Countering Noise-Based Splicing Detection Using Noise Density Transfer, Thibault Julliand, Vincent Nozick, Hugues Talbot
Countering Noise-Based Splicing Detection Using Noise Density Transfer, Thibault Julliand, Vincent Nozick, Hugues Talbot
Journal of Digital Forensics, Security and Law
Image splicing is a common and widespread type of manipulation, which is defined as pasting a portion of an image onto a second image. Several forensic methods have been developed to detect splicing, using various image properties. Some of these methods exploit the noise statistics of the image to try and find discrepancies. In this paper, we propose a new counter-forensic approach to eliminate the noise differences that can appear in a spliced image. This approach can also be used when creating computer graphics images, in order to endow them with a realistic noise. This is performed by changing the …

Law Reviews And The Migration To Cyberspace, M. Ethan Katsh
Akron Law Review
I am very pleased to contribute an introduction to this issue of the Akron Law Review, the first to appear both in print and on the World Wide Web. There are very few law reviews that have surfaced, thus far, on the World Wide Web. The editors who decided to take this step deserve our respect and admiration. Their decision reflects an understanding that the world of publishing and distributing information has begun to change, and begun to change in a significant way.

Does Learning About Climate Change Adaptation Change Support For Mitigation?, Michael P. Vandenbergh, Heather Barnes Truelove, Amanda R. Carrico, David Dana
Vanderbilt Law School Faculty Publications
Many have speculated that increased attention to climate change adaptation will reduce support for mitigation. The Risk Compensation Hypothesis suggests that remedies to reduce the impacts of risky behaviors can unintentionally increase those behaviors. The Risk Salience Hypothesis suggests that information about adaptation may increase the salience of impacts, and therefore increase mitigation support. Experiment 1 presented participants with a news article about an irrigation technology described as a way to improve efficiency (Pure Control), reduce emissions (Mitigation Control), or reduce drought vulnerability (Adaptation). Political moderates in the adaptation condition rated climate change as a higher political priority and were …
Should Australian Courts Give More Witnesses The Right To Skype?, Marilyn Krawitz, Justine Howard
Should Australian Courts Give More Witnesses The Right To Skype?, Marilyn Krawitz, Justine Howard
Law Papers and Journal Articles
Millions of people use Skype, a common form of social media that permits
people to talk to each other over the internet. Courts in Australia have
permitted witnesses in at least a few instances to testify by Skype to date. This
article examines whether Australian courts should permit witnesses to testify
by Skype more often. The article considers using videoconferencing, as
opposed to Skype, and security issues associated with Skype. It also
considers the impact that Skype may have upon considering witness credibility.
Ultimately, it argues that Australian judicial officers may want to consider
permitting witnesses to testify by Skype …
Who Owns Villa La Pietra? The Story Of A Family, Their Home, And An American University Under Italian Law, Felicia Caponigri
Who Owns Villa La Pietra? The Story Of A Family, Their Home, And An American University Under Italian Law, Felicia Caponigri
Notre Dame Journal of International & Comparative Law
In 1994 Harold Acton, son of Arthur Acton, an English art dealer in Florence, and Hortense Mitchell Acton, an American banking heiress, donated his family home, Villa La Pietra, to New York University. Today, this Tuscan villa is at the center of a declaration of paternity lawsuit and a claim of inheritance brought by Liana Beacci, Arthur Acton's daughter by his Italian secretary. In this Note, Felicia Caponigri presents the facts of the case, focusing on the provenance of the Villa, and the procedural posture of the case. Caponigri applies Italian law to argue that New York University might claim …

Internet commerce has transformed the marketing of goods and services. The separation between point of sale and seller, and the presence of geographically dispersed sellers who do not engage in repeated transactions with the same customers challenge traditional mechanisms for building the trust required for commercial exchanges. In this changing environment, legal rules and institutions play a diminished role in building trust. Instead, new systems and methods are emerging to foster trust in one-shot commercial transactions in cyberspace.
The Article focuses on the rise of “social commerce,” a socio-economic phenomenon centered on the use of social media and other modes …
Leaping Language And Cultural Barriers With Visual Legal Rhetoric, Michael D. Murray
Leaping Language And Cultural Barriers With Visual Legal Rhetoric, Michael D. Murray
Law Faculty Scholarly Articles
This Article discusses the scholarship of popular culture, cognitive studies and brain science, data visualization studies, modern argument theory in rhetoric, the rapid development of technology in the production of documents, and technology in the reading and reception of documents, which all point to one outcome: the tools of legal education and law practice must become more visual by following principles of visual legal rhetoric and visual narrativity. Visual has become the "new normal" in communication, and legal rhetorical communication in law school and law practice must not let itself fall behind the times.

Taking Images Seriously, Elizabeth G. Porter
Taking Images Seriously, Elizabeth G. Porter

Law has been trapped in a stylistic straitjacket. The Internet has revolutionized media and communications, replacing text with a dizzying array of multimedia graphics and images. Facebook hosts 150 billion photos. Courts spend millions on trial technology. But those innovations have barely trickled into the black-and-white world of written law. Legal treatises continue to evoke Blackstone and Kent; most legal casebooks are facsimiles of Langdell’s; and legal journals resemble the Harvard Law Review circa 1887. None of these influential forms of disseminating the law has embraced — or even nodded to — modern, image-saturated communication norms. Litigants, scholars and courts …

The Visual And The Law Of Cities, Stephen R. Miller
Pace Law Review
This article will attempt to explore, through four separate “tableaux,” or brief sketches, four ways in which the visual interplays with the law of cities, and how a deeper understanding of this intersection can assist in the development of these laws and their underlying policies. This discussion will by no means be definitive. However, by presenting these four approaches in which the visual complicates and assists the law of cities, and sometimes even acts as the law of cities, it is hoped the article will spur a dialogue on the law’s relationship to the visual.

Commercial contract users read their contract documents infrequently, and understand them inadequately. The disincentives may be several: contract language may be too technical and too long; contracts may be organized around ensuring or avoiding legal liability rather than providing guidance toward performing contractual responsibilities; or contracts may rarely include frameworks that would prompt the parties to explore new opportunities. For whatever reason, the neglect by users of contractual documents can lead not only to unpleasant surprises in the performance or enforcement of particular contractual duties, but also to chronic underuse of contracts as potential instruments for planning, innovation, commercial relationship-building …

Lawyers, judges, and jurors face a vast array of visual evidence and visual argument inside the contemporary courtroom. From videos documenting crimes and accidents to computer displays of their digital simulation, increasingly, the search for fact-based justice is becoming an offshoot of visual meaning making. But when law migrates to the screen it lives there as other images do, motivating belief and judgment on the basis of visual delight and unconscious fantasies and desires as well as actualities. Law as image also shares broader cultural anxieties concerning not only the truth of the image, but also the mimetic capacity itself, …

Conventional wisdom states that labor unions and people of color are adversaries. Commentators, academics, politicians, and employers across a broad range of ideologies view the two groups’ interests as fundamentally opposed and their relationship as rightfully fraught with tension. Like much conventional wisdom, the narrative that unions and people of color are rivals is flawed. In reality, labor unions and civil rights groups work together to advance a wide array of mutual interests; this work ranges from lobbying all levels of government to protesting working conditions across the country. Moreover, unions improve the lives of both members and non-members of …

Implementing Building Information Modeling In Public Works Projects In Ireland, Barry Mcauley, Alan V. Hore, Roger West
Implementing Building Information Modeling In Public Works Projects In Ireland, Barry Mcauley, Alan V. Hore, Roger West
Conference papers
The Irish State in recent years has suffered huge financial losses in the public works sector, which has now pushed the Irish Government to explore new ways of controlling cost. This background lead to the introduction of the Capital Works Management Framework in 2007 which aimed to support the certainty of outcome in terms of cost and quality, as well as improved risk management, through the implementation of fixed price contracts. In order to successfully compete within this framework it is recommended by the authors, that Irish Government moves towards the legal mandating of BIM. This can ensure a greater …

The Limitations Of Regulatory Oversight On Online Video, Jennifer Simpson
Canadian Journal of Law and Technology
Discussion in this paper focuses on the factors, attributes, and elements of telecom and broadcast regulation in Canada. Part I of this study briefly outlines the history of online video regulation in Canada to date. In Part II speculation as to how online video might be regulated, based on prior decisions of the CRTC, is presented. Part III considers the challenges of applying the Broadcasting Act to new media entities in order to create a regulatory framework for online video. Part IV looks at judicial decisions related to broadcast law that may be used to define the nature of the …

Municipal Elder Law: A Minnesota Perspective, A. Kimberley Dayton, Israel (Issi) Doron

The field of elder law has developed dramatically over the past several decades and is primarily regarded as a creature of state and federal law. This area of law will be of paramount importance in the coming years as the elderly population continues to increase dramatically. Indeed, nearly every community in the United States will undoubtedly be impacted in some way by the influx of older residents. Notably, however, the effect of an aging society will impact each local community differently. For these reasons, Professors Kimberly Dayton and Israel (Issi) Doron sought to examine the role that municipal elder law …
