Faculty Journal Articles and Book Chapters

In honor of the Syracuse Law Review's 50th Anniversary, this article considers various developments in health law and concludes that the passage of the Medicare amendments to the Social Security Act has had the most significant impact on the field. The article discusses the impact of Medicare on the culture of hospitals and their medical staffs, on the development and dissemination of new technologies, and on restructuring and reforming the industry in key areas, including fraud and abuse, patient dumping, organ donation, advance directives, patients' rights, and other agencies' regulation of health care providers.

Throwing Caution To The Wind: The Global Bear Parts Trade, Adam M. Roberts, Nancy V. Perry Jan 2000

Throwing Caution To The Wind: The Global Bear Parts Trade, Adam M. Roberts, Nancy V. Perry

Animal Law Review

The exploitation of bears occurs in a myriad of forms. Bear baiting, abuse of bears in entertainment, habitat destruction, and the legal and illegal trade of bear parts all contribute to the decline of the bear. The market demand for bear gallbladders and bile is on the rise and is negatively impacting bear populations worldwide. Mounting evidence points to a systematic pattern of killing bears in the United States and Canada in order to satisfy the demand for bear parts in consuming nations, primarily Asian markets. The bear parts trade is international in scope and difficult to regulate and contain. …

A House On Fire: Linking The Biological And Linguistic Diversity Crises, Kieran Suckling Jan 2000

A House On Fire: Linking The Biological And Linguistic Diversity Crises, Kieran Suckling

Animal Law Review

Although it is a truism among conservation biologists that humanity is in the midst of the Earth's sixth great extinction spasm, overt public awareness of the crisis is dim, and understanding of its implications even dimmer. The house is burning down around us, and even as the beams begin to cave in, we have but the vaguest intuition of the enormity of the danger. How is it possible to ignore the biosphere careening toward an extinction catastrophe unparalleled not only in the brief span of human history, but in the last sixty-five million years of life on Earth? The question …

The Changing American Family: A Reevaluation Of The Rights Of Foster Parents When Biological Parental Rights Have Been Terminated, Cassandra S. Haury Jan 2000

The Changing American Family: A Reevaluation Of The Rights Of Foster Parents When Biological Parental Rights Have Been Terminated, Cassandra S. Haury

Georgia Law Review

During the past twenty years, the American ideal of the traditional nuclear family made up of heterosexual parents and their children has been increasingly replaced by a number of new and unconventional family systems. Although many of these novel family systems have received recognition by the courts, foster families have been consistently denied legal rights to the children that they raise. Due to the reality of changing dynamics in family systems in the United States, and the failure of the present foster care system, the judicial system needs to reevaluate its denial of foster parents' due process rights. This Note …

Social Risk And The Transformation Of Public Health Law: Lessons From The Plague Years, Elizabeth B. Cooper Jan 2000

Social Risk And The Transformation Of Public Health Law: Lessons From The Plague Years, Elizabeth B. Cooper

Faculty Scholarship

Acquired Immune Deficiency Syndrome (AIDS) was the wake-up call that disturbed America from its mid-twentieth century slumber concerning the dangers of communicable diseases. Until AIDS was identified in 1981, most Americans felt largely impervious to health threats posed by viruses or bacteria. Polio, smallpox, and tuberculosis had been brought under control by the "magic bullets" of antibiotics and vaccines." We felt more susceptible to the ravages of cancer or the debilitation of heart disease. But, over the last twenty years, the (re)emergence of serious or life-threatening microbial- based conditions such as Ebola, hantavirus, Lyme disease, West Nile virus, and even …

A Critical Evaluation Of The Development And Implementation Of Forest Preservation Services, Ryan K. Mckain Jan 2000

A Critical Evaluation Of The Development And Implementation Of Forest Preservation Services, Ryan K. Mckain

Connecticut Journal of International Law

For many years, nations have struggled with loss of the Earth's natural resources. Once thought inexhaustible, animal life, plant life and minerals were exploited as fast as possible. Often viewed as a "race-to- ,,2 the-bottom, nations compete with each other to extract as much of a valuable resource as possible from the planet before the resource vanishes. The prevailing view has not been "use it or lose it" but rather "use it until it's lost." Now our vast resources are being visibly depleted - we can see the bottom of what was historically thought to be a bottomless pit. Recently, …

Towards A Functional International Criminal Court: An Argument In Favor Of A Strong Privileges And Immunities Agreement, Lindsay Zelniker

Fordham International Law Journal

Part I of this Note discusses the legal doctrines governing privileges and immunities of U.N. officials and diplomats in international law. Part I also describes the manner in which diplomatic and U.N. privileges and immunities are applied to the ICC. Part II outlines the conflict between the goals of advancing human rights and preserving political sovereignty in international law. Part III argues that the adoption of the Rome Statute compels an international responsibility to achieve the goal of an effective and independent Court. This Note concludes that providing increased privileges and immunities to ICC personnel at the expense of some …

This Essay will also identify those areas where Article XX, in its present form, it likely to be a source of justified public concern.

Trade In Technology Within The Free Trade Zone: The Impact Of The Wto Agreement, Nafta, And Tax Treaties On The Nafta Signatories, Catherine Brown, Christine Manolakas Jan 2000

Trade In Technology Within The Free Trade Zone: The Impact Of The Wto Agreement, Nafta, And Tax Treaties On The Nafta Signatories, Catherine Brown, Christine Manolakas

Northwestern Journal of International Law & Business

Trade in technology and related services has assumed a major role both on the world trade agenda and within the NAFTA block. The success of such cross-border trade is dependent upon three factors: protection of intellectual property,' access to foreign markets by service providers, and a minimized risk of double taxation. Each of these factors is impacted by national laws, multinational conventions, and bilateral tax treaties. The last decade has witnessed an explosion of such legislation and agreements. This article focuses on Canada, Mexico and the United States, and explores the World Trade Organization Agreement ("WTO Agreement"), the North American …
