Constitutional Law-Equal Protection-Relatives' Responsibility Statutes Do Not Create A "Suspect" Classification Based On Wealth
Fordham Urban Law Journal
This note discusses Swoap v. Superior Court - a case brought by two recipients of aid to the aged and their adult children who challenged the constitutionality of two state statutes. One imposed a general duty of support on the children of parents unable to support themselves. The other gave county officials a cause of action against the children to compel contribution to the public assistance given by the state to the needy parents. The plaintiffs argued this was discrimination based on wealth class. The court concluded that it wasn't discrimination based on wealth but on percentage but why discrimination …

Solomon's Sword: Adjudication Of Child Custody Questions, Robert E. Shepherd Jr.
Solomon's Sword: Adjudication Of Child Custody Questions, Robert E. Shepherd Jr.
University of Richmond Law Review
It is significant that this story from the reign of King Solomon in the tenth century B.C. uses as its setting a battle over child custody to illustrate the legendary "wisdom of Solomon."' It is equally meaningful that after the passage of some three thousand years of civilization and supposed social progress, a twentieth century Amer- ican judge could remark that "a judge agonizes more about reaching the right result in a contested custody issue than about any other type decision he renders." And this agony intrudes into an ever-increasing number of cases.

The Status Of Women In Israel - Myth And Reality, Pnina Lahav
The Status Of Women In Israel - Myth And Reality, Pnina Lahav
Faculty Scholarship
The issue of women's rights has been subjected to reexamination and redefinition in recent years. The legal structure relevant to this issue, so clearly intertwined with traditional values and historical prejudices, is increasingly studied in an attempt to find ways to achieve equality of the sexes in our lifetime. In this context, cross-cultural study of diverse societies and legal systems can make a vital contribution. A step forward in this direction was taken in the fall 1972 issue of this journal, in a symposium on the status of women. Among others, the Israeli legal system was discussed by Plea Albeck, …
Police Discretion With Respect To The Juvenile Offender, Department Of Public Safety, Multnomah County, Oregon, Muriel Bridges, Monty Merritt
Police Discretion With Respect To The Juvenile Offender, Department Of Public Safety, Multnomah County, Oregon, Muriel Bridges, Monty Merritt
Dissertations and Theses
This is an exploratory study which focuses on the types of information that deputies assigned to the Department of Public Safety, Multnomah County, Oregon, consider important when making a decision regarding the disposition of a juvenile offender.
This empirical study developed as a result of participant observation. The authors spent one year working with deputies as part of police-social worker teams. During the course of the year it became apparent that police use a considerable amount of discretion when determining the disposition of a juvenile offender.
The purpose of this exploratory study was to investigate systematically:
- the types of information …

Sentencing: The Probation Officer, James Lowenthal
Sentencing: The Probation Officer, James Lowenthal
IUSTITIA
Sentencing offenders of the criminal law is a widely diverse and complex problem. Few guidelines are available for those upon whom the task has been thrust. Depending upon the jurisdiction, various parties are responsible for sentence determination: juries, administrative agencies, legislatures, and judges. Most jurisdictions, however, require the judge to make the final determination.' To aid in this determination, many jurisdictions, including federal district courts, require or permit judges to consider a presentence investigation report prepared by a professional probation officer. The use of these reports and recommendations are generally limited to felony cases or to specific crimes where probation …

Regional Commissions To Monitor Confinement Institutions: A Proposal, Arthur R. Landever
Law Faculty Articles and Essays
O N ANY GIVEN DAY, THERE ARE MORE THAN one million persons involuntarily confined within government institutions.1 Those in custody whether committed to mental institutions, jails, juvenile facilities, or prisons, are the invisible Americans. Until recently, most of us on the outside were not particularly concerned about their lot. To the extent that we knew of their existence, we were relieved that they were out of our immediate neighborhoods and that we were "protected" from them. Increasingly, however, newspaper headlines or television screens have begun to show glimpses of these inmates as they riot; widespread abuses are exposed, and authorities …

The Negro College: Role And Prospect, Herman H. Long
Vanderbilt Law Review
American higher education, especially in the Negro college, is in a time of major crisis; the institutions are beset by many new problems and issues. Perhaps at no other time in the nation's history has higher education been more widely discussed and written about in the public press as well as in educational circles. Indeed, higher education has emerged in recent years as a national issue that ranks close to the problems of poverty, welfare, and the decline of the cities. A national policy on higher education is being formulated; resource allocation priorities are being determined; and Congress is struggling …

Legal Rights In A Juvenile Correctional Institution, Matthew L. Myers
Legal Rights In A Juvenile Correctional Institution, Matthew L. Myers
University of Michigan Journal of Law Reform
This article focuses on the effect on juvenile correctional institutions of the erosion of the "hands-off" doctrine and the introduction of procedural safeguards in the juvenile justice system. In so doing, the article examines the difficulties inherent in any attempt to reform institutional practices and procedures to accommodate the goals of the juvenile correctional model. In the juvenile context, the extent to which fundamental rights need or may be abrogated to allow the institution freedom to rehabilitate and treat its inmates is crucial. Therefore, this article examines three areas involving fundamental constitutional rights: imposition of punitive segregation, freedom of communication, …
