Transboundary Groundwaters: The Bellagio Draft Treaty, Robert D. Hayton, Albert E. Utton

Publications

Increasing populations and industrial and agricultural development worldwide are placing much greater demands on groundwater supplies. Many of these groundwater basins or aquifers underlie two or more countries and are, thus, international or transboundary. Withdrawals from one country can drain life-giving water from a neighboring country and, as a consequence, be the source of severe and protracted conflict. Unfortunately, international law and treaty practice are only at a beginning stage. With the goal of advancing international law and institutions on the matter, a multi-disciplinary group of specialists over an eight-year period have developed a draft international groundwater treaty.

Information Economics And Chemical Toxicity: Designing Laws To Produce And Use Data, Mary L. Lyndon

Michigan Law Review

Just as laws may create entitlements to the use of information, they may also be written to distribute information and to encourage information production. This Article discusses the ways in which law affects the generation and distribution of information related to chemical exposure and toxicity. It describes the economic impact of recently enacted right-to-know laws and proposes that better and more abundant data could be produced if the law paid greater attention to basic economic principles that influence research and information systems.

Lately when I talk about gender, I am often confronted with the message that women's equality has already been achieved. Solutions In The Convention On The Law Of The Sea To The Problem Of Overfishing In The Central Bering Sea: Analysis Of The Convention, Highlighting The Provisions Concerning Fisheries And Enclosed And Semi-Enclosed Seas, Lourene Miovski

San Diego Law Review

In this Article, Ms. Miovski analyzes the justification, under the Convention on the Law of the Sea, for various types of fishery management control over the Central Bering Sea and the interrelationship of the freedoms, rights, duties, and interests recognized in the Convention. A number of theories are advanced to support various types of control under the Convention. After evaluating the various theories, the author considers the dispute resolution mechanisms available under the Convention as well as methods of enforcement. Finally, states' freedoms, rights, duties, and interests, recognized under the various CLOS articles and theories, are summarized. In conclusion, the …
