributions. Establishing national fisheries regimes is a difficult and time-consuming task, even for the leading developed nations.

The Unique, Novel, And Unsound Adversary Ethic, Thomas L. Shaffer

The dominant ethic in the American legal profession in 1988 is the adversary ethic. The adversary ethic, in the words of the late Justice Abe Fortas, claims that "[l]awyers are agents, not principals; and they should neither criticize nor tolerate criticism based upon the character of the client whom they represent or the cause that they prosecute or defend. They cannot and should not accept responsibility for the client's practices." This ethic is the principal-and often the only-reference point in professional discussions. Although it is embedded in our professional codes, our cases, and our law offices, this Article argues that …
