How Would You Like Your Television: With Or Without Borders And With Or Without Culture--A New Approach To Media Regulation In The European Union, Kevin M. Mcdonald

Fordham International Law Journal

This Essay analyzes the effectiveness of television broadcasting regulations as a means to effectuate the promotion and protection of a pan-European culture, namely, television broadcasting regulations. First, in Part I, this Essay considers the broader background developments in the audio-visual sector that led to the passing of the Directive. Part II looks at the advantages and disadvantages of the most controversial aspect of the Directive, namely, the quota provisions. Part III critiques the Directive's effectiveness in realizing its dual goals of both protecting and promoting a pan-European culture. Ensuring Effective Communication: The Duty Of Health Care Providers To Supply Sign Language Interpreters For Deaf Patients, Elizabeth Ellen Chilton

UC Law Journal

When a profoundly deaf patient arrives for treatment at a hospital or doctor's office, how should communication barriers be overcome? Are sign language interpreters always required? Who is responsible for coordinating and paying for interpreting services? Many health care providers are uncertain about the answers to these questions and are unaware of their legal duty to establish effective communication with their deaf patients. Consequently, patients encounter considerable difficulty in getting sign language interpretation in medical settings. Many health care providers lack comprehensive policies for the provision of sign language interpreters. In addition, doctors practicing in their own offices are reluctant …

The Probative Weight Of The "Mainstreaming" Requirement Under The Eha, Linda S. Abrahamson

Northern Illinois University Law Review

This comment examines the case law which has developed around the "mainstreaming" provision of the EHA. It focuses on the fact that placement decisions made by school districts are nearly always upheld, regardless of the desires of parents or handicapped students. The author contends that this inequity does not properly respect the role of parents under the EHA, as advocates for their handicapped children. The author concludes by developing a factor test to determine the appropriate placement for a handicapped student when the degree of mainstreaming is the only issue before a reviewing court.

This article examines the legal and policy perspectives of U.S. trade initiatives toward the ROC in the last decade and their impact on economic liberalization in Taiwan. Part I sets forth the basic legal, policy and structural framework of this bilateral trade relationship. Part II is a sectoral retrospect of the major bilateral trade issues dealt with in the last decade.
