The Cost Of Criminal Justice In West Virginia, George A. Shipman, Carl M. Frasure
The Cost Of Criminal Justice In West Virginia, George A. Shipman, Carl M. Frasure
West Virginia Law Review
The National Commission on Law Observance and Enforcement, generally known as the Wickersham Commission, is popularly associated with prohibition, as critic, protagonist, propagandist, or apologist, depending upon the point of view. The more fundamental aspects of its work have escaped popular attention. The first two reports dealt with the problem of national prohibition. Twelve more were devoted to other phases of crime and its treatment. Here attention is to be devoted to the Report on the Cost of Crime in an effort to determine the economic burden through taxation, private expenditures, and economic loss which results from the necessity of …
Public Utilities - Private Carrier Cannot Be Made A Common Carrier By Legislative Fiat
Public Utilities - Private Carrier Cannot Be Made A Common Carrier By Legislative Fiat
Michigan Law Review
The appellant, a private carrier for hire, was arrested for operation of motor vehicles upon the state highways without having obtained a certificate of public convenience and necessity from the state railroad commission and without having paid the mileage tax required by the state statute. This statute also gave the commission power to fix and approve rates and schedules, and otherwise regulate carriers. It further stated that, if any of its provisions were held to be unconstitutional, the validity of the remaining portions should be unaffected. Laws of Florida, 1929, c. 13700. In view of this latter provision, the state …

Foreign Diplomats And The Prohibition Laws, Lawrence Preuss
Foreign Diplomats And The Prohibition Laws, Lawrence Preuss
Michigan Law Review
Notwithstanding the general and inclusive nature of the Eighteenth Amendment and of the enforcement legislation enacted under its terms, the executive departments of the national government have acted on the assumption that foreign diplomats are exempted from the operation of the prohibition laws, and have issued regulations by which the importation of liquor by members of this class is permitted. According to statements of the responsible officers concerned, this privilege is based upon "international comity and usage," and upon "the established principles of international Jaw and the statutes of the United States, including the provisions of sections 4063-4065 of the …
Report On Lawlessness In Law Enforcement, John Barker Waite
Report On Lawlessness In Law Enforcement, John Barker Waite
Michigan Law Review
The first part of this Report offers taxpayers little return on their investment. All it even purports to do is to inform the public that the police throughout the country sometimes use intolerable, brutal methods to extract information concerning crime and occasionally keep arrested persons out of communication with lawyers and friends until they can be questioned at length. But of these facts the public was already convinced through newspaper and magazine. Indeed, the Report itself uses the widespread public knowledge of the evil as evidence of its existence. Yet, beyond this repetition of already accepted beliefs, the Report really …

A Review Of Common Carrier Motor Vehicle Regulation, Karl Stecker
A Review Of Common Carrier Motor Vehicle Regulation, Karl Stecker
Washington Law Review
Perhaps no other single factor has played so great a part in the revolution of the economic and social life of the nation during the past generation as the motor vehicle. With the growth of its importance in transportation has come the necessity for regulation. Broadly speaking, outside of the matter of general registration, the regulation, or necessity for regulation, falls within three periods corresponding with the improvement of the motor vehicle itself and with the development of the highways (1) the intracity or "jitney bus" period, (2) the intrastate period, and (3) the interstate period. The regulation of the …

Some Comments On The Reserved Power To Alter, Amend And Repeal Corporate Charters, Gustavus Ohlinger
Some Comments On The Reserved Power To Alter, Amend And Repeal Corporate Charters, Gustavus Ohlinger
Michigan Law Review
The old theories as to the nature, creation and powers of corporations which during the last hundred years have been obscured, but today are coming more and more to the fore in legal literature, in the adjudications of the courts, and in recent revisions of corporation acts suggest a re-examination of the power of state legislatures to alter, amend and repeal corporate charters under the reservations contained in many state constitutions and statutes, both as related to those theories and as they apply to recent and impending social and economic changes.
