Pell Scholars and Senior Theses
This article proposes that educational and community based programs can help juveniles stay away from crime and prevent recidivism. A presentation of federal and state statistics, along with an analysis of the risk factors for delinquency, will be provided in order to illustrate the important areas that should be addressed in successful programs. Testimonies, including personal interviews with those who have experience working at the RI Training School, DCYF, Boys' Town, Child and Family Services will be shared as evidence of the research found. Finally, recommendations based on the findings will be proposed.

Community Standards V. Teacher Rights: What Is Immoral Conduct Under Missouri's Teacher Tenure Act, Conor Neusel
Missouri Law Review
In a recent Missouri case, Homa v. Carthage R-IX School District, the Court of Appeals for the Southern District upheld the Carthage School District's decision to terminate one of its program directors for engaging in "immoral conduct."6 The Carthage school board terminated Lynda Homa, a teacher, and the director of its Parents-as-Teachers program, after it found that Homa authorized a parent-educator to visit an incarcerated program participant to convince the participant to put her child up for adoption.7 Interestingly, the court did not base its determination solely on the inappropriate adoption discussion. In its opinion, the court put Freater emphasis …

The Lawyer Meets The Therapist, The Minister, And The Psychiatrist: Law School Cross-Professional Collaborations, Timothy W. Floyd
Mercer Law Review
Lawyers in practice rarely encounter purely legal problems. Understanding the social, economic, political, and historical context is often crucial to resolving legal issues, and legal decisions are often dependent upon business, scientific, medical, psychological, and technological information. Most legal representation occurs within some field of enterprise or industry, and nearly all representation of clients involves complex emotional and interpersonal dynamics.
Early in my legal career, I realized the importance of knowing other fields and specialties in order to be an effective lawyer. My first practice experience was in commercial litigation, and our firm represented clients from a wide range of …

These include the Older Americans Act services, Medicaid LTSS, transportation services, a nursing case management program, and mental health services for those living in nursing homes and assisted living facilities. Engendering The History Of Race And International Relations: The Career Of Edith Sampson, 1927–1978, Gwen Jordan
Chicago-Kent Law Review
Edith Sampson was one of the leading black women lawyers in Chicago for over fifty years. She was admitted to the bar in 1927 and achieved a number of firsts in her career: the first black woman judge in Illinois, the first African American delegate to the United Nations, and the first African American appointed to the North Atlantic Treaty Organization. Sampson was also a pro-democracy, international spokesperson for the U.S. government during the Cold War, a position that earned her scorn from more radical African Americans, contributed to a misinterpretation of her activism, and resulted in her relative obscurity …

Someone's Afoot: Wisconsin's Foreign Guardianship Transfer Law, Kurt M. Simatic
Someone's Afoot: Wisconsin's Foreign Guardianship Transfer Law, Kurt M. Simatic
Marquette Law Review
Due to a “grayer” and more mobile population with diminished mental capacities, the subject of interstate guardianships is attracting much-needed attention. In 2006, Wisconsin’s landmark guardianship reform included a process by which guardians and their wards could transfer their guardianships established in other states to Wisconsin. The statutory provisions providing for these “foreign guardianships” were a step in the right direction. However, the reality of transferring foreign guardianships and modifying them to comply with Wisconsin law has proved troublesome.
This Comment will focus on how Wisconsin’s foreign guardianship transfer law developed, the shortcomings in the law that have arisen over …

Every Adolescent Deserves A Parent, Dale Margolin Cecka
Every Adolescent Deserves A Parent, Dale Margolin Cecka
Law Faculty Publications
This article argues that all adolescents, indeed all human beings, deserve at least one parent—one person who takes the good with the bad because that person’s life is intertwined with the child’s. The child matters to the parent in a way that a friend, nephew, or foster child may not. Child welfare professionals must never lose sight of this principle when they recruit, train, and maintain parents for adolescents. The parent can be someone who is already in the young person’s life or someone who has been unable to parent in the past, but is now ready to secure that …
The Jessica Lenahan Nee Gonzales Story, Radha Mohan
The Jessica Lenahan Nee Gonzales Story, Radha Mohan
Connecticut Journal of International Law
On June 22, 1999, Simon Gonzales abducted his three daughters from their mother's residence in Castle Rock, Colorado, in violation of a domestic violence restraining order.' Jessica Gonzales repeatedly called the local police department and asked them to locate her husband and children to enforce the order.' The police failed to respond, though they were obligated under state law to arrest any individual who violated a restraining order.3 Mrs. Gonzales grew increasingly concerned and telephoned the police repeatedly, explaining Mr. Gonzales's precarious mental state and the unusual phone calls she received from Mr. Gonzales's girlfriend, regarding his behavior.' The police …
Un-Convicting The Innocent: The Case For Shaken Baby Syndrome Review Panels, Rachel Burg
Un-Convicting The Innocent: The Case For Shaken Baby Syndrome Review Panels, Rachel Burg
University of Michigan Journal of Law Reform
This Note proposes that states should develop error-correction bodies to identify past errors that have resulted in wrongful convictions of people accused of shaking a child. These institutions, which I call SBS Review Panels, would be similar to the error-correction bodies and commissions that have recently been established throughout the world to deal with various sorts of wrongful convictions. An SBS-specific commission should be developed because of the high level of scientific expertise that is required to fully understand this diagnosis and the problems associated with using the triad of medical findings as evidence of the defendant's conduct. Part I …
Reform That Understands Our Seniors: How Interdisciplinary Services Can Help Solve The Capacity Riddle In Elder Law, Thomas Richard Stasi
Reform That Understands Our Seniors: How Interdisciplinary Services Can Help Solve The Capacity Riddle In Elder Law, Thomas Richard Stasi
University of Michigan Journal of Law Reform
This Note suggests an interdisciplinary approach to assist in determinations of legal capacity. It also urges an amendment to the Model Rules and current law firm business models, so attorneys can better approach capacity challenges. While this Note does not presume to resolve the problems faced by capacity determinations, the purpose is to offer functional alternatives to the current working models. Part I reviews the Model Rules' treatment of capacity issues, detailing attorneys' conflicting ethical duties and the ambiguous methodology for capacity evaluations. Part II examines the customary processes that attorneys presently follow for seeking diagnostic evaluations and highlights their …
