Public Regulation Of Water Power In The United States And Europe, John A. Fairlie Apr 1911

Public Regulation Of Water Power In The United States And Europe, John A. Fairlie

Michigan Law Review

The law of water rights in the United States has been for the most part regulated by the several states, subject, however, to the power of Congress to regulate interstate and foreign commerce, (which includes the control of navigation and of navigable streams in the interest of commerce) and to the control of the United States over waters on public lands and rivers on the international boundaries. The laws of the several states show considerable variation; but in respect to the use of water power, they have until within a few years been based mainly on the protection of private …

The Gibbons V. Ogden Fetish, Fred'k H. Cooke

Michigan Law Review

It was, we believe, Huxley who once said something to the effect that, as soon as one becomes an authority in science, he becomes a nuisance. In many a field of human activity, we find illustrations of the influence of a great name in retarding the progress of thought. Cuvier and Agassiz furnish notable instances in the realm of natural science. For centuries the great authority of Galen operated to paralyze progress in medicine. Still better known are instances of supposedly infallible individuals, or organizations, or writings, in retarding progress in theology. The same influence has notoriously operated in jurisprudence. …

The Illinois Ten-Hour Labor Law For Women, Andrew Alexander Bruce Nov 1909

The Illinois Ten-Hour Labor Law For Women, Andrew Alexander Bruce

Michigan Law Review

There are few cases before the American courts today which are of more significance than that which has recently been brought in the Illinois courts by William E. Ritchie of Chicago and which seeks "to enjoin the prosecuting officers of the state from enforcing the provisions of the so-called Women's' Ten-Hour Labor Law. The case of course involves the somewhat mooted question as to whether the remedy in such cases, if remedy there be at all, is by injunction, or whether the slower and more unsatisfactory procedure of a writ of error is not technically demanded, but this question is …

Labor Organizations In Legislation, Jerome C. Knowlton Jan 1908

Labor Organizations In Legislation, Jerome C. Knowlton

Articles

During the first months of the current year, the Supreme Court of the United States handed down three decisions on important questions in labor legislation.1 The Employers' Liability Act was declared unconstitutional, but on grounds that may be avoided by subsequent legislation; the boycott was decided to be an unlawful conspiracy against interstate commerce, and in violation of the Anti-Trust Act and the congressional enactment providing criminal punishment for the discharge of an employee because of his membership in a labor organization was also held unconstitutional. These decisions have been unjustly spoken of by some, as unreasonably severe on labor …

Police Regulation Of Sleeping Car Berths, Edson R. Sunderland Jan 1908

Police Regulation Of Sleeping Car Berths, Edson R. Sunderland

Articles

From the time of the introduction of the sleeping car there has been a constant feud between the sleeping car companies and the travelling public in regard to the upper berths. The exigencies of the situation have, of course, made economy of space a prime requisite in sleeping car construction, and there is no doubt but that a high degree of success in this respect has attended the efforts of the sleeping car builders.

A Written Constitution In Some Of Its Historical Aspects, Andrew C. Mclaughlin Jun 1907

A Written Constitution In Some Of Its Historical Aspects, Andrew C. Mclaughlin

Michigan Law Review

That an institution of government, like an institution or practice of society, is a growth and not a creation is now an accepted proposition. No one seeks to argue for it; no one endeavors to deny it. The introduction of this idea into our political thinking strongly influenced our methods and our ideas. In no field of study has the evolutionary idea shown itself more strongly than among workers in history and political science. And yet occasionally one is surprised by seeing how recently this idea has manifested itself in the examination of some historical problems. Until a short time …
