Constitutional Law--Church And State--Freedom Of Religion--The Constitutionality Under The Religion Clauses Of The First Amendment Of Compulsory Sex Education In Public Schools, Michigan Law Review
Michigan Law Review
It has been said that "[s]ex education, once the domain of the church and the home, has by necessity, become a responsibility of the schools." Indeed, by the operation of most state education statutes, sex education can be made compulsory in public primary and secondary schools if it is taught as part of otherwise compulsory classes or if the local school authorities have prescribed sex education courses as a compulsory part of the curriculum. While some of the state statutes authorize exemptions on religious grounds, most do not. Nevertheless, the introduction of sex education into public schools has not been …

Decentralization Of Metropolitan Government: Reform In Indianapolis, Charles T. Richardson
University of Michigan Journal of Law Reform
This note will deal first with the reasons for centralization of local governments and how certain cities, especially Indianapolis, have achieved that goal. The issue of involving smaller communities in the solution to urban problems will then be discussed, first in the context of certain objections to the Indianapolis consolidation, then in the context of the achievement record of community development corporations, and finally with relation to MINIGOV itself. Part IV will consider specific sections of the MINIGOV bill dealing with citizen participation in land use planning and development, and Part V will more broadly compare the Indianapolis scheme to …

Damages In Housing Discrimination Cases, James A. Ciocia
Damages In Housing Discrimination Cases, James A. Ciocia
Cleveland State Law Review
The existance of a shortage of adequate housing in the United States has further intensified the problems of those who suffer most when there is a shortage of anything-the minority groups. ... Contributing to the awareness of the public is the salient fact that within the last ten years there has been a consistent increase in the number of court cases dealing with housing discrimination. The scope of these cases has expanded from what had been a broad interpretation of public accommodation statutes to the award of damages, both compensatory and punitive, for private acts of discrimination which allegedly precipitated …
Non-Profit Types, Uses, And Abuses: 1970, Howard L. Oleck
Non-Profit Types, Uses, And Abuses: 1970, Howard L. Oleck
Cleveland State Law Review
American society long has consisted, to an extraordinary extent, of voluntary associations of persons and organizations not-for-profit, but for the public good (pro bono publico). No other nation in the world even approaches the United States in number and activity of non-profit organizations. These organizations are based on the characteristic American tendency to form groups (to associate themselves) voluntarily, for the accomplishment of social, religious, educational, fraternal, economic, and other purposes. Americans are the greatest "joiners" in the world. American non-profit organizations, generally speaking, are a magnificent part of the society, despite the disturbing growth of abuses among them.

Injuries From Electronic Power Sources, Charles H. Grace, Sheila M. Kahoe
Cleveland State Law Review
In order to understand how the existing products liability law applies to electronic products, it is necessary to examine the methods by which such products are distributed, and the manufacturers' attitude toward the inclusion of safety devices in the production of these products. The four characteristics of electronic products that most affect their legal treatment will be identified and discussed, and the three principal theories most often used for the prosecution of products liability cases will be described herein, with emphasis on the features most likely to be involved in electronic cases.
Parking Lots And Personal Injuries, Theodore V. Boyd
Parking Lots And Personal Injuries, Theodore V. Boyd
Cleveland State Law Review
When a negligent injury occurs as a result of an encounter with obstacles in a parking lot, the question presented is who, if anyone, is liable for the injury. This article will examine the current state of the law pertinent to the question of liability and discuss the adequacy of that law.
Federal Taxation And Non-Profit Organizations, Marcus Schoenfeld
Federal Taxation And Non-Profit Organizations, Marcus Schoenfeld
Cleveland State Law Review
The Revenue Act of 1969 is one of the greatest overall changes in the revenue laws since the introduction of the federal income tax . Perhaps the most extensive changes were made in the area of tax-exempt organizations. Only some of these changes were within of the topic of this presentation, and some of the other changes in the "charitable" area merit great discussion-for example charitable remainder trusts. Even the topics discussed herein, of necessity were discussed briefly due to lack of time and Regulations. The full the 1969 Act on non-profit organizations will not be apparent for quite some …

Over 65 cases were decided by Michigan courts during the Survey period dealing with some aspect of property law. Most of these cases raise property questions which are only incidental to nonproperty issues and, as a result, will not be discussed in this article. Similarly, those cases which have no precedential value, restate old law, or confirm an established trend are not considered worthy of discussion. Accordingly, in our judgment, only 16 property cases decided during the Survey period merit protracted attention.
Privileges And Immunities Of Non-Profit Organizations, Gerard D. Dimarco, Ira O. Kane
Privileges And Immunities Of Non-Profit Organizations, Gerard D. Dimarco, Ira O. Kane
Cleveland State Law Review
"And now abideth, faith home and charity, these three; but the greatest of these is charity." This unsubtle reference to the word charity describes superficially the field of non-profit or not-for-profit corporation law. The objective of this paper is not to delve into the intricacies and complexities of the non-profit area, but rather to make manifest a few of the many privileges and immunities granted to non-profit corporations.
