Access To Home Health Services Under Medicare's Interim Payment System, Nora Super

This issue brief explores the impact of the interim payment system (IPS) for home health agencies established under the Balanced Budget Act of 1997 (BBA). IPS was intended to constrain program outlays by imposing limits on spending per beneficiary and spending per visit in the existing cost-based reimbursement system. This issue brief examines the impact of the IPS on access to home health care, including home health agencies' responses to the payment system and its impact on provider availability and, ultimately, access to care for the sickest or most expensive populations

Margins As Measures: Gauging Hospitals' Financial Health, Karen Matherlee

Recognizing the considerable controversy over ways to measure hospitals' financial viability, this issue brief reviews various ways to assess their fiscal strength. The paper looks first at operating margins, traditional measures that some experts say are inadequate when considered alone. It then explores several recommendations: (a) net income, liquidity and cash flow, and debt burden, suggested by the National Advisory Panel; (b) factors that determine year-to-year changes in hospitals costs, such as hospital input price inflation, changes in care patterns, and the complexity of patients treated, put forth by the Medicare Payment Advisory Commission; and (c) 35 financial indicators and …

The Coming Millennium: Enduring Issues Confronting Catholic Health Care, Lawrence E. Singer, Elizabeth Johnson Lantz
Annals of Health Law and Life Sciences
Professor Singer and Ms. Johnson Lantz provide a cogent overview of Catholic health care in the United States and address the key issues affecting Catholic health care in the coming years. In particular, (1) clarity in canonical and ethical interpretation; (2) industry consolidation; and (3) "next generation" sponsorship and the impact of these issues are discussed in detaiL The authors conclude that successful Catholic health care organizations must maintain strong mission and business fundamentals in an increasingly competitive reimbursement and regulatory environment.

Part I reviews the historical development of physician assisted suicide, describes current medical practices and physicians' attitudes, and outlines the related legal debate over euthanasia. Part II explains the statutory and case law precedent of physician-assisted suicide. This Part also examines the factual and procedural history of the Supreme Court's decisions in Glucksberg and Vacco. Part III explores the Ninth Amendment issues which the Court failed to address in Glucksberg and Vacco, and argues that a right to die exists under existing Ninth Amendment precedent. This part also provides recommendations for a model Dignity in Dying statute that would comply …

In neutrality theory the recipients of vouchers, grants, and purchase-of-service contracts are eligible to participate as providers in government social service programs without regard to their religious character. Indeed, religious beliefs and practices are prohibited bases for screening out those who want to be welfare program providers. Notable examples of congressional social service legislation conforming to the rule of religious neutrality are the ‘charitable choice‘ feature imbedded in the Welfare Reform Act of 1996 and the Community Services Block Grant Act of 1998, as well as the provision allowing issuance of child care vouchers to indigent parents in the Child …

The Maladaptation Of Miranda To Advance Directives: A Critique Of The Implementation Of The Patient Self-Determination Act, Thaddeus Mason Pope

In this Article, Thaddeus Pope argues that the Patient Self Determination Act (PSDA) is a failure on its own terms. The Article first identifiesthe central purpose of the Act as the protection of patient autonomy. The Article then reviews much of the empirical research on the implementation of the Act. This research suggests that the medical preferences expressed in advance directives completed pursuant to the PSDA are usually not based on real understanding because patients are merely "Mirandized" of their right to direct their post-autonomous medical care. A Walk Through The Woods Of The Property Course With Dukeminier And Krier's Casebook On Property, Charles I. Nelson

This casebook is organized along three main themes even though it has five major parts. The first two parts seem to me to focus on relative rights in property. The third part discusses transfer of property interests and assurances of title and the fourth discusses regulation of land use by private and public means. The majority of this essay will look at those themes and how they play out in the casebook and in my course. In the latter part of the essay, I will discuss some of the things I find most engaging about the book and why I …
