Debate: The Right To Treatment - Encounter And Synthesis - A Summary Of Dr. Birnbaum's Initial Remarks [Comment]
Duquesne Law Review
Dr. Birnbaum first noted that the judicial history on the right to adequate care and treatment in public mental hospitals is brief and limited to mere recognition. In 1966 the United States Court of Appeals of the District of Columbia held that a criminally-committed person had the right to adequate treatment, based on a mental health statute. In 1968 the foundation for the right to treatment seemed to be expanded to the constitutional due process level. Finally in 1971, a further expansion occured when a federal district court in Alabama clearly said that a civilly-committed patient had a constitutional right …

Dissertations and Theses
When a family starts to dissolve it frequently comes to the attention of the court or the welfare department and what happens once its members enter the system can be of critical importance. While the number of adults incarcerated is expected to increase slightly, the alarming fact is that if we continue to confine juveniles at the same rate an increase of 70% between 1965 and 1975 can be expected. These data suggest that we should investigate alternatives to detention, not only because of the increasing pressures of space available but, more importantly, because juvenile detention has shown itself to …

The Shutoff Of Utility Services For Nonpayment: A Plight Of The Poor, David M. Shelton
The Shutoff Of Utility Services For Nonpayment: A Plight Of The Poor, David M. Shelton
Washington Law Review
The shutoff of essential utility services for nonpayment causes immeasurable hardship to many poor individuals. This comment examines the existing situation and suggests possible reforms aimed at immediate alleviation of the hardships. The role of the courts and regulatory agencies is examined but the primary focus is on the minimum alteration of existing policies necessary to provide immediate and substantial relief. An insight into the existing shutoff policies of utilities is provided by an appendix summarizing a survey of utility policies through the United States.
Forcing Protection On Children And Their Parents: The Impact Of Wyman V. James, Robert A. Burt
Forcing Protection On Children And Their Parents: The Impact Of Wyman V. James, Robert A. Burt
Michigan Law Review
This Article will focus on one of the concerns implicated in Wyman: the government's power to force assistance for the protection of children, when they or their parents are unwilling to accept that assistance. The state's protective purposes in insisting that Mrs. James accept its assistance or suffer serious loss of benefits played an important role in the Wyman decision. Only a few years ago, in In re Gault, the Court refused to defer to a state's similarly beneficent motives when it was asked to withhold the imposition of procedural safeguards in juvenile delinquency proceedings. Wyman does not …

The Battered Child: Logic In Search Of Law, Paul Mullin Ganley
San Diego Law Review
Willful child abuse resulting in what has been termed the battered child has received an increasing amount of attention in recent years. While the problem is not unique to modern times, its solution continues to challenge the minds of men in almost all the professions of functioning society in the United States - including medicine, law, the social sciences, education, and government. The purpose of this article is to try to achieve some perspective on the problem by analyzing significant aspects and to clarify the legal issues so as to bring them closer to resolution. Part of the problem involves …

Neglect Proceedings And The Conflict Between Law And Social Work, Patrick R. Tamilia
Duquesne Law Review
The 20th century might well be considered the age when children acquired the right to exist. To some, the rights and privileges of children have developed so rapidly that they would categorize our culture to be child-centered and our future to be youth-directed. For the undeniable betterment of mankind, within the past 50 years, we have come to be aware of the inner life and intrinsic worth of the child as an independent being. Much of what we consider to be permissive, uncontrolled child behavior is a result of the recent recognition of the individual worth of the child. Perhaps …
Character Evidence And The Juvenile Record, Terrence N. O'Donnell
Character Evidence And The Juvenile Record, Terrence N. O'Donnell
Cleveland State Law Review
When a youngster makes a mistake and is arrested for committing a crime, should that act, committed while he is still a juvenile, appear and reappear, to haunt the offender for the rest of his life? There are some people in this country who say that we are not tough enough with our young people. But even they would not want the life of a young person marred forever by a mistake which he made as a juvenile.
