Compulsory Home Repair Laws, Maynard L. Graft Jr. Jan 1971

Compulsory Home Repair Laws, Maynard L. Graft Jr.

Cleveland State Law Review

In recent years legislative bodies at various levels of government have recognized the need for legally requiring the maintenance of housing at certain minimum standards. Such regulation has been deemed necessary because of the deterioration experienced by practically every major city in America. This deterioration causes a downward spiral usually resulting in complete blight in the deteriorating area. Newsman's Immunity Statute--A Comparison Of Legislative Intent To Statutory Form, Ignazio J. Ruvolo

San Diego Law Review

The purpose of this Article will be to evaluate the need to protect the identity of sources of information from disclosure by extending the immunity statute to both newsmen and their sources. Also to be considered is the equally basic need to protect society from abuse of the immunity by unknown libelers and the infringements placed on the interests of justice by such an extension of the statute.

Coastal Zoning, James H. Ewalt, Robert H. Deaderick Jan 1971

Coastal Zoning, James H. Ewalt, Robert H. Deaderick

Vanderbilt Journal of Transnational Law

In today's atmosphere of environmental awareness, protection of the coastal wetlands seems appropriate for many reasons. The wetlands include much of the most aesthetically pleasing areas in the United States, while also being a source of recreation and enjoyment. Man has long had an economic interest in the valuable natural resources, minerals and fish which the wetlands yield. The result is a conglomerate of conflicting demands upon the wetlands. The situation begs for definition and control of these interests so that the full potential of the coast can be realized.

Zoning has often been suggested as a means to protect …

Representation For The Poor In State Rulemaking, Allan Ashman Dec 1970

Representation For The Poor In State Rulemaking, Allan Ashman

Vanderbilt Law Review

After a violent summer of urban unrest and civil disorder, President Johnson established the National Advisory Commission on Civil Disorders in 1967 to find out what happened in our nation's cities, why it happened, and to suggest ways to prevent it from occurring again. One of the findings of the Commission was that from the vantage point of the poor ghetto resident, local government was distant and unconcerned. For the poor person, particularly the poor black ghetto resident, the possibility for effective change either in his personal life style or in the political system appeared remote.' Reflecting upon this gulf between …

Civil Rights--Segregation--Federal Income Tax: Exemptions And Deductions--The Validity Of Tax Benefits To Private Segregated Schools, Michigan Law Review

Michigan Law Review

In granting the preliminary injunction, the district court found that plaintiffs were asserting a substantial constitutional claim and had a reasonable possibility of success. Balancing the equities of the parties, the court decided that the possibility of significant adverse effect on the Commissioner and schools awaiting tax benefits was not great and was in any event far outweighed by the harm which could result from a denial of the requested relief pendente lite. Thus, the court found that the threat of irreparable injury justified the issuance of a preliminary injunction. The propriety of the court's decision to grant a preliminary …
