This article examines the use of epidemiology to evaluate Risks posed by toxic substances. Using illustrations drawn from an elaborate example, it argues that scientists applying usual conventions in doing statistical studies tend to ignore important normative issues.

New Fda Drug Approval Policies And Hiv Vaccine Development, Wendy K. Mariner

Conducted a study of Food and Drug Administration (FDA) law and policy including interviews with FDA officials in the Center of Biologics Evaluation and Research and the Office of the General Counsel. Suggests that the new FDA drug review policies do not fit vaccines. Instead, the nature of vaccines, and HIV vaccines in particular, argues for adherence to a more rigorous form of review. (JLN)

[W]hether law should intervene to prevent or to compensate for harms documented by scientific evidence is clearly a value-laden question of law and policy. What we decide to call pollutants . . . may be partly determined by what harms we think are important, which harms we think we can control, and which harms we wish to do something about. . . . Webster And The Future Of Substantive Due Process, James Bopp Jr., Richard E. Coleson

In Webster v. Reproductive Health Services, the United States Supreme Court indicated that Roe v. Wade (the case that found a federal constitutional right to abortion) is without majority support on the Court. Roe is de facto overruled. However, the rejection of Roe does not mean a rejection of substantive due process analysis or the right of privacy, which have been approved by all members of the current Court. But substantive due process analysis has been significantly refined. The analysis has been made more objective in two ways. First, the Court now relies primarily on the test for fundamentality …

Indeterminacy And Incommensurability In Constitutional Law, Steven L. Winter

Progressive constitutional scholarship has yet fully to confront the implications of the conservative shift in constitutional law. Liberal critics continue to seek governing constitutional theories with which to constrain decisionmaking by judges of a notably different mind. Other, more radical scholars employ the indeterminacy and "law is politics" critiques in a more open attempt at displacement. Neither approach is viable, however. Each presumes the primacy of the autonomous, self-directing subject; each resists recognition of the situated nature of all human endeavor. Dumping of wastes into the ocean has gone on for years especially in the New York Bight. The National Oceanic and Atmospheric Administration (NOAA) is mandated by Title II of the Ocean Dumping Act of 1972 to investigate the effects of ocean dumping on the marine environment. However, there is a perception within Congress, the public and other agencies that NOAA is not meeting it's responsibilities with regard to ocean dumping research. The effectiveness of NOAA's ocean dumping policies and programs and the difficulties in implementation experienced by the agency are evaluated by applying George Edwards' theory of policy implementation. …

This study examines the present status of the maritime boundaries of India in the context of applicable international laws related to boundary definition. As a developing nation with a long coastline and large Exclusive Economic Zone, it is important for India to define its boundary limits for better utilization and management of its marine resources.
